Quick answer: when LOT compensation may be available
LOT Polish Airlines is an EU carrier. That matters because EU 261 can cover LOT flights departing from the EU and many LOT flights arriving in the EU from outside Europe. Your nationality and ticket price do not decide the claim. The route, operating carrier, final arrival delay, cancellation notice and reason for disruption do.
The strongest LOT compensation cases usually involve arrival at the final destination at least 3 hours late, cancellation announced less than 14 days before departure, involuntary denied boarding due to overbooking, or a missed connection on one through booking.
| LOT flight situation | Likely coverage | Why it matters |
|---|---|---|
| LOT flight from Warsaw to another EU airport | Yes, EU 261 | The flight departs from the EU and LOT is the operating carrier. |
| LOT flight from Warsaw to the US, Canada or Asia | Yes, EU 261 | The flight departs from an EU airport. |
| LOT flight from the US, Canada or Asia to Warsaw | Usually yes, EU 261 | LOT is an EU airline operating a flight into the EU. |
| LOT codeshare sold by another airline | Check the operating carrier | The claim usually goes against the airline that operated the disrupted flight. |
| Separate tickets through Warsaw | Only the disrupted ticket is checked | A missed self-connection is much weaker than one through-ticket journey. |
Most important rule
How much LOT compensation can you claim?
EU 261 compensation is fixed by distance. It is not a refund of the ticket price and it does not depend on whether your ticket was cheap, flexible, business class or bought with miles. If the legal conditions are met, each passenger can have an individual claim.
| Flight distance | EU 261 amount | Typical LOT examples |
|---|---|---|
| Up to 1,500 km | EUR 250 | Warsaw - Berlin, Warsaw - Vienna, Krakow - Frankfurt |
| 1,500-3,500 km | EUR 400 | Warsaw - Madrid, Warsaw - Athens, Warsaw - Lisbon |
| Over 3,500 km | EUR 600 | Warsaw - Chicago, Warsaw - New York, Warsaw - Toronto, Warsaw - Seoul |
| Long-haul rerouting with 3-4 hour arrival delay | EUR 300 | The EUR 600 amount may be reduced by 50% in some rerouting cases. |
Long-haul LOT routes such as Warsaw to Chicago, New York, Toronto, Delhi or Seoul normally sit above 3,500 km. If EU 261 applies and no valid extraordinary-circumstances defence is proven, the headline amount is usually EUR 600 per passenger.

Delayed, cancelled, overbooked or missed connection?
The same regulation can cover several different LOT disruptions, but the test is not identical in each case. A delay case starts with arrival time. A cancellation case starts with the notice period and replacement flight. An overbooking case starts with whether you were involuntarily refused boarding despite meeting the boarding conditions.
| Problem | Typical compensation trigger | What to check first |
|---|---|---|
| Delay | Arrival at final destination is 3+ hours late | Check the actual door-open arrival time and the cause of the delay. |
| Cancellation | Short notice cancellation and no qualifying replacement flight | Refund or rerouting rights are separate from fixed compensation. |
| Denied boarding | You were involuntarily refused boarding despite having a valid booking | Overbooking claims are often strong if you checked in and arrived on time. |
| Missed connection | One booking and late arrival at the final destination | The full journey matters when Warsaw is only a connection point. |
| Downgrade | You flew in a lower cabin than booked | This is a different EU 261 remedy based on part of the ticket price. |
LOT flight delay compensation
A LOT delay can qualify when you arrive at the final destination 3 hours or more after the scheduled arrival time and the reason was within the airline's responsibility. Late aircraft rotation, crew planning issues and ordinary technical faults often need close checking before accepting a refusal.
LOT cancelled flight compensation and refund rights
When LOT cancels your flight, you normally have a right to choose refund or rerouting. Fixed compensation is a separate question. If the cancellation was announced less than 14 days before departure and the replacement flight did not meet the timing exceptions, EUR 250-600 compensation may still be due.
LOT overbooking and denied boarding
If LOT refuses boarding because the aircraft is overbooked, keep proof that you had a valid reservation, checked in on time and were at the gate as instructed. Involuntary denied boarding is one of the clearer EU 261 claim types when the passenger documents the event well.
LOT routes where passengers often miss compensation
LOT long-haul routes are especially important because the compensation band can reach EUR 600. This includes flights between Warsaw and North America, India, South Korea and other non-EU destinations, plus one-ticket connections through Warsaw.
| Route example | Coverage point | Practical note |
|---|---|---|
| Chicago - Warsaw on LOT | EU 261 can apply both ways | Often EUR 600 if the disruption qualifies. |
| New York or Newark - Warsaw on LOT | EU 261 can apply both ways | Long-haul LOT route, final-arrival delay is key. |
| Toronto - Warsaw on LOT | EU 261 can apply both ways | Covered when LOT operates the flight into the EU. |
| Delhi - Warsaw on LOT | EU 261 can apply both ways | LOT is an EU carrier; long-haul band can matter. |
| Seoul - Warsaw on LOT | EU 261 can apply both ways | Check operating carrier and one-ticket connections. |
| Warsaw - London on LOT | EU 261 from Warsaw, UK 261 from London | Currency and enforcement path can differ. |
Warsaw connections deserve special attention. If your itinerary was sold as one booking, a short delay on an earlier LOT segment can become a valuable claim when it makes you arrive at the final destination 3+ hours late. If the second flight was on a separate ticket, the legal protection is usually much weaker.
For route-specific evidence and remedies, see the LOT guides for Toronto-Warsaw, Chicago-Warsaw, New York-Warsaw and California-Warsaw. Passengers comparing different legal systems can also use the LOT EU261 versus US DOT guide.
After a cancellation, compare the earliest available itinerary in the LOT Star Alliance rerouting guide. If the disruption leaves you waiting overnight, preserve receipts and check the LOT transatlantic care and expense guide.

