A Kenya Airways delay can qualify for EUR 250-600 or GBP 220-520 when the continuous journey begins in the EU/EEA or the United Kingdom, reaches its final destination at least three hours late and is not excused by extraordinary circumstances. A Kenya Airways-operated flight starting in Nairobi normally does not become an EU261 or UK261 case merely because it arrives in Europe.

For example, Amsterdam-Nairobi-Dar es Salaam on one ticket can be assessed to Dar es Salaam. If the Amsterdam flight arrives two hours late and the missed connection results in arrival six hours late, the final loss of time is the relevant measurement. If the two sectors were bought independently, the first carrier is not automatically liable for consequences on the second contract.
Measure arrival, not the departure board
The headline “three-hour delay” concerns arrival at the final destination. Touchdown, parking and door opening are different moments. Under European case law, actual arrival is normally when at least one door opens and passengers are permitted to leave.
Convert scheduled and actual arrival into the same time zone. Nairobi, London and continental Europe do not keep identical clock offsets throughout the year, so copying local display times can create a false result. Retain the replacement boarding pass and a reliable record of door opening, such as an airline message, airport record or contemporaneous note.

Direction changes the legal result
Europe to Kenya or onward Africa
A Kenya Airways departure from Paris-CDG or Amsterdam can fall under EU261. The airline's Kenyan licence does not remove that protection. When the ticket continues through Nairobi, final arrival at the onward African airport may determine both eligibility and distance.
United Kingdom to Nairobi
A Kenya Airways service leaving Heathrow or Gatwick can fall under UK261. The fixed long-distance amount is GBP 520 where the qualifying arrival delay exceeds four hours; a three-to-four-hour long-haul delay is generally GBP 260.
Nairobi to Europe or the United Kingdom
A separate Nairobi-origin flight operated by Kenya Airways is normally outside EU261 and UK261. A KLM-operated Nairobi-Amsterdam sector may produce a different EU analysis because KLM is an EU carrier. On KQ operation, examine rerouting, involuntary refund, Kenya consumer remedies and demonstrable Montreal Convention loss rather than demanding a European fixed sum without a territorial basis.
When the reason supports a fixed claim
Routine operational events within airline activity often remain the carrier's responsibility. Examples requiring fact-specific review include ordinary aircraft defects, crew rostering, a delayed incoming aircraft and boarding-process failures. A label such as “technical” does not decide the legal result.
External events may remove fixed compensation if Kenya Airways proves both the event and the reasonable measures it took. Severe weather incompatible with safe operation, air traffic management restrictions, airport closure, security threats and some third-party strikes can qualify. The airline should still provide care on a protected journey and should explain the causal chain rather than name a category in isolation.

Most direct Europe-Nairobi journeys exceed 3,500 km. Under the long-distance delay rule, arrival between three and four hours late may permit a 50% reduction. Do not halve the claim merely because Kenya Airways offered another flight; the actual final arrival and statutory reduction conditions matter.
Each eligible traveller is calculated separately. Fare price, cabin and whether the trip was bought during a sale do not set the fixed sum. An award ticket can also fall within EU261 or UK261 when it was issued through a public loyalty programme rather than free private carriage.
Care while the passenger waits
Fixed compensation is not the same as airport assistance. On a covered long-haul departure, the care trigger is generally four hours at departure. Kenya Airways should provide reasonable meals and refreshments, communication, and hotel accommodation with airport transport when an overnight wait becomes necessary.
Extraordinary weather may defeat the fixed payment but does not erase care duties under EU261 or UK261. If direct assistance is not offered, spend proportionately and keep itemised invoices. Alcohol, luxury accommodation or an unnecessary taxi is harder to recover than a modest meal, practical room and transfer.
After a delay of at least five hours on a protected departure, a passenger who no longer wishes to travel can choose reimbursement under the applicable statutory rule. Evidence for a Kenya Airways delay claim
Save the original e-ticket, booking reference, every boarding pass, the operated-by line, delay notifications and all replacement documents. Record the scheduled final arrival, actual door-opening time and the explanation given by staff. Photograph the departure display only when the flight and timestamp are readable.
For connected travel, preserve the entire itinerary and proof that the connection was issued under the same reservation. Note when the first aircraft parked, when the passenger reached transfer screening and what onward flight Kenya Airways offered. This distinguishes a true protected misconnection from a separately arranged connection.
Use Kenya Airways' dedicated EU/UK disruption portal for the fixed claim. State the legal system, initial departure, final destination, final delay and amount per passenger. Is a three-hour departure delay enough for Kenya Airways compensation?
