Iberojet and EU261: which flights are covered?

Published: 10 September 2026

Iberojet coverage is unusually easy to misread because the holiday brand sits over two operating companies. The reliable method is to identify the airport where the affected direction began and the airline that was meant to operate the disrupted flight. Evelop Airlines S.L. is Spanish and uses E9; ORBEST S.A. is Portuguese and uses 6O. Both are EU carriers.

What happened to your flight?

Claim up to €600 for a delayed or cancelled flight.

Choose the situation that applies to your flight:

This assessment uses the law in force on 9 September 2026. Although an EU reform was adopted in July 2026, application is deferred. Its future nine-month claim period and other amended rules are not current law.

EU departures are the straightforward category

EU261 can cover an Iberojet-operated flight that departs from an EU airport, regardless of passenger nationality or residence. Madrid–Punta Cana and Lisbon–Cancún therefore pass the territorial gateway when operated by Evelop or Orbest. The same departure rule can protect an EU flight operated by a non-EU carrier too, although that is less likely on Iberojet's own operation.

The relevant departure is assessed for the affected journey. Paying in pounds, booking through a Canadian agency or travelling on a package does not move Madrid or Lisbon outside the EU. Equally, an English-language confirmation does not create UK261 coverage.

Inbound flights depend on the operating carrier

For a flight beginning outside the EU and ending inside it, EU261 generally requires an EU operating carrier. That is why the distinction between brand and operator matters. A Punta Cana–Madrid service physically operated by Spanish Evelop, or a Cancún–Lisbon flight operated by Portuguese Orbest, can satisfy the inbound carrier condition.

Do not assume every flight sold as Iberojet has the same answer. A codeshare or replacement sector flown by another airline must be tested using that operator. The booking logo, ticket stock and package seller are not substitutes for “operated by”. Keep the original coupon before a disruption reissues it.

A return ticket contains two legal directions

Imagine Niamh buys Dublin–Madrid separately, then one Iberojet return ticket Madrid–Havana–Madrid. The outbound Madrid–Havana direction is covered because it leaves the EU. The return can also be covered if Evelop or Orbest operates Havana–Madrid. Her Irish residence is not the reason; the airports and EU status of the inbound operator are.

Now change the facts: a non-EU partner operates the Havana return under an Iberojet marketing code. The inbound limb may then fall outside EU261. The outbound result does not automatically carry across to the return simply because both appear under one PNR.

UK261 requires its own UK territorial connection. It should not be promised merely because the passenger started a separate feeder in Manchester or bought through a British organiser.

Connections require a contract check as well as a map

Where connecting sectors are on one transport contract, the final destination and total arrival delay may govern the compensation assessment. An agency itinerary, however, may bundle two tickets visually. Separate ticket numbers or a self-transfer can break the chain, leaving each carrier responsible only for its own contract.

For a Cancún–Madrid–Rome itinerary issued as one through ticket, preserve every coupon and identify each operator. If Iberojet's first sector causes a missed protected connection, Rome may be the final destination for delay measurement. If Madrid–Rome was bought independently, Iberojet did not necessarily undertake carriage to Rome.

Coverage does not itself guarantee payment. The disruption type, delay, cancellation notice, cause and reasonable measures still require proof.

Match each remedy to the covered event

Fixed EU261 compensation uses the EUR 250, EUR 400 or EUR 600 bands. Refund or rerouting concerns unused transport; care concerns reasonable support during the wait. These rights have different triggers. An extraordinary-circumstances defence can affect the fixed award without cancelling care or the choice after cancellation.

Baggage damage does not become an EU261 fixed award because the flight was covered. It follows the Montreal Convention, with a property-loss calculation, prompt airport report and written time limits. Package rights remain with the organiser and can address the wider holiday, subject to avoiding double recovery.

Evidence that settles territorial disputes.

Use the original e-ticket, boarding pass, operating-carrier line, full itinerary and any aircraft-change notification. Put four facts in the first paragraph of the Iberojet form: affected direction, first departure airport, final contractual destination and operator. A booking locator and surname are used to access the form; save each field and attachment.

If rejected, ask which territorial element Iberojet disputes. Enforcement routes in Spain or Portugal depend on the departure and event rather than the passenger's preferred language. A precise file is easier to escalate than a broad claim that “all European bookings are covered”.

Questions about Iberojet coverage

Is every Iberojet flight covered by EU261?

No. EU departures are within the territorial gateway, while inbound non-EU departures require an EU operating carrier. Other eligibility conditions also apply.

Are Evelop and Orbest EU carriers?

Yes. Evelop is Spanish and Orbest is Portuguese. Confirm which entity operated the flight through the E9 or 6O coupon and operated-by line.

Does one PNR make both directions covered?

No. Outbound and return directions are assessed separately. A common PNR does not change where each direction starts or who operates it.

Does a package booking change EU261 territory?

No. It creates possible rights against an organiser, but EU261 still follows the flight direction and operating carrier.

Is the future nine-month period current?

No. The July 2026 reform has deferred application, so the nine-month period is not the law in force on 9 September 2026.