When LOT can refuse compensation
LOT can refuse fixed compensation if it proves extraordinary circumstances and shows that reasonable measures could not have avoided the disruption. Severe weather, airport closure, security risk, air traffic control restrictions and some external strikes can be valid defences.
But a refusal should be specific. A short phrase such as "technical reasons", "operational reasons" or "rotation delay" does not automatically defeat the claim. Ordinary aircraft maintenance and internal airline planning problems are usually treated differently from truly external events.
Do not stop at the first refusal
Refund, rerouting and airport care are separate rights
After a LOT cancellation or long delay, passengers often receive messages about rebooking, vouchers or ticket refunds. These rights are important, but they are not the same as fixed compensation. In many cases you should check three separate buckets.
- Refund or rerouting: your choice after cancellation or a very long delay.
- Care at the airport: meals, refreshments, hotel and transport when the waiting time requires it.
- Fixed compensation: EUR 250, EUR 400 or EUR 600 when the EU 261 compensation conditions are met.
If LOT offers a voucher instead of money, check the conditions carefully. Voucher acceptance should not replace cash rights unless you clearly and voluntarily agree. Our airline voucher guide explains how to ask for cash.
How to claim LOT Polish Airlines compensation
- Confirm the operating carrier. LOT-marketed tickets can involve codeshare partners. EU 261 usually points to the operating airline.
- Measure the delay at final arrival. For connections, use the final destination on the same booking, not only the delayed segment.
- Keep evidence. Save airline notices, booking documents, boarding passes, screenshots and receipts.
- Send a clear cash demand. State the flight number, date, route, passenger names, legal basis and requested EUR amount.
- Escalate if LOT refuses or ignores the claim. Depending on the route and jurisdiction, this can involve a national enforcement body, consumer process or court route.
| Evidence | Why it helps |
|---|---|
| Booking confirmation or e-ticket | Shows route, passenger name, booking reference and ticketed itinerary. |
| Boarding pass or check-in proof | Especially important for denied boarding and overbooking cases. |
| Airline emails, SMS and app notifications | Proves cancellation notice, delay updates and replacement flights offered. |
| Arrival evidence | Screenshots from airport boards, flight trackers or messages can support the final-arrival delay. |
| Receipts for meals, hotel and transport | Duty-of-care expenses are separate from fixed compensation. |

FAQ: LOT Polish Airlines compensation
1. Can I claim compensation from LOT Polish Airlines?
Yes, if the flight is covered by EU 261 and the disruption qualifies. LOT is an EU airline, so many LOT flights from the EU and many LOT flights into the EU can be covered.
2. How much is LOT flight compensation?
The fixed EU 261 amounts are EUR 250, EUR 400 or EUR 600 per passenger, depending mostly on the flight distance. Most intercontinental LOT routes to or from Warsaw fall into the EUR 600 band when eligible.
3. Does EU 261 apply to LOT flights from the United States to Poland?
Usually yes when LOT operates the flight, because LOT is an EU carrier flying into the EU. The route still needs to meet the delay, cancellation or denied-boarding conditions.
4. Can LOT refuse compensation because of a technical problem?
A normal technical fault is often part of airline operations and does not automatically remove compensation rights. LOT would need to show a genuinely extraordinary circumstance if it relies on that defence.
5. What if LOT cancelled my flight and offered a refund?
A refund or rerouting is separate from fixed compensation. In some cancellation cases you may have a right to both a ticket refund or alternative flight and EUR 250-600 compensation.
6. Who is responsible on a LOT codeshare flight?
EU 261 claims usually go against the operating carrier, not necessarily the airline whose code appears on the ticket. Check which airline physically operated the disrupted segment.
7. How long do I have to claim against LOT?
Time limits depend on the jurisdiction. Polish transport claims are often assessed with a short one-year period, while other countries can allow longer periods, so LOT cases should be checked quickly.
