A flight that lands two hours and 55 minutes late can cross three hours while waiting for a stand. Conversely, a departure delayed by four hours may recover enough time to arrive under the threshold. Save records around the door-opening moment rather than relying only on a flight-tracking arrival label.
Final destination can be beyond Nairobi
Suppose a passenger holds Paris-Nairobi-Entebbe under one reservation. The Paris departure creates the territorial link to EU261. If the long sector arrives two hours and 20 minutes late, the passenger misses the protected connection and reaches Entebbe seven hours late, the final destination is Entebbe for the delay assessment.
Now change one fact: the Nairobi-Entebbe ticket was bought separately. The original carrier did not accept responsibility for that independent contract merely because the passenger planned to connect. The Paris-Nairobi arrival must be assessed on its own, while losses involving the second ticket may require a different contractual or Montreal Convention argument.

Direction remains the first filter

The exact same delay can therefore produce a fixed sum in one direction and no European fixed sum in the other. This is not based on fairness, nationality or where the ticket was sold; it follows the territorial wording of the respective rules.
Calculate the delay correctly
Use one time zone for both scheduled and actual final arrival. Daylight-saving changes can make a copied pair of local times misleading. The scheduled time should come from the ticket valid for the affected journey, while the actual time should be supported by operational evidence.
If the result is close to three hours, request the airline's movement record and door-opening time. Helpful supporting material includes:
- the original e-ticket and updated boarding pass;
- airport arrival displays photographed with a visible timestamp;
- a message confirming arrival or connection rebooking;
- a contemporaneous note of when passengers were allowed to leave;
- baggage or immigration records that corroborate the sequence;
- statements from travelling companions recorded independently.
Do not alter a screenshot or round 2 hours 58 minutes up to three hours. A precise claim is more credible and avoids spending time on an ineligible threshold case.
Three hours does not automatically mean payment
After scope and timing, examine the cause. Kenya Airways can avoid the EU261 or UK261 fixed sum if it proves extraordinary circumstances that could not have been avoided even with all reasonable measures.
Severe weather incompatible with flight safety, binding air traffic restrictions, airport closure and security risks may qualify. Normal aircraft maintenance, ordinary component failure and preventable crew planning are generally closer to the airline's own activity. An incoming-aircraft delay needs a causal chronology; it is not an independent defence.
Ask for the event date, airport, aircraft rotation and mitigation. A response that says only “operational constraints” does not allow the passenger to test the legal standard.
Long-distance amounts and the four-hour reduction
Direct European gateways to Nairobi are over 3,500 km. A qualifying EU261 delay can therefore carry a standard EUR 600 amount. UK261 uses GBP 520 for its long-distance band. Where long-haul arrival is between three and four hours late, the airline may apply the relevant 50% rule, resulting in EUR 300 or GBP 260.
At four hours exactly, retain precise evidence rather than assuming which side of the line the case falls on. Compensation is calculated per eligible passenger, not per booking. A couple on one reference has two claims; a family is not limited to one payment.
Care starts on a different clock
The three-hour arrival threshold is not the waiting-time trigger for food or accommodation. For long-distance EU261 and UK261 departures, care generally begins after four hours of departure delay. A traveller might therefore receive care even when final arrival later falls below three hours, or qualify for fixed compensation after a missed connection even though the initial departure wait was shorter.
If an overnight stay becomes necessary and Kenya Airways does not arrange it, choose a reasonable room and transport connection, then retain itemised receipts. The cause can be extraordinary and care can still be due.
Submit the borderline case clearly
Kenya Airways' dedicated EU/UK claim portal allows the passenger to begin with a 706 ticket number or enter details manually. State the first departure, final destination, operating carrier, scheduled arrival and evidenced door-opening time. Attach the entire booking where a connection determined the outcome.
Separate the fixed sum from expenses and any fare refund. If the response uses only the arrival at Nairobi despite a through booking to another city, point to the final destination on the e-ticket. If Kenya Airways says the route is outside scope, answer with the covered initial departure rather than the passenger's residence.
Current EU261 remains applicable on 15 August 2026. The adopted reform is not yet in force; its future procedural deadlines should not be retrofitted to a present claim.
