Neos and EU261: which flights are covered?

Published: 10 September 2026

Neos's Italian licence matters most on the return leg. Any Neos flight leaving an EU airport can pass EU261's territorial gateway. A flight beginning outside the EU and arriving inside it can also pass when Neos actually operates it, because Neos is an EU carrier. The same result cannot be assumed when a non-EU partner operates the aircraft, even if the booking carries a Neos or tour-operator label.

What happened to your flight?

Claim up to €600 for a delayed or cancelled flight.

Choose the situation that applies to your flight:

These are the rules applicable on 9 September 2026. The EU reform approved in July 2026 has deferred application. In particular, its prospective nine-month claim period is not a present deadline.

Use a two-direction test for every return booking

Split a round trip at its turning point. Milan–Cancún starts in the EU, so EU261's departure rule can apply regardless of the carrier's nationality. Cancún–Milan starts in a third country, so coverage requires an EU operating carrier; a Neos-operated return meets that carrier limb. One PNR, one card payment and the passenger's residence do not merge the two directions.

The same method works for Verona–Zanzibar, Rome–Havana or Malpensa–Mombasa itineraries. Identify the first airport and final contracted destination for each direction, then identify who operated each affected sector.

“Operated by” outranks the holiday brand

Passengers on charter holidays may receive only an agency voucher. Preserve the original version and find the operating-carrier line, flight number and airport records. NO is Neos's operating code, but a marketing code or prominent seller logo is not conclusive. Aircraft substitutions and wet leases require careful reading of notices and boarding documents.

A tour operator remains important for accommodation and package performance. It does not become the air carrier merely by selling the trip. Conversely, Neos does not automatically owe package-price losses merely because it operated the flight. Direct each request to the party responsible for that contract.

Coverage does not guarantee compensation

Passing the territorial test only opens the EU261 analysis. The passenger must also hold a confirmed reservation and comply with check-in rules. The event must be a qualifying cancellation, long final-arrival delay or denied boarding. Notice, distance and cause then affect the fixed award.

Neos can avoid fixed compensation where it proves extraordinary circumstances and that reasonable measures could not have prevented the disruption. However, reimbursement or rerouting after cancellation and reasonable care during a wait are separate duties. An extraordinary event does not erase them automatically.

EU261, UK261, package rights and Montreal occupy different lanes

A journey touching Britain does not automatically invoke UK261. A Neos flight departing a UK airport can fall within the UK regime's departure limb. An inbound flight to the UK requires the relevant carrier and route conditions to be checked separately. Do not promise both EU and UK fixed awards for the same disruption; overlapping regimes are not a route to double recovery.

Package-travel rights address the organiser's holiday contract. The Montreal Convention governs provable baggage loss, delay or damage and certain additional damages. Neither replaces EU261's fixed-compensation rules, and a Montreal baggage limit is not a flat payment.

Worked example: a mixed-carrier holiday via Milan

Sofia books Dublin–Milan–Mauritius and back through a travel company. The outbound Milan–Mauritius flight is operated by Neos and is cancelled. It departs the EU, so the territorial gateway is satisfied. On return, Mauritius–Milan is marketed under the same holiday brand but operated by a non-EU airline and arrives four hours late. Arrival in Italy and the shared booking logo do not alone bring that inbound flight under EU261.

If Neos had operated the inbound, its EU-carrier status could change the result. Sofia should preserve both coupons rather than submit a general claim headed only with the tour operator's name. Her cancellation choice, care costs and any package shortfall remain separately analysed.

At the top of the file write: direction, departure, final destination, operating carrier, ticket structure and applicable regime. Then add the disruption, notice and cause. This prevents a plausible EUR 600 calculation being attached to an uncovered operation.

For a connection, establish whether all sectors belong to one contract. One protected booking may make the final arrival decisive; a self-transfer does not automatically extend Neos's responsibility. If a local-law benefit has already been paid for a third-country departure, disclose it, because equivalent benefits may affect the EU claim.

Questions about Neos coverage

Is every Neos flight covered by EU261?

No. Direction, airports and actual operator matter, followed by the passenger and disruption conditions.

Is a Neos flight from Mexico to Italy covered?

It can be, because Neos is an EU carrier, provided Neos actually operates it and the other conditions apply.

Does booking through a UK agency create UK261 rights?

No. The route and operating carrier determine territorial scope, not the seller's location.

Does one PNR make both directions covered?

No. Outbound and return directions are tested separately even when they share a reservation.

Can EU261 and package rights apply together?

Yes, to different obligations, but the passenger cannot recover the same financial loss twice.
