LATAM flight compensation: when EU261 or UK261 applies

A LATAM delay, cancellation or involuntary denied boarding can qualify for fixed compensation when the disrupted journey starts at an EU/EEA/Swiss airport or at a UK airport. LATAM is not an EU or UK carrier, so a LATAM-operated flight that starts in Latin America and ends in Europe normally falls outside EU261 and UK261. On a covered long-haul journey, the maximum is usually EUR 600 or GBP 520 per passenger, subject to the event, notice, arrival delay, cause and operating airline.

“Can apply” is not the same as “must be paid.” The protected event still needs to satisfy its own rules. A late arrival generally needs to reach the three-hour threshold; a cancellation has notice and rerouting tests; denied boarding must be involuntary and not justified by documents, health, safety or late arrival at the gate. Extraordinary circumstances can remove fixed compensation, although care or rerouting duties may remain.

Why LATAM's carrier status changes the answer

EU261 covers every operating airline when a flight departs an airport in the EU, EEA or Switzerland. The airline does not need to be European. That is why a LATAM-operated departure from Madrid, Paris, Frankfurt or Lisbon can create a strong claim.

The inbound branch is narrower. A flight beginning outside the protected European area and arriving there is generally covered only when the operating airline is an EU carrier. LATAM's own passenger-rights page describes the group as non-Community and says EU261 applies to its EU departures. Therefore Sao Paulo-Madrid operated by a LATAM affiliate normally fails the territorial test, while the reverse direction can pass it.

UK261 works on a related but separate territorial model. A flight leaving a UK airport is protected regardless of the operator's nationality. A non-UK, non-EU carrier's flight arriving from abroad is normally outside UK261. Thus Heathrow-Sao Paulo can be a GBP 520 case, while the LATAM-operated return usually is not.

Identify the airline that actually flew

LATAM is a brand used by several affiliated operating airlines. A booking can also contain Iberia, British Airways, Delta, Qatar Airways or another partner. Marketing codes help sell and coordinate the itinerary; they are not conclusive proof of who owes statutory compensation.

Use these records:

  • the e-ticket line headed “operated by”;
  • the boarding pass and check-in operator;
  • the airline name on the aircraft and crew notices;
  • the irregular-operations message that changed the flight;
  • the full ticket numbers and each segment's flight details.

If Iberia physically operates Lima-Madrid, its EU status may make the inbound flight covered even though LATAM sold it. If LATAM Airlines Brasil operates an IB-coded Sao Paulo-Madrid service, Iberia's marketing code does not convert the operator into an EU airline. Events that can produce compensation

Arrival delay

For a covered booking, measure lateness at the final destination shown on that booking, not just the departure delay or the time the first sector lands. Arrival is generally tied to opening at least one aircraft door. A Europe-GRU-domestic journey on one reservation may therefore qualify when the passenger reaches the final South American airport at least three hours late, even if the first aircraft was delayed by less than three hours.

Cancellation

A cancellation notified less than 14 days before departure can produce compensation when the replacement timing falls outside the statutory windows and LATAM cannot establish extraordinary circumstances. Refund and rerouting are separate choices. Accepting a replacement does not automatically waive fixed compensation; it can affect the amount if arrival is sufficiently close to schedule.

Involuntary denied boarding

When the passenger reported on time with a valid booking and documents but was refused because the flight was oversold or capacity changed, compensation, rerouting or reimbursement, and care can arise. A negotiated volunteer voucher is different: read its terms before accepting because the passenger is agreeing to surrender the seat.

Missed connection

One booking can carry the territorial protection of its covered departure through later connections. If a Madrid-origin LATAM itinerary misses a connection in Sao Paulo and arrives at the ticketed destination more than three hours late, final arrival matters. The amount is per passenger, not per booking, and is not capped by the ticket price. Most direct Europe-Latin America routes exceed 3,500 km, but distance must be measured for the protected journey. On long-haul rerouting, the fixed sum can be reduced by 50% when the replacement reaches the final destination within the relevant four-hour window. Extraordinary circumstances and LATAM's evidence

Extreme weather, air-traffic-control restrictions, airport closure, security risk or some external strikes can constitute extraordinary circumstances. The label alone does not decide the file. The airline needs to connect the external event to the flight and show that reasonable measures could not have avoided the disruption.

