LATAM flights from the UK: UK261 compensation and care
A LATAM flight departing London Heathrow or another UK airport can fall under UK261 regardless of LATAM's non-UK nationality. A qualifying long-haul disruption can produce GBP 520 per passenger, or GBP 260 when rerouting reaches the destination between three and four hours late. A LATAM-operated return beginning in South America normally does not fall under UK261 because LATAM is neither a UK nor an EU carrier.

The CAA describes UK261 as covering flights leaving a UK airport on any airline. For arrivals, operator nationality matters. A non-UK/non-EU airline's inbound service normally sits outside the regime. Buying in pounds, booking on a UK website or holding a British passport does not change that boundary.
Heathrow facts to preserve
LATAM's current airport page identifies its Heathrow operation at Terminal 3, but terminals can change. The compensation analysis does not depend on terminal number. What matters is proof that the passenger reported on time, which airline operated the flight, what the original schedule promised and when the final destination was reached.
Before accepting any rebooking, take screenshots of:
- the original LHR departure and all onward sectors;
- the order number, booking reference and ticket numbers;
- each “operated by” entry;
- LATAM's proposed alternative and notice time;
- the airport board and gate message;
- later arrival at the final destination.

Long delay from the UK
UK fixed compensation is linked to arrival delay and distance. A long-haul LATAM journey over 3,500 km can produce:
- GBP 260 per passenger when arrival is between three and four hours late;
- GBP 520 per passenger when arrival is at least four hours late.
Compare the scheduled and actual arrival at the final destination on one booking. If Heathrow-Sao Paulo arrives two hours late but the passenger misses the protected connection and reaches Rio six hours late, the final point may be decisive. If Rio was a separately purchased self-transfer, that conclusion does not follow automatically.
Door opening, rather than touchdown, is the useful arrival marker. Keep airline messages and reliable airport evidence. The passenger does not need to prove a financial loss to receive the fixed sum, but LATAM can avoid compensation if it establishes extraordinary circumstances and reasonable measures.
Cancellation and replacement travel
A UK departure cancelled with less than 14 days' notice can support fixed compensation unless LATAM proves an applicable timing or extraordinary-circumstance defence. Independently, the passenger should be offered a choice between reimbursement and rerouting.
If the journey remains important, ask LATAM to reroute at the earliest opportunity. Search reasonable same-day options, including partner services, and send them to the airline before buying an expensive replacement. When LATAM refuses or cannot act, preserve chats, call logs, screenshots and a proportionate receipt. Recovery of self-arranged transport is fact-sensitive; evidence that the airline was given a chance to perform is valuable.
Selecting a refund can be appropriate when the trip has lost its purpose. It also normally ends the contract's transport obligation for the refunded sectors. A LATAM Wallet credit or travel voucher should be accepted only after checking currency, expiry, transferability and whether it settles statutory rights. UK261 compensation is monetary unless the passenger freely agrees to another form.
Missed connection after Heathrow
One-ticket journeys can be valuable claims. Consider Heathrow-GRU-SCL. A carrier-controlled delay at Heathrow causes the onward flight to be missed, and LATAM reroutes the passenger to arrive in Santiago 8 hours late. UK261 began at Heathrow, so the final arrival can support GBP 520 if the other requirements are met.
The evidence should establish a joined itinerary. One reservation code is strong, but also retain the e-ticket coupon sequence, through baggage tag and LATAM's automatic rebooking. If the ticket has multiple operating airlines, identify which carrier operated the flight that caused the disruption and which carrier handled the rerouting.

Care during a UK departure disruption
For long-haul delay, the care threshold is generally four hours at departure. Cancellation or denied boarding can trigger assistance while rerouting is pending. Appropriate support includes meals and refreshments, a means of communication, and hotel accommodation with transport when an overnight wait is necessary.
Care does not depend on airline fault in the same way as fixed compensation. Severe weather may defeat the GBP 520 claim while leaving the duty to look after stranded passengers intact. Ask LATAM first. If no practical support is provided, buy reasonable essentials, avoid premium choices and retain itemised receipts.
Put expenses in a separate claim line. A restaurant receipt does not prove entitlement to GBP 520, and the fixed amount does not reimburse the actual hotel bill. Keeping categories distinct helps both survive review.
Denied boarding at Heathrow
An oversold departure may prompt LATAM to seek volunteers. A volunteer negotiates benefits and alternative transport. Someone who does not volunteer but is still refused despite being ready to travel can have statutory rights to compensation, care and rerouting or reimbursement.
Ask gate staff for a written denied-boarding record. Photograph the gate information, retain the final boarding pass and note when volunteers were requested. Do not sign a document describing the refusal as voluntary unless that is accurate and the negotiated terms are acceptable.
No compensation is expected when the refusal was reasonably based on missing visas, invalid travel documents, safety, health or late presentation. South American itineraries can have complex transit requirements, so preserve the document check if LATAM relies on it.
Causes: what LATAM must explain
The UK extraordinary-circumstances test asks whether an event outside normal airline control caused the disruption and whether reasonable measures could have prevented or reduced it. Examples can include severe weather, airspace restrictions or security incidents. The airline needs more than the phrase “circumstances beyond our control.”
The CAA states that ordinary technical component failure and general wear and tear should not normally be treated as extraordinary. A carrier-wide staffing or rotation problem also deserves close scrutiny. Request the underlying occurrence, aircraft rotation, relevant restrictions and recovery steps.
A knock-on delay from an earlier flight is not self-proving. LATAM should show the causal link and why spare capacity, crew changes or rerouting were not reasonable. If the explanation changes between the airport and claim response, preserve both versions.
GBP calculations for households
Three passengers, 5-hour arrival delay. A family on Heathrow-GRU under one qualifying booking arrives 5 hours late after a routine operational event. GBP 520 multiplied by three equals GBP 1,560. Add documented care costs separately.
Four passengers, rerouted within four hours. A cancelled LHR departure is replaced and final arrival is 3 hours 40 minutes late. If the reduction conditions apply, GBP 260 each totals GBP 1,040 rather than GBP 2,080.
Outbound and return both disrupted. Heathrow-Sao Paulo is delayed five hours and can qualify. The LATAM-operated Sao Paulo-Heathrow return is delayed six hours but normally lies outside UK261. The two events should not be presented as a double GBP 520 claim merely because they share a booking.

Filing and escalation in the UK
Create a written LATAM Help Center case and retain the case identifier. State UK departure, complete itinerary, operator, final arrival, cause reported at the airport, amount per passenger and expenses. Attach the original ticket, boarding documents, messages and receipts.
If LATAM issues a final response or does not respond within eight weeks, current CAA guidance directs passengers to an approved ADR provider when the airline participates, or potentially to the CAA's Passenger Advice and Complaints Team when it does not. Check the current airline listing before naming a forum. PACT can provide assistance but does not have power to impose a binding award in every case.

UK261 remains separate from the EU reform adopted in 2026. Future EU procedural provisions do not rewrite the UK amounts or automatically control a Heathrow claim. Use current CAA guidance and verify the available LATAM complaint route on the submission date.

Can LATAM owe GBP 520 even though it is a Chilean group?
Yes. UK261 covers a flight departing a UK airport regardless of the operating airline's nationality, subject to the other compensation conditions.
Is LATAM Sao Paulo-Heathrow protected by UK261?
Normally not when a LATAM affiliate operates it, because the inbound flight starts abroad and LATAM is not a UK or EU carrier.
Does accepting rerouting cancel my compensation claim?
