Kenya Airways five-hour delay: refund or continue travelling?

After a Kenya Airways departure covered by EU261 or UK261 has been delayed for at least five hours, the passenger may abandon the journey and request reimbursement instead of continuing. This is a choice about the usefulness of the trip, not automatic EUR 600 or GBP 520 compensation. A separate Kenya Airways journey beginning in Nairobi is normally outside the European five-hour rule, although KQ publishes another direct-sale refund process after more than eight hours.

Five hours measures departure delay

The statutory reimbursement choice under EU261 and UK261 is tied to delay at departure. That differs from fixed delay compensation, which normally uses arrival at the final destination.

A passenger can use the five-hour refund choice even when extraordinary weather caused the delay. The fixed payment might fail because of that weather, but the right not to continue a now-pointless protected journey remains a separate matter.

Which Kenya Airways journeys use this rule?

Covered EU departure

Paris-CDG-Nairobi or Amsterdam-Nairobi operated by Kenya Airways can fall under EU261 because the aircraft leaves a covered EU airport. The airline's place of establishment does not matter for the outbound direction.

Covered UK departure

Heathrow-Nairobi and Gatwick-Nairobi operated by Kenya Airways can fall under UK261 because they depart the United Kingdom. The five-hour reimbursement choice is available on qualifying delays.

Nairobi departure

Nairobi-Paris or Nairobi-London operated by Kenya Airways is not brought within EU261 or UK261 by its destination. The passenger should examine Kenya Airways' contract, its more-than-eight-hour direct-sale refund workflow and any provable Montreal Convention loss. Do not cite Article 6 of EU261 without a covered territorial starting point.

What reimbursement can include

For a protected journey abandoned after the threshold, reimbursement can cover the full cost of the unused travel. It can also cover parts already flown if the trip no longer serves the passenger's original plan, together with a return flight to the first departure point where relevant.

Consider Amsterdam-Nairobi-Mombasa on one ticket. The passenger reaches Nairobi, but the final sector is delayed far beyond five hours and the business event in Mombasa has ended. If the completed travel no longer serves any purpose, the claim may extend beyond the last unused coupon and require transport back to Amsterdam. The passenger should document the original purpose and why continuing no longer helps.

This is not a general permission to cancel a return journey that remains useful. State exactly which coupons are unused, which completed segment lost its purpose and what return transport is requested.

Decide before accepting a workaround

Kenya Airways may propose a later flight, partner service, reroute or voucher. Ask for the itinerary in writing and compare its final arrival with the purpose of the trip. If continuing is useful, taking rerouting can preserve a separate fixed-compensation assessment. If the journey has become pointless, reimbursement may be the rational choice.

Do not accept a voucher merely because it appears fastest on a mobile screen. Check:

  • whether cash reimbursement is available;
  • voucher expiry and route restrictions;
  • whether accepting it closes only the fare issue or all claims;
  • what happens to return and onward sectors;
  • whether all passengers on the booking must make the same choice;
  • whether an agent or Kenya Airways controls the ticket payment.

Avoid accidental cancellation of useful sectors

Kenya Airways' online refund information warns that a refund request can cancel the entire booking. Before submitting, list every future sector that should remain active and ask for confirmation if only part of the itinerary is being abandoned. This is particularly important for round trips and family bookings where passengers may make different decisions.

Where a travel agent issued the ticket, the agent may control the fare refund. That does not make the agent responsible for EU261 or UK261 fixed compensation caused by Kenya Airways as operating carrier. Send each demand to the party responsible for that remedy.

Five hours versus Kenya Airways' eight-hour process

Kenya Airways' current online refund page tells a direct web customer who cancelled because a flight was delayed for more than eight hours to use a specified form. This is a KQ processing route for eligible direct purchases. It must not be used to postpone a five-hour EU261 or UK261 right.

Evidence and notification at the airport

Keep the ticket, booking reference, original schedule and a timestamped record showing the delay reached five hours. Ask Kenya Airways to note that the passenger is exercising the reimbursement choice rather than voluntarily abandoning an on-time flight. Request written confirmation of which sectors will be cancelled.

If travel has already begun, retain proof of the itinerary's purpose and why it no longer could be achieved. Save any request for a return to the starting airport and the airline's response. Where reasonable care was not provided while the passenger decided, preserve itemised expense receipts.

After the journey, put fixed compensation, reimbursement and care costs in separate sections. FAQ

Does five hours automatically mean EUR 600?

No. Five hours creates a possible reimbursement choice on a covered departure; fixed compensation uses final arrival, cause and other conditions.

Can I take the later flight and still claim compensation?

Yes, accepting rerouting does not by itself waive a qualifying fixed-payment claim.

Is the five-hour rule available from Nairobi?

Normally not under EU261 or UK261 on a Kenya Airways-operated Nairobi departure. Review KQ's separate contract and refund procedure.

Will an online refund cancel the whole reservation?

It can. Kenya Airways warns that submitting certain refund requests cancels all sectors, so check the effect before filing.

What if the delay is caused by extreme weather?

The fixed sum may be excluded, but a covered passenger can still have care and five-hour reimbursement rights.
