Neos flight compensation for delay or cancellation
Published:
A disrupted holiday flight does not automatically produce a cash award. For Neos, first identify the direction of travel and the airline that actually operated the aircraft. A Neos flight leaving Italy or another EU airport can fall under Regulation 261/2004. Because Neos is an Italian EU carrier, its own flight from a non-EU country back to the EU can also be covered, subject to the regulation's conditions and any equivalent benefit already received locally. The passenger's nationality, residence and place of booking do not decide coverage.

What happened to your flight?
Claim up to €600 for a delayed or cancelled flight.

This guide states the law as at 9 September 2026. The EU reform approved in July 2026 has deferred application. Its future nine-month claim period is not the current deadline and should not be used to reject or shorten a present claim.
When a Neos disruption can produce fixed compensation
EU261 fixed compensation may be due after arrival at the final destination three hours or more late, a cancellation notified too late, or involuntary denied boarding. The passenger must have a confirmed reservation, comply with the applicable check-in deadline and travel on a covered operation. For a delay, arrival normally occurs when at least one aircraft door opens and passengers are permitted to leave, not when the wheels touch the runway.
Cancellation compensation depends partly on notice and the replacement offered. Notice at least 14 days before departure generally removes the fixed award. Shorter notice can still avoid it if the alternative departs and arrives within the regulation's prescribed windows. Neos may also defeat fixed compensation by proving extraordinary circumstances and showing that the disruption could not have been avoided even if all reasonable measures had been taken.
Direction and operating carrier come first
Read the original e-ticket or charter voucher, boarding pass and any “operated by” line. The NO code normally points to Neos, but a tour operator, travel agency or marketing airline shown prominently on the paperwork may not have operated the flight. The operating carrier is the proper addressee for EU261 flight-performance duties.
Direction matters separately. Milan Malpensa–Cancún operated by Neos starts in the EU and passes the territorial test. Cancún–Milan operated by Neos can also qualify because Neos is an EU carrier. If the return is actually operated by a non-EU partner, arrival in Milan alone may not be enough. Treat the outbound and inbound as separate directions even if one PNR and one payment cover the round trip.
EUR 250, EUR 400 or EUR 600 is not the whole claim
The statutory bands are generally EUR 250 for flights up to 1,500 km; EUR 400 for intra-EU flights over 1,500 km and other covered flights from 1,500 to 3,500 km; and EUR 600 for covered flights over 3,500 km. A long-haul Neos service can therefore reach EUR 600, while a long intra-EU journey remains in the EUR 400 category. In some rerouting cases the amount can be reduced by 50% when arrival stays within the regulation's specified limits.
That sum belongs to each qualifying passenger. It is not calculated from the ticket or package price. Keep it separate from reimbursement of an unused ticket, rerouting to the destination, reasonable meals and accommodation during the wait, and proven baggage loss under the Montreal Convention. A family may claim four individual fixed awards but only the actual cost of one shared hotel room.
Worked example: a late return from the Dominican Republic
Amelia and Josh buy a Manchester-origin package through a British travel agent, with a Neos-operated return from La Romana to Milan and a separate self-booked flight from Milan to Manchester. The NO flight reaches Milan four hours and 20 minutes late after an operational aircraft change.
The relevant EU261 direction begins in the Dominican Republic and ends in Milan under the Neos contract. Neos's EU-carrier status brings that inbound operation within the territorial gateway. The separately purchased Manchester flight does not become Neos's final destination merely because the couple planned to take it. If the cause is within Neos's control and the remaining conditions are met, the long-haul band may be EUR 600 each. Their replacement Manchester tickets are not automatically part of the fixed award; any additional-damages argument needs its own legal basis, proof, causation and mitigation.
Build a claim that keeps every remedy labelled
Preserve the original itinerary before the app replaces it. Record scheduled and actual arrival, including local time zones, the operating carrier, notice messages and the explanation given at the airport. Attach boarding passes and numbered receipts. Ask for the precise event behind any broad phrase such as “operational reasons” or “weather” and how it affected this rotation.
Send the statutory flight claim to Neos even when an agency handled booking changes. State the requested fixed amount per passenger on one line; list care expenses, unused fare or other losses on separate lines. ENAC supervision and Italian conciliation channels serve different purposes and neither automatically awards compensation. Escalation should address the particular unresolved issue rather than repeat an unfocused complaint.

Questions about Neos compensation
Does a three-hour Neos delay always mean EUR 600?
No. Coverage, final-arrival delay, distance, operator and cause must all be checked. EUR 600 is the maximum long-haul band, not a universal delay payment.
Can I take rerouting and still request fixed compensation?
Yes. Rerouting performs the journey; fixed compensation addresses qualifying lost time. Accepting sensible transport does not by itself waive the separate award.
Is compensation available on a Neos charter flight?
Charter status does not remove EU261. Confirm that Neos operated the flight, identify the direction and keep the voucher showing the original schedule.
What if Neos says the cause was extraordinary?
Ask for the specific event, its connection to the affected flight and the reasonable measures considered. An external event can remove fixed compensation, but care duties may still continue.
Can I also claim a refund and baggage loss?
Potentially, but not as one undifferentiated total. Refund or rerouting, care, fixed compensation and Montreal baggage damages have separate tests and cannot duplicate the same loss.
