TUI codeshare: identify the operating carrier

The airline whose code appears beside a TUI flight is not always the airline that operates it. For statutory delay, cancellation and denied-boarding claims, the operating carrier is normally the essential defendant. Finding that company also determines whether an inbound flight can rely on UK261 or EU261.

The position described is current on 9 September 2026. The EU reform adopted in July 2026 has deferred application, including its future nine-month claim period.

Distinguish seller, marketing carrier and operator

The seller takes payment. A tour organiser assembles the package. A marketing carrier places its code on a service. The operating carrier supplies the aircraft and performs the flight. One company can fill several roles, but a TUI booking does not guarantee that it does.

Look for “operated by” in the e-ticket, final travel document, check-in page and boarding pass. Airport displays and disruption messages can confirm a late substitution. Keep screenshots because an app may later show only the replacement service.

Do not rely exclusively on livery. A wet-leased aircraft can display another company's colours while legal responsibility depends on who is operating the flight under the applicable rules. If the evidence conflicts, ask TUI to identify the operating air carrier in writing.

Know which TUI airline you found

TUI Group lists five airline businesses: TUI Airways, TUI fly Germany, TUI fly Belgium, TUI fly Netherlands and TUI fly Nordic. TUI Airways is British. The other four are EU airlines. Codes such as BY, X3, TB, OR and 6B may point toward an entity, but the operated-by field remains the safer answer.

This classification matters most on an inbound journey. A Cancún–Gatwick flight operated by TUI Airways can be covered by UK261 because it is operated by a UK carrier. A Punta Cana–Brussels flight operated by TUI fly Belgium can be covered by EU261 because it is operated by an EU carrier. Substitute a non-European operator and the result can change despite identical TUI branding.

Departures from the UK or EU are generally protected under the corresponding regime regardless of the operator's nationality. Each return direction must still be tested separately.

Trace operator changes across the journey

Connections and replacements can involve several airlines. Create a row for each sector showing route, marketing code, operator and disruption. Do not describe an entire Manchester–Amsterdam–Curaçao itinerary as “a TUI Airways flight” if only the first leg was operated by it.

Worked example: Nora books a TUI package from Manchester to Aruba. Her confirmation initially shows TUI Airways, but a reissue states that the outbound is operated by another UK airline and the return by a Dutch TUI airline. The Manchester departure remains within UK261 irrespective of the substitution. For the Aruba return, the Dutch operator is crucial to potential EU261 coverage; it does not make the flight a TUI Airways UK claim.

If a disruption on one carrier causes a missed protected connection on another, include the whole ticket and final arrival. Legal responsibility can be fact-sensitive, so address the operator linked to the disrupted performance and state the complete journey rather than sending identical demands to every logo present.

Match each remedy to the correct party

Fixed compensation follows the statutory operating-carrier claim and uses the applicable distance bands: EUR 250, 400 or 600 under EU261, or GBP 220, 350 or 520 under UK261. Coverage, delay or cancellation criteria, and cause must all be proved before selecting the amount.

Refund or rerouting concerns unused or replacement carriage. Care covers reasonable meals, hotel and transfers during disruption. Package rights may be enforced against the organiser for a failure of the holiday contract. Montreal baggage damages follow the carrier rules and proven loss. Separating these requests avoids asking the organiser to pay a flight award merely because it sold the holiday.

TUI's UK delay-form guidance reflects this distinction: it processes TUI Airways customers and tells passengers who flew with another airline to approach that carrier.

Submit evidence that settles identity early

Place the operated-by line immediately below the route in the complaint. Attach the original and revised ticket, boarding pass, replacement notice and any written confirmation of an operator switch. Then set out final arrival, cancellation notice or denied boarding and the stated cause.

For TUI Airways, unresolved claims may proceed to AviationADR under TUI's contact guidance. Another TUI airline or partner has its own process and relevant national body. Continue a package complaint separately if the organiser's support, accommodation or transfers failed.

An operator correction does not excuse an otherwise qualifying claim; it tells you where to send it. Acting promptly is sensible, but the future EU nine-month period is not yet the current rule.

Frequently asked questions

Is the airline code enough to identify the operator?

Not always. Codeshares and substitutions can separate the marketing code from the airline actually operating the aircraft. Check the explicit operated-by wording.

Is TUI the operating carrier of every TUI package flight?

No. TUI can act as organiser or seller while a group airline or outside partner operates the flight.

Why does the operator matter on a return flight?

An inbound journey beginning outside the UK or EU generally needs a qualifying UK or EU carrier for the matching passenger-rights regime.

Should I send the same compensation claim to two airlines?

Identify the operator and disrupted sector first. Duplicate submissions can obscure responsibility; describe the whole protected itinerary to the correct carrier.

Does changing operator remove my package rights?

No. Package rights against the organiser may continue, but they remain separate from the statutory flight claim against the operating airline.
