LOT California-Warsaw compensation: Los Angeles and San Francisco
Short answer: LOT-operated travel between California and Warsaw can be covered by EU261 in both directions. Los Angeles-Warsaw uses LAX and Warsaw Chopin WAW. LOT launched a seasonal San Francisco-Warsaw route from SFO in May 2026. Both are well over 3,500 km, so a qualifying disruption can carry a headline amount of EUR 600 per passenger.

LAX and SFO are not interchangeable local airports. They serve different metropolitan areas hundreds of kilometres apart. If LOT proposes one as a replacement for the other, agree the positioning flight or ground transport, timing and cost in writing before accepting.
California route and coverage matrix
| Affected sector | EU261 position | Practical issue |
|---|---|---|
| LAX-WAW operated by LOT | covered inbound because LOT is an EU carrier | preserve LAX departure and WAW arrival |
| WAW-LAX operated by LOT | covered as an EU departure | notice and replacement timing matter |
| SFO-WAW operated by LOT in its operating season | covered inbound because LOT is an EU carrier | preserve season-specific itinerary |
| WAW-SFO operated by LOT | covered as an EU departure | check whether rerouting changes airport or date |
| partner feeder to LAX or SFO | identify the feeder operator and one-ticket status | marketing code alone does not assign liability |
| California-Warsaw-Europe on one ticket | final destination can control delay | save all sectors and replacement flights |
LOT's official page describes SFO-WAW as a seasonal route that began on 6 May 2026. Do not assume it operates on every date or at a fixed frequency. For a claim, the confirmed ticket and cancellation notice are decisive.
EUR 600, final arrival and the 50 percent reduction
The EU261 long-haul distance band is clear for both California routes. Eligibility is not. A delay claim normally requires arrival at the final destination at least three hours late and no proven extraordinary-circumstances defence.
Cancellation compensation depends on when LOT informed the passenger and on the replacement schedule. At least 14 days' notice normally removes the fixed payment. With shorter notice, compare the offered departure and arrival against the statutory windows.
If LOT reroutes the passenger and the replacement long-haul journey reaches the final destination no more than four hours late, Article 7(2) can permit a reduction from EUR 600 to EUR 300. The airline should not halve the amount without identifying the qualifying reroute and actual final arrival.
Example: LOT operates LAX-WAW. A routine technical fault causes an eight-hour arrival delay. An unexpected ordinary component failure is generally inherent in airline operations under EU case law. If LOT cannot prove a genuinely external event, EUR 600 can be due.
Example: SFO-WAW is cancelled shortly before a seasonal departure and LOT reroutes the passenger the next day. If the cancellation was within LOT's responsibility, the passenger can assess EUR 600 separately from hotel, meals and the replacement journey.
The LOT technical-fault guide explains why "Dreamliner issue" or "technical reasons" is not a complete extraordinary-circumstances defence.
Seasonal SFO cancellation and rerouting
A seasonal route can produce a longer wait because the next same-route service may not be immediate. EU261 does not limit earliest rerouting to LOT's next SFO flight. The passenger should ask LOT to compare reasonable alternatives under comparable transport conditions.
Possible options may involve another LOT gateway, a partner transatlantic flight or a connection through another European airport. Availability, immigration requirements, baggage transfer, cabin and final arrival all matter. A screenshot showing a seat for sale is useful evidence, but does not alone prove that LOT could ticket that exact fare or inventory.
If the offered route leaves from LAX instead of SFO, ask who will provide and pay for travel between Northern and Southern California. Article 8(3)'s rule for airports serving the same city or region should not be assumed for SFO and LAX. They are not a normal same-city airport substitution.
If LOT refuses a materially earlier reasonable option, preserve the refusal before self-booking. Independent replacement costs are not automatically reimbursed. A strong file shows that rerouting was requested, LOT failed to provide it, the purchased route was necessary and the price was reasonable.
See LOT Star Alliance rerouting for the decision process.
US DOT airport-change and refund rules
US DOT rules apply to foreign-carrier itineraries to, from or within the United States. Cancellation or a significant change can trigger an automatic refund when the passenger rejects alternative transportation, credit or a voucher.
