LATAM from Latin America to Europe: when EU261 does not apply
A flight operated by LATAM from Brazil, Chile, Peru, Colombia or another Latin American country to the EU or UK normally does not qualify for EU261 or UK261 fixed compensation. LATAM is neither an EU nor a UK carrier, and both regimes restrict coverage for inbound flights that start outside their territory. The conclusion can change when an EU or UK airline actually operates the relevant sector, or when the disputed journey started in Europe on one protected booking.

LATAM may still owe rerouting, reimbursement, assistance or damages under the departure country's law, its contract and the Montreal Convention. Those remedies should be claimed accurately instead of relabelling them as automatic EUR 600 or GBP 520 payments.

The point of sale does not move the departure airport. Paying in euros, buying from LATAM's European website or using an EU travel agency will not by itself make a South America-origin flight fall under EU261. Likewise, a British resident returning home does not gain UK261 solely through residence or destination.
Why EU261 normally stops at the inbound boundary
The regulation protects flights departing the EU/EEA/Switzerland on any operating carrier. For a flight that begins outside and arrives inside that area, the operator generally must be an EU carrier. LATAM's current passenger-rights information explicitly describes LATAM as non-Community and links EU protection to its departures from the EU.
That makes Madrid-Sao Paulo and Sao Paulo-Madrid legally asymmetric when LATAM operates both. The outward flight can qualify; the return normally cannot. A round-trip ticket does not erase the separate territorial analysis, and neither does a shared reservation code.
Your Europe guidance also warns that non-EU-to-EU connecting journeys need careful operator analysis. Do not assume that a short EU-operated final sector automatically imports the entire preceding LATAM journey into EU261. Identify each flight, the operating airlines and the ticket structure.

UK arrivals follow a comparable limitation
UK261 covers departures from the UK on any airline. For an inbound journey, it generally covers flights operated by a UK or EU carrier. LATAM does not have that status. A LATAM-operated Sao Paulo-Heathrow service therefore usually sits outside UK261 even if the same aircraft's Heathrow-Sao Paulo sector would be protected.
Codeshares can alter the result. If British Airways physically flies the aircraft and provides the crew on the inbound service, the UK-carrier branch may apply. A BA code printed beside a LATAM-operated flight is not enough. Conversely, an LA code on a British Airways-operated flight does not remove the operator's status.
Passengers should preserve the e-ticket's “operated by” line and the boarding pass. The operating-carrier guide helps identify the correct respondent before a claim is sent.
A European connection does not always rescue the claim
Consider Santiago-Madrid-London sold on one ticket. LATAM operates Santiago-Madrid and Iberia operates Madrid-London. A disruption on the first flight causes arrival in London five hours late. This is not safely analysed by saying “the final destination is in Europe.” The journey began outside the protected area, the causative long-haul sector was operated by a non-EU airline, and current EU guidance requires flight-by-flight operator attention on inbound itineraries.
Now reverse it: London-Madrid-Santiago under one booking. UK261 can attach at London and final arrival may govern. The mirror itinerary is not legally identical. Direction has changed.
If a passenger independently buys Sao Paulo-Madrid and Madrid-London, each ticket is usually assessed on its own. The first LATAM ticket remains an inbound non-EU-carrier service. Loss of the separate London flight may be a proven-damages question but is not automatically fixed compensation.
When an inbound LATAM itinerary is still part of a protected journey
There is an important distinction between an ordinary return sector and a later connection on an EU-origin one-way journey. Madrid-Sao Paulo-Porto Alegre on one reservation starts in the EU. A disruption at GRU can still be assessed using arrival in Porto Alegre because the protected journey began in Madrid.
By contrast, the return Porto Alegre-Sao Paulo-Madrid starts in Brazil. It does not inherit the outbound's EU261 status merely because both directions were bought together. Record each directional itinerary, ticket coupons and actual operating carriers.

