Kenya Airways weather and air traffic control compensation
Bad weather or an air traffic control restriction can remove fixed compensation only when Kenya Airways proves that the event actually caused the disruption and could not reasonably have been avoided. On a protected departure, meals, accommodation and rerouting can still be due even when EUR 250-600 or GBP 220-520 is not. A Kenya Airways flight leaving Nairobi for Europe normally falls outside EU261 and UK261, so direction must be checked before debating the cause.

A thunderstorm in another country, a forecast that never affected the airport or congestion mentioned without a restriction is not enough by itself. The evidence should connect a specific event to the claimed service.
When weather may be extraordinary
Conditions that can support an extraordinary-circumstances defence include airport closure, unsafe crosswinds, volcanic ash, severe icing, lightning damage or a storm that makes the planned operation unsafe. The legal test is fact-specific. Rain, cloud or a seasonal weather forecast does not automatically excuse a long delay.
Compare the alleged condition with the airport, runway and time of operation. If other flights departed, that does not conclusively prove KQ could fly: aircraft type, assigned runway, crew duty time and destination conditions can differ. It is nevertheless useful evidence when the airline supplies only a generic statement.
Ask for the operational period affected, any airport or authority notice, the aircraft rotation and the time at which normal operations resumed. This distinguishes the initial external event from later recovery choices.
What an ATC restriction means
Air traffic control can reduce arrival rates, close airspace, impose a departure slot or direct an aircraft to hold or divert. A binding decision external to Kenya Airways can be extraordinary. General airport congestion, however, does not explain every later delay in the aircraft's schedule.
The airline should identify the restriction and its duration. Useful details include a slot message, airspace closure, runway restriction or destination flow-control period. Passengers can ask whether the delay resulted from the assigned slot, a missed slot caused by KQ's own readiness problem, or a combination of events.
If the aircraft was not ready and then lost its slot, responsibility can be mixed. The carrier should explain which event caused the final arrival delay rather than relying on the last operational message alone.
Protected and unprotected directions
Amsterdam-Nairobi and Paris-Nairobi operated by Kenya Airways can fall under EU261 because they leave the EU. Heathrow-Nairobi and Gatwick-Nairobi can fall under UK261. A qualifying long-distance final delay can ordinarily produce EUR 600 or GBP 520 unless the extraordinary defence succeeds; a long-haul arrival between three and four hours late can trigger the statutory reduction.
The reverse KQ-operated journeys, Nairobi-Amsterdam, Nairobi-Paris or Nairobi-London, normally do not receive those European or British fixed sums. Kenya Airways is not an EU or UK carrier. Contractual rerouting, a ticket refund in a qualifying case and proven loss under the Montreal Convention may still be relevant.
If KLM or Air France actually operates an incoming sector, repeat the test using that operating airline. The marketing code on the ticket does not settle territorial coverage.
Incoming aircraft and knock-on delay
Weather may affect the aircraft before it reaches the passenger's airport. Kenya Airways can rely on an earlier external event only if it demonstrates a direct causal connection to the claimed flight and reasonable recovery measures.
Request the affected rotation, not merely the words "late incoming aircraft." Consider how much time passed, whether the weather had cleared, whether a reserve aircraft or partner reroute existed and whether crew duty limits arose because recovery was delayed. An extraordinary event can have unavoidable knock-on effects, but the label does not extend indefinitely through the timetable.
For a through booking, calculate delay at the final ticketed destination. A two-hour weather delay from Paris that causes an overnight missed connection in Nairobi may create a much longer final delay. The defence still turns on the proven event and reasonable measures across the journey.
Care does not disappear
On a covered EU or UK departure, Kenya Airways must provide reasonable meals and refreshments after the applicable waiting period, communication, and a hotel plus transfers when an overnight stay becomes necessary. These duties apply even if weather or ATC removes fixed compensation.
Ask KQ staff or the appointed ground handler for written assistance. If none is provided, buy proportionate essentials and keep itemised receipts. Alcohol, luxury rooms and unrelated shopping are difficult to recover. Photograph the departure board and retain messages showing when help was requested.

Evidence checklist
Keep the e-ticket, booking reference, boarding pass, airport notices, KQ messages and proof of actual arrival. Add screenshots of airport status pages or official weather and airspace notices captured at the relevant time. A later generic weather website is less useful than contemporaneous operational evidence.
Write a chronology with scheduled departure, first notification, revised times, actual take-off, landing and door opening. Record what staff said without presenting an informal comment as confirmed fact.
In the claim, state why the route is protected, identify the fixed sum sought and request the precise extraordinary event plus reasonable measures. Put hotel and meal reimbursement in a separate section with receipts. The claim-form guide shows which portal and documents to use.
Worked examples
A KQ flight from Paris to Nairobi is cancelled after the airport closes runways during a severe storm. KQ places the passenger on the earliest practicable flight the next morning and provides a room and meals. Fixed EU compensation may be excluded if the closure and mitigation are proved, but the care remains payable.
Now assume Amsterdam weather cleared by noon, yet KQ cancelled an evening service and cited only "operational reasons caused by weather." Other suitable reroutes had seats and the airline supplies no rotation or airport restriction. The passenger has a reasonable basis to challenge the defence and request evidence.
For Nairobi-London operated by KQ, an ATC delay does not create a UK261 claim because the flight did not depart the UK and KQ is not a UK carrier. The passenger should pursue contractual assistance and documented financial loss instead of quoting GBP 520 as an automatic entitlement.
