Care is practical support during the wait, not a substitute for fixed compensation. On a covered Neos disruption, reasonable meals, communications, hotel accommodation and airport-hotel transport may be owed even when extraordinary circumstances caused the delay. Replacement travel or reimbursement answers a different question, and baggage damage belongs under Montreal.

Establish the covered operation first
Neos departures from EU airports can fall under EU261. Because Neos is an Italian EU carrier, its own third-country-to-EU flights can also qualify. Verify NO and “operated by”, especially when an agency voucher or partner name appears. A non-EU operator on an inbound route may change coverage.
Direction is assessed separately for outbound and return. Residence, nationality and booking currency do not replace route and operator.
What reasonable care includes
The carrier should provide meals and refreshments in reasonable relation to waiting time, plus communications. When a stay becomes necessary, care includes hotel accommodation and transport between airport and hotel. The timing thresholds depend on flight distance and expected delay; passengers need not wait three hours before every care duty arises.
Reasonableness matters. A modest meal and practical hotel are easier to recover than alcohol, luxury upgrades or unrelated shopping. Medical or accessibility needs should be explained and documented.
When to arrange care yourself
Ask Neos or its ground handler first and retain the answer. If the desk is closed, the queue is impossible or assistance is refused, record the circumstances with photographs, messages and notes. Buy what is necessary and proportionate, requesting itemised receipts.
Do not assume a voucher settles other rights. Nor should a passenger deliberately incur avoidable expense when suitable care is offered. Shared rooms and taxis are claimed once at actual cost, not multiplied by traveller count.
Worked example: an overnight wait at Malpensa
Maya, Ben and their child are rerouted after a Neos cancellation from Milan to Mombasa. The new flight leaves next morning. No hotel desk remains open, so they book one nearby family room for EUR 188, take a EUR 34 taxi each way and spend EUR 61 on ordinary meals.
Their care schedule totals EUR 317 with four receipts; it is not EUR 317 per passenger. Possible fixed compensation is calculated separately for each qualifying traveller. If the package loses a resort night, the organiser receives that distinct request. If Neos proves extraordinary weather, the fixed award may fail while reasonable care can remain due.
Replacement transport and reimbursement are alternatives
After cancellation, passengers generally choose reimbursement or rerouting. If Neos fails to offer suitable earliest rerouting, necessary self-arranged transport may be recoverable, but document available options and seek approval where practicable. Choosing an unnecessarily expensive cabin weakens the claim.
A passenger who accepts reimbursement normally cannot also demand carriage for the same unused sector. Keep this choice separate from care incurred before the journey was abandoned and from any fixed award.
Create a table with date, item, travellers served, reason, amount and receipt number. Add the disruption notice, replacement itinerary and proof that assistance was unavailable. Convert currency transparently and retain the original charge.
If a receipt covers both necessary and personal purchases, identify the recoverable lines rather than claiming the total. A card statement can corroborate payment but is weaker than an itemised invoice. Where cash was the only option, add a contemporaneous note explaining the vendor, purpose and amount. Keep the original currency alongside any conversion rate used.
Care follows the duration of the necessary wait. It is not an open-ended daily allowance, and it normally ends when appropriate rerouting departs or the passenger elects reimbursement and abandons travel. At the same time, Neos cannot avoid reasonable overnight assistance merely because a tour operator sold the seat or because fixed compensation is disputed.
For a group, name who consumed each meal and who occupied the room without manufacturing separate costs. If one traveller has a documented dietary, medical or accessibility need, explain why a different purchase or transport choice was reasonable. Practical context is more persuasive than describing every expense as “compensation”.
Baggage necessities are not automatically EU261 care. Delayed-bag purchases require a Montreal analysis, prompt reporting and a written demand. Avoid double claiming the same toiletries or clothes under both headings.
