LOT Toronto-Warsaw flight compensation: EU261 and Canadian APPR

Short answer: a LOT-operated Toronto-Warsaw flight can fall under EU261 even when it departs Canada because LOT is an EU carrier and the flight arrives in the EU. A qualifying long-haul delay, short-notice cancellation or involuntary denied boarding can therefore reach EUR 600 per passenger. Canadian Air Passenger Protection Regulations also apply to flights to and from Canada, but they use different cause, amount and procedure tests. A passenger cannot collect two inconvenience payments for the same disruption without accounting for the first one.

LOT currently sells direct travel between Toronto Pearson (YYZ) and Warsaw Chopin (WAW), with onward connections through Warsaw. Schedules can change by season, so the e-ticket and actual operating-carrier line are stronger evidence than a remembered timetable.

EU261 amount on YYZ-WAW

Toronto-Warsaw is a non-EU journey longer than 3,500 km. Under the current EU261 distance bands, the headline fixed amount is therefore EUR 600 for an eligible passenger. It is not based on the ticket price or cabin.

For a delay claim, arrival at the final destination must normally be at least three hours late. If LOT reroutes the passenger and the long-haul final arrival is no more than four hours late, Article 7(2) can permit a 50 percent reduction to EUR 300. EUR 300 is not a separate transatlantic rate and should not be used merely because the delay was between three and four hours without checking the rerouting condition.

Cancellation compensation uses a different test. Notice of at least 14 days normally removes the fixed payment. Shorter notice requires checking the replacement departure and arrival windows, the cause and whether LOT can prove extraordinary circumstances. Refund, rerouting and care remain separate from fixed compensation.

Example: LOT operates YYZ-WAW and an ordinary aircraft component fails before departure. The passenger reaches Warsaw eight hours late. If the defect is inherent in normal aircraft operation and LOT cannot prove an exceptional external event, EU261 can support EUR 600. Calling the issue "required for safety" does not by itself decide the EU test.

Example: severe conditions close Toronto Pearson and LOT demonstrates the direct causal link and reasonable measures. Fixed EU261 compensation may fail, but rerouting, reimbursement and care still require separate analysis.

Canadian APPR is a separate calculation

Canadian APPR applies to flights to, from and within Canada, including connecting journeys. It divides disruption causes into:

  • within the airline's control;
  • within the airline's control but required for safety; and
  • outside the airline's control.

Compensation for inconvenience is generally reserved for events within airline control and not required for safety. The amount depends on final-arrival delay and whether the airline is classified as large or small under its Canadian tariff.

Do not assume LOT's category from the aircraft size or from a list of Canadian airlines. APPR classification uses worldwide passenger numbers, and the carrier's applicable tariff should identify its status. Preserve the tariff or rights notice available for the travel date.

A Canadian request for delay or cancellation compensation must be sent to the airline within one year. The airline then has 30 days to pay or explain in writing why compensation is not owed. If the dispute remains unresolved after 30 days, the passenger can consider a complaint to the Canadian Transportation Agency and must show prior written contact.

APPR expressly prevents duplicate inconvenience compensation where the passenger has already received compensation for the same delay or cancellation under another passenger-rights regime. Disclose an EU261 payment in the Canadian request and identify whether another sum covers ticket price, expenses or inconvenience.

Rebooking, refund and care in Canada

Canadian rules require rebooking or refund options across all three cause categories, although the precise duty depends on carrier size and circumstances. EU261 independently gives a passenger whose LOT flight is cancelled a choice among reimbursement, rerouting at the earliest opportunity and travel at a later convenient date, subject to availability.

Do not click "refund" while still asking LOT to transport you. Reimbursement and rerouting are alternative solutions for the unused carriage. Fixed compensation and reasonable care costs are assessed separately.

Under Canadian rules, meals, communication and overnight accommodation can be due where the disruption is within airline control, including safety-related events, notice was given less than 12 hours before original departure and the passenger has waited at least two hours. EU261 care can be broader on a covered LOT-operated YYZ-WAW flight and is not removed merely because the cause was extraordinary.

If LOT does not provide assistance, ask first and then buy only what is reasonably necessary. Keep itemised receipts for meals, a practical hotel, transport between the airport and accommodation, and essential communication. A credit-card total without item detail is weak evidence.

Connections through Warsaw

One booking can extend the final-destination analysis beyond Warsaw. If YYZ-WAW-GDN is issued as one itinerary and the Toronto delay causes arrival in Gdansk five hours late, use Gdansk as the final destination for the delay test. The same principle can apply to an onward European destination.

The result changes with separate tickets. A passenger who buys YYZ-WAW from LOT and WAW-PRG independently may lose the second ticket after a late arrival. The Prague loss does not automatically become part of the EU261 LOT journey. Insurance, package rights or a self-transfer guarantee may be more relevant.

Evidence to collect at YYZ and WAW

Build one timeline rather than sending disconnected screenshots:

  1. Save the e-ticket, PNR and every sector with the operating carrier.
  2. Preserve the scheduled YYZ departure and final scheduled arrival.
  3. Screenshot LOT messages, gate displays and each stated cause.
  4. Record the first aircraft-door opening time at the final destination where possible.
  5. Keep original and replacement boarding passes and baggage receipts.
  6. Save partner-flight availability if LOT offered a materially slower reroute.
  7. Retain itemised meal, hotel and ground-transport receipts.
  8. Keep proof of the written LOT claim and its submission date.

If a codeshare partner operated the disrupted sector, direct the EU261 fixed-payment request to the operating carrier. Ticket refunds can involve the merchant or ticket issuer, while Canadian operating duties can require a separate operator analysis.

How to present the claim

Start with the remedy, not a long travel story. State the passenger names, e-ticket, date, affected flight, operator, route, final-arrival delay and cause supplied by LOT. Then separate the request into numbered amounts:

  • EU261 fixed compensation, if applicable;
  • reimbursement or rerouting issue;
  • reasonable care expenses with receipts;
  • Canadian APPR compensation, if relied on, with the carrier-size source and no-double-payment disclosure.

The EU passenger-rights reform adopted in July 2026 is not yet applicable on 11 August 2026. Its future nine-month EU claim procedure must not replace the current Canadian one-year APPR request deadline or a national court limitation period.

FAQ

Is a LOT flight from Toronto to Warsaw covered by EU261?

Yes, when LOT operates the flight and the other conditions are met. LOT is an EU carrier arriving in the EU from Canada.

Can a Toronto-Warsaw delay pay EUR 600?

Yes. The route exceeds 3,500 km, so EUR 600 is the headline EU261 amount for an eligible disruption, subject to the cause and any lawful rerouting reduction.

Can I claim both Canadian APPR and EU261 compensation?
