Neos charter or package holiday: who handles the disruption?
A Neos package disruption commonly creates two files. The organiser manages the holiday as a package; the operating carrier answers for flight performance. Keeping those files separate helps the passenger obtain the right remedy without claiming the same lost night, transfer or meal twice.

Neos departures from the EU can fall under EU261, and Neos-operated returns from third countries to the EU can qualify because Neos is an Italian EU carrier. The law stated is current at 9 September 2026. The July 2026 EU reform has deferred application, including its future nine-month claim period.
Separate the organiser from the airline
The organiser combines flight, accommodation or other travel services and may have duties when the package cannot be performed. Neos is responsible for operating a Neos flight and is the relevant EU261 addressee for that performance. A travel agent may only be an intermediary.
Neos may direct agency customers back to the seller for booking changes. That practical route does not turn the seller into the operating carrier. Send each party a schedule limited to its obligations.
Preserve the charter evidence
Charter passengers may receive only a voucher. Save its original version, flight number, airports, schedule, cabin, baggage terms and “operated by” line before a substitution changes the app. NO normally identifies Neos, but verify each sector.
Split outbound and return directions. A Neos-operated Dominican Republic–Milan flight can qualify under EU261 because Neos is an EU carrier. If a non-EU substitute operates the return, arrival in Italy alone may not suffice.
Match each problem to its remedy
Cancellation produces a choice between reimbursement and rerouting under EU261 where covered. Waiting can create care rights. Qualifying delay or cancellation may also produce fixed EUR 250, EUR 400 or EUR 600 compensation. These are not calculated from the package price.
The organiser may need to rearrange accommodation, offer an appropriate package solution or address a price reduction or damages under applicable package law. Montreal governs provable baggage loss, delay or damage. Label each claim and deduct overlapping payments.
Worked example: two lost nights in Zanzibar
Olivia and Sam buy a seven-night package from an English organiser, with a Neos-operated Verona–Zanzibar flight after their own separate trip to Verona. Neos cancels and reroutes them 36 hours later. They receive no hotel at the airport and lose two resort nights.
The Neos file covers the EU departure, rerouting choice, reasonable airport hotel and meals, and possible long-haul fixed compensation depending on notice and cause. The organiser receives the claim about the shortened package and resort performance. Their separate journey to Verona is not automatically part of Neos's contract.
Avoid package-price arithmetic in an EU261 demand
A family of four may have four individual fixed awards, but one shared room is one expense. The full holiday price is not the base for EU261 compensation. Likewise, a package refund should not be added again as “flight damage” without identifying an unrecovered loss.
Keep a ledger showing payer, legal basis, amount sought, amount received and loss covered. This makes settlement offers safer to assess and prevents accidental duplication.
Send the flight claim to the operating carrier with route, operator, notice, arrival and receipts. Send the package claim to the organiser with the package confirmation, revised programme and missed services. If Neos invokes extraordinary circumstances, request the event, causal link and reasonable measures; care may remain due.
Keep the organiser's replacement offer as well as Neos's notice. They may describe different promises: a new flight, a shorter stay, another hotel or a full package cancellation. Record which offer you accepted and why. Accepting a sensible package solution does not automatically settle a distinct fixed-compensation question, but any payment covering a specific loss must be disclosed.
Where a package includes independent feeder travel, airport parking or excursions, link each loss to the contract and event that caused it. Neos's fixed award does not automatically reimburse every holiday consequence. Conversely, an organiser's partial refund does not necessarily discharge Neos's duties as operating carrier.
ENAC supervision and Italian conciliation have different functions and do not automatically calculate compensation. Package escalation depends on the organiser and governing market. Preserve submission dates; the deferred future deadline is not current law.
