LOT Star Alliance rerouting after cancellation: ask for the earliest route

Short answer: when LOT cancels a covered flight, EU261 lets the passenger choose reimbursement, rerouting at the earliest opportunity or travel on a later convenient date, subject to available seats. Earliest rerouting is not automatically limited to the next LOT-operated service. A reasonable partner itinerary can matter, but Star Alliance membership does not by itself guarantee access to every seat or create a separate passenger-rights rule.

Fixed EU261 compensation is a separate test. Taking a replacement flight does not automatically waive EUR 250-600, although the final replacement arrival can permit a 50 percent reduction in defined cases.

What "earliest opportunity" means in practice

Article 8 does not say that passengers must wait for the same flight number, aircraft type or airline's next identical route. LOT should assess a reasonable route to the booked final destination under comparable transport conditions.

Depending on the origin and destination, alternatives can include:

  • another LOT departure from the same airport;
  • a LOT route from a nearby airport with positioning arranged;
  • a Star Alliance carrier through Frankfurt, Munich, Vienna, Zurich, Copenhagen or another connection point;
  • another carrier outside the alliance where it materially improves arrival;
  • rail or ground transport for an appropriate short sector;
  • a combination that protects the original final destination.

This is not an absolute promise that LOT must buy the most expensive public fare visible online. Seat inventory, ticketing access, visas, airport changes, baggage and comparable conditions all matter. The passenger's best evidence is a contemporaneous set of plausible options plus a written request that LOT evaluate them.

Example: LOT cancels ORD-WAW and offers a departure two days later. A same-day itinerary on a partner is visibly available and reaches Warsaw the next morning. The passenger asks LOT to book it and records the refusal. That is stronger evidence than silently buying a premium last-seat fare first.

Star Alliance is evidence, not the legal source

LOT belongs to Star Alliance and publishes codeshare partners including Air Canada, Lufthansa, United and other airlines. Commercial cooperation can make rebooking easier, but EU261 creates the rerouting right. Alliance branding does not decide legal liability.

The operating carrier still matters after rebooking. If LOT replaces a cancelled LOT flight with United or Air Canada, the original cancellation claim remains assessed against LOT. Any new disruption on the replacement sector is analysed using its actual operator, direction and legal regime.

Do not assume a partner flight inherits LOT's EU status. A United-operated inbound flight from the United States to the EU generally has a different EU261 scope from a LOT-operated inbound flight. Save the reissued ticket and every "operated by" line.

Comparable transport conditions and cabin

Comparable conditions do not guarantee the same seat number, meal or aircraft. Cabin is more important. A passenger originally booked in LOT Business should ask for business-class rerouting where reasonably available, not accept Economy without recording the downgrade.

If LOT reroutes in a higher cabin, it cannot charge an upgrade supplement under Article 10. If it places the passenger in a lower cabin, downgrade reimbursement can be 30, 50 or 75 percent of the relevant sector price, depending on distance. A transatlantic downgrade normally points to the 75 percent band, with the calculation limited to the downgraded segment under the Court of Justice's Mennens method.

A passenger may choose a lower cabin to leave earlier. Get written confirmation that the change is involuntary or required by the reroute, the original cabin and how LOT will calculate the refund. The LOT downgrade guide covers the percentage claim.

Nearby airports and positioning transport

A replacement can involve a different airport. Ask LOT to specify who covers positioning and whether baggage will transfer.

EU261 expressly addresses an alternative airport serving the same city or region: the carrier bears transport to the booked airport or another nearby destination agreed with the passenger. That is useful for JFK and EWR, or another genuine metropolitan-airport pair.

It should not be stretched casually to distant regions. SFO and LAX are not normal substitutes within one city. A passenger accepting a long repositioning should obtain an agreed flight, train or ground-transfer plan and its cost in writing.

US DOT treats a different origin or destination airport as a significant change. A passenger who rejects that changed itinerary can pursue the US refund route instead of accepting transport. The EU261 versus DOT guide explains the election.

When self-booking can be justified

Self-booking is strongest as a remedy for LOT's failure, not as the first action. Before purchasing:

  1. ask LOT for earliest rerouting and state the final destination;
  2. offer specific reasonable alternatives with times and cabins;
  3. preserve the airline's refusal, silence or unworkable proposal;
  4. warn that you may buy reasonable replacement transport if the duty is not met;
  5. choose a proportionate route and fare;
  6. retain availability screenshots, invoice, ticket and proof of travel.

The European Commission's interpretative guidelines explain that where the carrier fails to offer rerouting and the passenger arranges it, the carrier should reimburse necessary, appropriate and reasonable costs. Disputes remain possible, especially where LOT offered a viable route that the passenger rejected for preference rather than necessity.

Avoid luxury upgrades, unnecessary stopovers and speculative bookings. If only a high fare remains, capture the lower options disappearing and the urgency. A family should show why the purchased seats were the earliest reasonable set available together.

Care while waiting for rerouting

Passengers waiting for earliest rerouting can also have Article 9 care: reasonable meals, communication, hotel accommodation when overnight stay is necessary, and airport-hotel transport. Extraordinary circumstances do not erase care.

The duty changes when the passenger elects reimbursement or deliberately postpones travel to a later convenient date. LOT does not normally fund accommodation for days voluntarily added after the immediate transport problem has ended.

Ask for vouchers and hotel first. If assistance is unavailable, keep itemised receipts and select a practical option. Use the LOT transatlantic care guide to separate those expenses from replacement-ticket cost.

Canadian and US differences

Canadian APPR also regulates rebooking on flights to and from Canada. The detailed obligation depends on whether the carrier is large or small, the cause category and elapsed time. In defined cases, large-carrier rules can require travel on any airline and from a nearby airport. Confirm LOT's classification in its applicable Canadian tariff rather than assuming it.

US DOT's federal refund rule is different: it guarantees automatic refund after cancellation or significant change when the passenger rejects alternatives. DOT notes that airlines often offer rebooking, but the refund rule itself does not promise a particular partner seat.

Evidence for a rerouting dispute

  • original e-ticket, fare and cabin;
  • cancellation notice and timestamp;
  • complete final destination on one booking;
  • LOT's offered itinerary and arrival time;
  • screenshots of reasonable alternatives with date and price;
  • chat, call log or airport-desk notes showing the request;
  • written refusal or elapsed response time;
  • replacement invoice, e-ticket and boarding passes;
  • baggage and positioning arrangements;
  • itemised care receipts;
  • actual final-arrival evidence.

The July 2026 EU reform strengthens and clarifies future rerouting rights but is not yet applicable on 11 August 2026. Apply the current Article 8 and current Commission guidance to a present claim.

FAQ

Must LOT reroute me only on another LOT flight?

No automatic same-airline limit appears in Article 8. LOT should assess reasonable earliest transport, but a passenger is not guaranteed every public seat on every partner.

Does Star Alliance membership guarantee rebooking on United or Lufthansa?

No. It can make commercial alternatives relevant, but EU261 is the legal source and actual inventory, ticketing and route conditions still matter.

Can I buy my own replacement flight?

Potentially, where LOT failed to provide required rerouting and the purchase was necessary, appropriate and reasonable. Ask first and preserve the refusal and available options.

Can LOT reroute Business Class into Economy?

It may happen operationally, but an involuntary lower cabin can trigger Article 10 downgrade reimbursement. Record the original and replacement cabin.

Does accepting rerouting remove EU261 compensation?

No. Compensation has separate notice, delay and cause tests, although timely replacement arrival can permit a defined 50 percent reduction.
