Aeromexico compensation rejected: how to challenge it

Published: 10 September 2026

An Aeromexico rejection is useful only once you identify the proposition being rejected. “Not eligible” may conceal a dispute about territory, operating carrier, final arrival, cancellation notice, extraordinary circumstances or evidence. Answer that issue with a focused record rather than resending the original complaint unchanged.

Check your case in the form

Enter your route, date and type of disruption. We will check whether your case qualifies for a claim under EU 261/2004 or UK261.

What happened to your flight?

Claim up to €600 for a delayed or cancelled flight.

Choose the situation that applies to your flight:

Aeromexico's status matters: it is not an EU or UK carrier. Its own EU departures may fall within EU261 and British departures within UK261; its Mexico-origin services do not normally become covered merely by arriving in Europe. The law below is stated at 9 September 2026. The July 2026 EU reform has deferred application, so its future nine-month claim period is not current.

Classify the reason for rejection

Mark the exact sentences in Aeromexico's response. A territorial rejection is answered with departure and operator evidence. A timing rejection needs scheduled and actual final arrival. A notice dispute needs the cancellation message and its timestamp. An extraordinary-circumstances defence calls for the specific event, its effect on the rotation and reasonable measures.

If the response addresses a refund when you sought compensation, restate the separate remedies. An unused-fare refund does not automatically settle a flat award or reasonable care expenses.

Correct mistakes about direction and operator

For an AM-operated Madrid–Mexico City flight, show that the disrupted direction began in the EU. For Mexico City–Madrid operated by Aeromexico, do not challenge a coverage rejection by relying only on the European destination; seek the contractual or Mexican route that actually applies.

On a codeshare, provide the original “operated by” line. An AM marketing number may sit on a partner-operated flight, while an EU marketing code does not transform an Aeromexico aircraft into an EU carrier. Replacement documents can hide the original operator, so retain both versions.

Demand facts behind an extraordinary-circumstances label

Broad phrases such as “weather,” “airport restrictions” or “operational reasons” do not establish the complete defence. Ask Aeromexico to identify the event, location and time; explain how it affected the aircraft or crew sequence; and state which reasonable measures were considered. Compare the explanation with airport conditions and the actual rotation without overstating what public tracking alone proves.

Even where the defence defeats fixed compensation, care, rerouting or reimbursement may survive on a covered disruption. Challenge only what the evidence supports and preserve reasonable receipts.

Worked challenge after a Paris cancellation

Samira's one-ticket Paris–Mexico City–Cancún journey is cancelled five hours before departure. Aeromexico reroutes her the next day and rejects compensation with the words “adverse weather.” She reaches Cancún 19 hours late and has meal and hotel receipts.

Her reply states the EU departure, AM operating carrier, notice time and protected final destination. She requests the weather event, affected airport, operational link and reasonable measures. She calculates any flat award per passenger, but lists one hotel room and meals at actual cost. She does not include her delayed suitcase in the same calculation; that proceeds under Montreal with its PIR and purchase records.

Rebuild the evidence index.

Attach the original itinerary, e-ticket coupons, boarding passes, notices, replacement route and actual-arrival evidence. Use filenames that state their purpose. For a connection, show whether every sector was one contract. For a cancellation, show when Aeromexico communicated it. For a delay, distinguish door opening from touchdown.

Add a one-page table: disputed point, Aeromexico's position, passenger evidence and requested correction. This lets a reviewer see what remains unresolved without searching through chat screenshots.

Keep the rejection email in its original format, including headers and attachments. A dated, continuous exchange also shows that the passenger pursued the case diligently and helps a later reviewer distinguish Aeromexico's first explanation from any new reason raised after challenge.

Escalate according to the covered departure

Give Aeromexico a reasoned opportunity to reconsider. Then use the authority or redress route relevant to the departure and legal regime. The UK Civil Aviation Authority explains the British framework, while EU files follow the competent national route. Such bodies may supervise compliance without automatically acting as a court that orders individual payment.

A Mexico-origin Aeromexico file may involve the contract or Mexican consumer avenues such as PROFECO rather than EU261. Package organisers handle their own package duties. Court or professional assistance may require limitation, cost and jurisdiction analysis, which should not be replaced by the deferred future EU deadline.

Frequently asked questions

Is “operational reasons” a sufficient rejection?

Not by itself. Ask for the actual event, its connection to the flight and the reasonable measures considered.

Should I open a new Aeromexico case?

Usually preserve continuity by replying with the existing reference unless the official channel requires another submission.

Can I challenge a rejection for Mexico City–Madrid?

You can challenge factual or contractual errors, but an Aeromexico-operated Mexico-origin flight is not brought under EU261 solely by arriving in Madrid.

Does an authority guarantee payment?

No. Its role and powers vary; regulatory supervision is not always an individual payment order.

Has the EU introduced a current nine-month cut-off?

No. At 9 September 2026 the July reform's application is deferred, and existing limitation rules remain relevant.
