Aeromexico from Mexico to Europe: when EU261 does not apply
An Aeromexico-operated flight from Mexico to Europe does not normally fall under EU261 merely because it lands in Madrid, Paris or Amsterdam. EU261 covers departures from its territory regardless of carrier, but inbound flights from a third country generally require a Community carrier. Aeromexico is Mexican. A similar operating-carrier condition matters under UK261 for arrivals from Mexico.

This direction rule applies even to the return half of a European round trip. It is stated here at 9 September 2026. The EU reform adopted in July 2026 has deferred application, and its future nine-month claim period must not be treated as current law.
Arrival in Europe is not enough
Mexico City–Madrid operated by Aeromexico starts in Mexico. A Spanish destination, euro fare, EU passport or Madrid-issued ticket does not shift the departure point. Mexico City–London similarly does not enter UK261 simply by arriving in Britain when Aeromexico operates it.
This is different from the outbound direction. Madrid–Mexico City operated by Aeromexico begins in the EU and can pass the EU261 territorial test; London–Mexico City can pass the UK territorial test. Every direction must be drawn separately before compensation is discussed.
One PNR does not export outbound coverage
A return reservation may have one booking reference and one total price, but the outbound and inbound journeys retain their own starting points. A disruption on the covered European outbound cannot make an unrelated return disruption automatically covered. Likewise, payment with a European card and sale by a European agency do not rewrite geography.
Connections within Mexico require the actual contract to be read. Oaxaca–Mexico City–Paris on one Aeromexico itinerary starts in Mexico. Adding a domestic feeder does not turn the journey into an EU departure.
A partner operator may change the answer
The AM code is sometimes a marketing code. Check “operated by” on the original e-ticket and boarding pass. If an EU carrier physically operates a Mexico-to-EU flight, its carrier status can produce a different EU261 analysis. If Aeromexico physically operates a flight marketed by an EU airline, the marketing partnership does not make Aeromexico a Community carrier.
Save the original operator line before rerouting. A replacement flight on Air France does not automatically transfer responsibility for a cancellation of an Aeromexico-operated service; planned and substitute operators are separate facts.
Worked round trip from Madrid
Rafael buys Madrid–Mexico City–Madrid directly from Aeromexico. The outbound AM flight leaves Madrid and arrives five hours late. He can test EU261 because that direction began in the EU. His fixed amount, care expenses and any rerouting are assessed separately.
On the return, Aeromexico cancels Mexico City–Madrid and carries him the next day. That direction began in Mexico and Aeromexico was the operator, so he cannot establish EU261 merely by pointing to Madrid or the same PNR. He preserves the replacement offer and expenses for Aeromexico's contractual channels and any relevant Mexican remedy, but does not advertise an automatic EUR 600 claim.
Rights that may remain outside EU261
No EU261 coverage does not mean no remedy. The fare conditions and Aeromexico's changes-and-refunds process may address unused carriage or alternatives. Mexican consumer channels such as PROFECO may be relevant to a Mexican territorial file. Travel insurance and card protections can also have distinct terms.
The Montreal Convention may govern proven baggage loss, damage or delay and certain proven delay damages, subject to conditions and limits. A package organiser may answer for combined travel services. None of those routes should be relabelled as EU261 fixed compensation, and the same loss cannot be recovered twice.
How to write an accurate Mexico-origin claim.
Lead with the route, operator and actual contractual right being invoked. Attach the original schedule, ticket, notices, reroute and receipts. If Aeromexico's response is generic, ask for the specific reason and available alternatives. State whether you seek unused-fare reimbursement, replacement transport, reasonable assistance costs or documented damage.
If a partner operated the flight, explain why that fact changes the territorial analysis. If Aeromexico operated it, use the applicable non-EU261 basis honestly. A precise claim is more credible than quoting a European flat amount unsupported by direction.
