Aeromexico delayed flight: the three-hour arrival test
Published:
For a covered Aeromexico journey, the important delay is usually the delay at the final destination on the same booking—not the late take-off shown on an airport screen. Arrival is generally measured when at least one aircraft door opens and passengers are permitted to leave. A flight can depart more than three hours late yet recover time, or leave only modestly late and miss a connection that produces a much later final arrival.

Choose the situation that applies to your flight:
Coverage comes first. Aeromexico is neither an EU nor a UK carrier. Its flight departing the EU can be tested under EU261, and its flight departing Britain under UK261. Its own flight from Mexico does not normally qualify merely because it arrives in Europe. This is the law as at 9 September 2026; the July 2026 EU reform has deferred application, so no future nine-month claim period applies yet.
Start and finish the correct clock
Save the scheduled and actual times for the contracted final destination. For Madrid–Mexico City on one direct ticket, compare the scheduled arrival in Mexico City with the door-opening time there. For Paris–Mexico City–Cancún sold as one through journey, a delay on the first sector may be assessed by arrival in Cancún if the legal and contractual conditions align.
Time zones matter. Put every event in local time with its airport and date, then calculate consistently. Do not use touchdown, gate assignment or a baggage-belt timestamp as a substitute when better door-opening evidence exists. A photograph of the cabin display, a timestamped message and airport tracking data can support a reasonable reconstruction.
One booking and two tickets produce different answers
Suppose Aeromexico sells London–Mexico City–Oaxaca under one ticket and the London departure is covered by UK261. If the late inbound causes a missed protected connection, the passenger should document arrival at Oaxaca, the final contracted destination. The airline's rerouting does not reset the history.
If a passenger separately buys Paris–Mexico City from Aeromexico and Mexico City–Oaxaca from another airline, the second ticket is normally a self-transfer. The clocks and remedies are assessed separately. A travel agent displaying both reservations on one page does not turn them into one contract. Preserve ticket numbers and coupon details rather than relying on the agent's itinerary summary.
Operating carrier and direction remain decisive
An AM number may sit on a partner-operated aircraft. Check “operated by” on the original booking and boarding pass. A Mexico-to-Europe sector physically operated by Aeromexico normally lacks EU261 coverage; a partner's status may require a different assessment. Conversely, Aeromexico's EU departure can qualify despite the carrier being Mexican.
A return PNR does not make the entire trip European. Madrid–Mexico City and Mexico City–Madrid retain their own directions. The passenger's passport, frequent-flyer programme, European payment card and place of purchase do not move the departure point.
Compensation, care and transport are not the same claim
When a covered final arrival delay reaches the threshold, fixed compensation may fall into the EUR 250, EUR 400 or EUR 600 band, subject to distance and the extraordinary-circumstances defence. UK261 uses statutory sterling amounts. Ticket price does not set the award.
Meals, hotel accommodation and hotel transfers address the wait. Reimbursement concerns unused transport, while rerouting gets the passenger to the destination. Montreal baggage damages and package-holiday rights use separate rules. A severe storm may affect the fixed award yet leave care obligations on a covered departure; keep receipts rather than treating every remedy as one “delay refund.”
Worked example: a missed connection to Monterrey
Amelia travels from Paris to Monterrey through Mexico City on one Aeromexico ticket. The AM-operated Paris flight arrives 2 hours 20 minutes late, and she misses the protected Monterrey connection. Aeromexico reroutes her and she reaches Monterrey 7 hours 5 minutes after the original schedule.
Her file should lead with the EU departure, Aeromexico as operating carrier, the single contract and final arrival in Monterrey. She keeps both boarding passes, the original itinerary, new boarding pass, meal receipts and a note of the final door-opening time. If Aeromexico invokes air-traffic restrictions, she asks which restriction affected her rotation and what reasonable alternatives were considered. Her fixed-compensation calculation is per passenger; her meals are claimed at actual reasonable cost.
Present the delay evidence in chronological order.
Download the original itinerary before the app replaces it. Keep notices, screenshots, gate announcements, rebooking communications and any written reason for the delay. Ask Aeromexico for the actual arrival record and the specific cause if either remains disputed.
In the customer-contact submission, use a compact table: scheduled event, actual event, airport, local time and supporting attachment. State whether the itinerary was one booking and name the operating carrier for each relevant sector. Then list fixed compensation, care expenses and any unused carriage under separate headings. Escalation should target the remaining dispute—coverage, final arrival, operator or cause—rather than resending an unstructured bundle.

Frequently asked questions
Is take-off delay used for the three-hour test?
Normally the decisive comparison is scheduled versus actual arrival at the protected final destination. Take-off delay is useful evidence, but it is not automatically the compensation threshold.
What counts as arrival if the aircraft waits on the stand?
The usual legal measure is when at least one door opens and passengers are permitted to leave, not touchdown. Record the most reliable contemporaneous evidence available.
Does a missed Mexico City connection count?
It can when the sectors form one protected booking and the passenger reaches the contracted final destination late. A separately purchased onward flight is normally assessed as a different contract.
Can extraordinary circumstances remove all my rights?
Not necessarily. They may defeat fixed compensation if proved with reasonable measures, but care and rerouting or reimbursement on a covered disruption are separate questions.
Does the July 2026 reform shorten my current claim time?
No. Its application is deferred as at 9 September 2026. Do not treat the future nine-month proposal as the current limitation rule.