Ordinary technical faults, routine aircraft rotation and staffing within the carrier's operation generally should not be accepted as extraordinary without a more specific legal basis. A vague response such as “operational reasons” proves very little. Ask for the actual event, its timing, the aircraft or rotation affected, and the mitigation attempted.

Refund, rerouting and compensation are different lines

Passengers often lose value by asking only for “a refund.” After cancellation, the statutory choice is normally reimbursement of the unused journey or rerouting at the earliest opportunity, with a later convenient date available in appropriate cases. Choosing reimbursement can end the airline's duty to transport you on that booking, so do not select it casually when reaching the destination still matters.

Fixed compensation addresses inconvenience. Care expenses repay reasonable out-of-pocket support. Ticket reimbursement restores unused transport value. A documented consequential loss may require a different legal basis and proof. Put each amount on a separate line in the claim.

LATAM's Help Center also describes commercial rescheduling, refund and LATAM Wallet options. A wallet credit or voucher is not automatically the required cash compensation. Record whether you consented, what right it settled and whether the terms purported to release other claims.

A practical evidence file

Save the original itinerary before accepting any change. Add every boarding pass, the cancellation or delay message, screenshots of the new schedule, receipts, the “operated by” line and proof of actual door-opening or final arrival time. For a family, list each passenger and ticket separately.

Then create a case through LATAM's current Help Center. State:

  1. complete itinerary, booking reference and operating airline;
  2. why EU261 or UK261 covers the departure;
  3. scheduled and actual final arrival;
  4. event, notice date and evidence;
  5. compensation per passenger and expenses separately.

Worked examples

Couple from Madrid to Lima via Sao Paulo. Both sectors are on one booking and operated within the LATAM group. A carrier-controlled first delay causes arrival in Lima 5 hours 10 minutes late. EU261 begins at Madrid and the long-haul journey can support EUR 600 per traveller, subject to causation and any valid reduction. The claim total is EUR 1,200 plus reasonable documented care.

Family from Heathrow to Santiago via Sao Paulo. One UK-origin booking arrives six hours late after an ordinary operational disruption. If LATAM was the relevant operator, UK261 can yield GBP 520 for each qualifying passenger, including children with tickets. Four passengers would claim GBP 2,080 before adding separate care expenses.

Legal position on 25 August 2026

The existing EU261 and UK261 rules described above remain the current basis used in this guide. An EU passenger-rights reform adopted in 2026 includes future procedural changes, including a harmonised claim-notification period. It applies only after the prescribed publication and application timetable. Do not replace current territorial tests or national limitation analysis with a future rule before it takes effect.

FAQ

Does LATAM pay EUR 600 for every flight to Europe?

No. A LATAM-operated flight normally needs to depart the EU/EEA/Switzerland for EU261 to apply. A return beginning in Latin America usually fails that territorial test.

Is Heathrow to Sao Paulo covered by UK261?

Yes, a LATAM-operated departure from Heathrow can fall under UK261. Compensation still depends on the disruption, final delay, cause and any rerouting window.

Does an LA flight number prove LATAM is responsible?

No. Check the airline identified as operating the aircraft and crew. Codeshare marketing and the ticket seller can differ from the statutory operating carrier.

Can children receive the same fixed compensation?

Generally yes when they travel on qualifying publicly available tickets. Calculate the statutory amount for every eligible passenger rather than once per family booking.

Can I claim compensation after accepting LATAM's replacement flight?

Potentially. Rerouting and fixed compensation are separate remedies, although a replacement arriving within the statutory window can reduce or remove the fixed sum.