A different origin or destination airport is a defined significant change. So are an international departure six hours or more early, international arrival six hours or more late, extra connection points and downgrade.
That does not mean a passenger can accept LAX replacement travel and demand the full unused ticket price. The DOT refund path is for rejected alternative travel. A passenger who accepts rerouting can still assess EU261 fixed compensation, care and any agreed positioning cost.
The LOT EU261 versus US DOT guide keeps these remedies separate.
Connections beyond Warsaw
California passengers often continue from WAW to another Polish or European city. On one booking, assess final-arrival delay at that last destination.
Example: LAX-WAW-KRK is one reservation. The transatlantic flight reaches WAW two hours late, the Krakow connection is missed, and the passenger reaches KRK nine hours late. Krakow is the final destination for the delay test, even though the first aircraft was less than three hours late into Warsaw.
Example: SFO-WAW and WAW-PRG were purchased separately. Missing Prague does not automatically extend the LOT ticket's final destination. Insurance, package rights or a documented self-transfer promise may be relevant.
Check the LOT missed-connection guide before calculating the claim.
Codeshare and wet-lease checks
The booking may contain an LO marketing number while a partner operates a feeder. Conversely, LOT may operate the transatlantic aircraft under another airline's marketing code. EU261 focuses on the operating air carrier.
An aircraft and crew can also be supplied under a wet lease. Under the Court of Justice's Wirth judgment, the company that decided to perform and assumed responsibility for the flight can be the operating carrier rather than the company merely supplying aircraft and crew. Preserve the ticket, airport display and airline notices instead of guessing from aircraft paint.
This distinction is especially important on an inbound US flight: LOT's EU status supports coverage only where LOT is legally the operator of the affected flight.
Care during a California overnight wait
On a covered LOT operation, EU261 care can include reasonable meals, communication, hotel accommodation and airport-hotel transport. Extraordinary weather, airspace restrictions or an external event may defeat fixed compensation but do not remove care.
Long waits on West Coast routes can span a full day because of aircraft rotation and time-zone differences. Keep the timeline in local airport time and include dates. Ask LOT or its handling agent for assistance before spending, then select a reasonable hotel and meals if support is not supplied.
Do not combine every expense into one unexplained total. Keep itemised receipts, payment proof, names of passengers covered and any refusal from the airport desk. The LOT transatlantic care guide provides the expense categories.
California claim checklist
- Confirm LAX or SFO and the exact destination on the e-ticket.
- Identify the operating airline for every feeder and long-haul sector.
- Save original and replacement schedules before they disappear from the app.
- Record the final destination and first-door-opening arrival where possible.
- Preserve cancellation notice timing and the stated cause.
- Capture reasonable alternative routes at the time of disruption.
- Obtain written agreement for any LAX-SFO positioning travel.
- Keep itemised care and transport receipts.
- Submit separate amounts for compensation, refund and expenses.
LOT's post-journey form is the direct carrier channel. The broad LOT US compensation guide covers inbound route scope and codeshares.
The EU reform approved in July 2026 is not yet applicable on 11 August 2026. Do not use its future complaint deadlines as if they already governed a California claim.
FAQ
Is LAX-Warsaw covered by EU261 when it departs the USA?
Yes, when LOT operates the flight and the other conditions are met. LOT is an EU carrier arriving in the EU.
Is SFO-Warsaw a current LOT route?
LOT's official page states that seasonal nonstop SFO-WAW service began on 6 May 2026. Check the current route map and the ticket for the exact travel date.
Can a California-Warsaw delay pay EUR 600?
Yes. LAX-WAW and SFO-WAW exceed 3,500 km, so EUR 600 is the headline amount for an eligible disruption.
Can LOT move me from SFO to LAX without covering the transfer?
Do not assume so. These airports serve different regions. Ask LOT to arrange or expressly cover positioning travel before accepting the reroute.
Does weather remove hotel and meal rights?
No. A proven extraordinary circumstance can remove fixed compensation, but EU261 care remains on a covered flight while the passenger reasonably waits.