Rights that may exist outside EU261 and UK261
Failure of the European fixed-sum test does not give LATAM a free hand. The departure country can impose rules on cancellation, schedule changes, assistance, refunds and complaint handling. The relevant body and remedy depend on where the flight started and which LATAM affiliate operated it.
Examples include Brazil's ANAC framework, Chilean aviation and consumer channels, Peru's aviation and consumer procedures, and Colombian passenger protections. Their terminology, deadlines and compensation models are not interchangeable. A right to re-accommodation or reimbursement is not automatically a EUR 600 tariff.
Useful claim categories include:
- refund of unused transport after cancellation;
- rebooking to the contracted destination;
- reasonable meals or hotel support where local rules require it;
- repayment of necessary, documented replacement costs;
- proven consequential damage under applicable law;
- baggage claims under the Montreal Convention for international carriage.
Ask for the remedy supported by the applicable source. Inflating a local complaint with an inapplicable EU amount makes a valid refund or expense claim easier to reject.
LATAM's commercial options are not statutory compensation
LATAM's Help Center describes rescheduling, refunds and LATAM Wallet. After an airline cancellation or significant change, My Trips may offer a replacement flight or refund of unused flights and services. Those options can solve transportation value, but they do not prove that EU261 applies.
A wallet credit can be convenient; it may also impose currency, account or usage restrictions. Before accepting it, compare the cash refund available under the governing rule and read whether the choice closes other claims. Preserve the offer screen and consent record.
When LATAM cancels a non-covered inbound journey, request a clear choice in writing. If a viable replacement is needed, avoid selecting reimbursement until the effect on onward transport is understood.
Evidence for a non-EU261 claim
Even without a European fixed sum, the evidence bundle should be rigorous:
- original booking and all ticket numbers;
- operating affiliate for each sector;
- cancellation, delay or denied-boarding notice;
- original and replacement itinerary;
- actual arrival and waiting time;
- care offered and itemised receipts;
- chats, call references and case numbers;
- proof of any specific loss claimed.
State why a local or contractual remedy applies. If the operator is LATAM Airlines Brasil, do not address a generic complaint only to “LATAM Group” when the form requests an operating company. If a partner operated the flight, follow that carrier's procedure.
Four realistic examples
Brazil to Spain on LATAM. A direct Sao Paulo-Madrid flight arrives seven hours late because of an ordinary technical issue. The inconvenience is serious, but the LATAM-operated journey began outside the EU. EU261's EUR 600 normally is not available. The passenger should pursue rights under the applicable Brazilian framework, LATAM's conditions and any proven-damage basis.
Peru to Spain on Iberia. LATAM sells the ticket, but Iberia operates Lima-Madrid and the flight is cancelled. Iberia's EU-carrier status can engage EU261 on the inbound route. The complaint should normally identify Iberia as operating carrier.
Chile to the UK on LATAM. Santiago-Heathrow is delayed by five hours. LATAM operates and the journey starts abroad, so UK261's GBP 520 generally does not apply. Local and contractual remedies remain to be checked.
EU-origin connection continuing within Brazil. Madrid-GRU-Recife is one LATAM booking. A GRU connection failure leads to final arrival in Recife six hours late. Because the protected journey began in Madrid, EU261 may apply to the final delay. This is not an inbound return case.
Avoid these common claim errors
Do not use destination alone as the legal test. Do not infer the operator from the flight code. Do not quote EUR 600 because the delay exceeded four hours before checking territorial scope. Do not combine outward and return disruption into one event. Do not call every wallet credit “compensation.”
The strongest files begin with a truthful coverage conclusion. Where EU261 does not apply, a precise local refund or expense claim has more credibility than a copied European template.

The EU reform adopted in 2026 does not turn LATAM into an EU carrier or reverse the inbound territorial rule before its provisions apply. Future procedural deadlines must not be used as current law. Check the departure country's live complaint channel and act promptly under the presently applicable rules.

Does arriving in Madrid make a LATAM flight covered by EU261?
No. When the journey starts outside the EU, the operating airline generally must be an EU carrier. LATAM-operated inbound flights normally fail that condition.
Can a European passport create compensation on Sao Paulo-Madrid?
No. Passenger nationality does not change EU261's territorial and operating-carrier tests.
What if Iberia operates the LATAM-booked flight?
An Iberia-operated arrival from Latin America can be covered because Iberia is an EU carrier. Confirm the operator rather than relying on the marketing code.
Is there no claim at all when EU261 is unavailable?
Other claims may exist under departure-country law, LATAM's contract, refund duties, proven-loss rules or the Montreal Convention. They are not automatic EUR 600 awards.
Does the outbound EU261 protection cover the return journey?
Not automatically. Each direction starts at a different airport and must be tested separately, even when both directions share one purchase.
