LOT Chicago-Warsaw flight compensation: ORD disruption guide

Short answer: a LOT-operated flight between Chicago O'Hare (ORD) and Warsaw Chopin (WAW) can be covered by EU261 in both directions. Warsaw-Chicago is covered because it departs the EU; Chicago-Warsaw is covered because LOT is an EU carrier arriving in the EU. The route is longer than 3,500 km, so an eligible delay, short-notice cancellation or involuntary denied boarding can carry a headline amount of EUR 600 per passenger.

LOT currently markets direct Chicago-Warsaw travel and also sells direct or connecting travel from Chicago to other Polish cities. Route seasons and operating patterns can change. The ticket for the disrupted date is the authoritative record.

When the amount is EUR 600 or EUR 300

The Chicago-Warsaw distance falls in the EU261 band for non-EU travel over 3,500 km. EUR 600 is the starting fixed amount where the disruption qualifies. Ticket price, Economy versus Business and the passenger's nationality do not change that band.

For delay, final arrival normally must be at least three hours late. For cancellation, notice and replacement timing matter. If LOT notified the passenger 14 days or more before departure, fixed cancellation compensation normally is not payable. Shorter notice can still be excluded where the replacement falls inside the statutory timing windows or a valid extraordinary circumstance is proved.

Article 7(2) permits a 50 percent reduction for long-haul rerouting when the replacement reaches the final destination no more than four hours late. This can reduce EUR 600 to EUR 300. It is not a general rule that every delay between three and four hours pays only EUR 300; the rerouting condition must be present.

Example: LOT's ORD-WAW aircraft has an unexpected ordinary component failure and passengers arrive seven hours late. Under the Court of Justice's van der Lans reasoning, an ordinary unexpected technical defect is generally inherent in airline operation. If LOT cannot prove an exceptional external cause, the fixed claim can be EUR 600 per passenger.

Example: LOT cancels ORD-WAW the evening before travel and reroutes a family of four through Frankfurt, reaching Warsaw ten hours late. If the cause is within LOT's responsibility, the family can have four individual EUR 600 claims, while meals and hotel expenses remain separate.

Final destination beyond Warsaw

Chicago passengers frequently continue through Warsaw to Krakow, Gdansk, Rzeszow, Prague, Vilnius or another city. When all sectors form one reservation, EU case law treats the connecting journey as a whole for final-arrival delay.

Example: ORD-WAW is 90 minutes late. The passenger misses WAW-BUD and reaches Budapest six hours after the original schedule. The first sector alone did not arrive three hours late, but the protected final destination did. The missed connection can therefore support the long-haul distance band if the remaining tests are met.

Separate tickets do not normally receive the same treatment. If the passenger independently bought ORD-WAW and WAW-BUD, LOT may assess its ticket only to Warsaw. The onward loss may need travel insurance, package law or a self-transfer guarantee.

Direct LOT flight or codeshare partner?

An LO number does not conclusively identify the operating airline. Check the words "operated by" on the e-ticket, boarding pass and booking record.

This matters most on domestic US feeders. United may operate a flight from another US city to ORD while LOT operates the transatlantic sector. If the feeder causes the missed connection, liability cannot be assigned to LOT merely because the complete ticket was sold on lot.com. Conversely, a LOT-operated ORD-WAW sector remains a LOT operation even if another airline marketed it under its own code.

Save both the marketing and operating flight numbers, but address the fixed EU261 claim to the operating carrier identified by the facts. Ticket refunds can involve the ticket issuer or merchant separately.

Cancellation and rerouting from Chicago

When LOT cancels a covered flight, EU261 gives a choice between:

  1. reimbursement for unused travel, with a return flight where the journey has become pointless;
  2. rerouting at the earliest opportunity under comparable conditions; or
  3. travel at a later date convenient to the passenger, subject to available seats.

Choose before accepting a refund or voucher. A passenger who still needs to reach Poland should ask LOT to compare reasonable alternatives, which can include another LOT service, a partner connection or a different gateway. Alliance membership does not guarantee a seat, but visible partner inventory can be useful evidence that a materially earlier route existed.

Meals, hotel and transport at ORD

On a covered LOT operation, Article 9 care can apply while a passenger reasonably waits. For long-haul departure delay, the regulation's care threshold is tied to an expected delay of four hours; cancellation and rerouting can trigger care through their own provisions.

Care includes reasonable meals and refreshments, two communications, hotel accommodation when an overnight stay becomes necessary, and transport between the airport and accommodation. Extraordinary circumstances can defeat fixed compensation but do not erase EU261 care.

Ask LOT staff or its handling agent first. If assistance is not supplied, purchase a practical option rather than a luxury substitute and keep itemised receipts. Record why an airport hotel, taxi or meal was necessary and whether the airline desk was closed.

US DOT rules do not replace this EU261 care duty with a universal federal hotel rule for LOT. DOT is particularly important for a ticket refund when a US itinerary is cancelled or significantly changed and the passenger rejects travel.

Evidence checklist for ORD-WAW

  • original e-ticket and PNR showing every destination;
  • the line naming the operator of each sector;
  • original and replacement boarding passes;
  • scheduled and actual final-arrival time;
  • LOT emails, SMS messages and app notices;
  • airport display screenshots with date, airport and gate visible;
  • written or recorded wording of the disruption reason;
  • partner-flight availability requested at the time;
  • itemised care receipts and proof of payment;
  • LOT form confirmation and case reference.

Avoid relying only on a flight-tracking screenshot. It can corroborate timing, but the booking, airline messages and door-opening arrival evidence make a stronger file.

Send a focused claim

State the operator, date, ORD and final airport, final-arrival delay, cause supplied and requested amount. If the journey continued beyond Warsaw, explain that all sectors were one booking and attach the full ticket. Separate EUR 600 fixed compensation from refund, rerouting and expense requests.

Use LOT's post-journey form. If the response says only "operational reasons", "technical reasons" or "weather", ask for the event affecting the exact aircraft, its timing, causal link and reasonable measures. The LOT rejected-claim guide provides a structured rebuttal.

The EU reform adopted in July 2026 is not yet applicable on 11 August 2026. Do not substitute its future complaint timetable for the current route analysis or the limitation law of a possible court.
