Iberojet flight compensation for delay or cancellation

Published: 10 September 2026

An Iberojet delay or cancellation can produce a fixed payment under EU261, but the airline does not owe it simply because a holiday started badly. Start with the flight direction and the carrier that was meant to operate it. Iberojet is a brand used by Spain's Evelop Airlines S.L. and Portugal's ORBEST S.A.; both are EU carriers. An E9/Evelop or 6O/Orbest flight leaving the EU can therefore be covered, and the same operator's flight into the EU from a non-EU country can also fall within EU261.

This guide states the law as at 9 September 2026. EU reforms adopted in July 2026 have deferred application. In particular, the proposed future nine-month claim period is not the current deadline and should not be used to reject or shorten a claim today.

When an Iberojet disruption can earn fixed compensation

The familiar EU261 payment is possible after a cancellation, an arrival delay of at least three hours, or qualifying involuntary denied boarding. The passenger must have a confirmed reservation, comply with the applicable check-in time, and be travelling on a flight within the regulation's territorial scope. For delay, the relevant time is normally arrival at the final destination on the same transport contract, not the moment the aircraft first touches the runway.

Direction comes before nationality. A Canadian family flying Iberojet from Madrid to Punta Cana may rely on EU261 because the flight departs from the EU. On the return, an Iberojet-operated Punta Cana–Madrid service may also qualify because Evelop and Orbest are EU carriers. A package booked through a British or Irish agency does not itself create coverage, and the language or currency of the booking is irrelevant.

Check the original e-ticket coupon for E9, 6O, “operated by Evelop” or “operated by Orbest”. A seller's logo or package voucher is not enough where another airline physically operated the affected sector.

The payment bands and the extraordinary-circumstances defence

Current EU261 bands are EUR 250, EUR 400 and EUR 600 per eligible passenger. They depend principally on the relevant route distance and, for some intra-EU journeys, whether the flight stays within the Union. Iberojet's leisure long-haul services will often sit in the EUR 600 band, while a protected intra-EU island route may fall in the EUR 400 category. The ticket price, package price and cabin do not set the amount.

Distance is only one part of the test. Iberojet can avoid fixed compensation if it proves that extraordinary circumstances caused the disruption and that it took all reasonable measures. A generic reference to “operational reasons”, “weather” or “air traffic control” is not a complete explanation. The response should identify the event, connect it to the flight and show why reasonable alternatives could not prevent the long delay or cancellation.

For certain long-distance reroutings that arrive less than four hours late, EU261 permits a 50% reduction. That reduction is not automatic whenever replacement transport is accepted.

Compensation is not a refund, care payment or damages award

Keep four columns in the claim. Fixed compensation addresses the qualifying loss of time. Reimbursement or rerouting deals with the unused or replacement journey after cancellation or a sufficiently long delay. Care covers reasonable meals, refreshments, communications, hotel accommodation and hotel transfers while the passenger waits. Further damages, including proven baggage loss, follow different legal rules and require proof of loss.

Accepting Iberojet's rerouting does not normally surrender a separate compensation claim. Equally, receiving EUR 600 does not automatically repay an unused ticket, a necessary hotel bill or a damaged suitcase. Do not multiply shared expenses: four passengers may each have a fixed award, but a family can recover the actual cost of one shared taxi only once.

A package holiday adds another contract. The organiser may owe solutions or a price reduction for package performance, while the EU261 claim follows the operating airline. The same lost hotel night cannot be recovered twice under different labels.

Worked example: Madrid to Cancún cancelled on departure day

Leah and Marcus bought a Manchester–Madrid feeder and an Iberojet Madrid–Cancún flight through an agency. The documents show separate ticket numbers. Iberojet cancels the Madrid departure six hours before take-off and reroutes them the following afternoon. They arrive in Cancún 25 hours late. Because the Iberojet sector starts in Madrid and the coupon names Evelop as operator, EU261 coverage is strong. The separate Manchester ticket does not extend Iberojet's contract backwards.

They should calculate the file in separate lines: any fixed EUR 600 claim for each passenger, the reasonable Madrid hotel and meals not supplied, and any unused transport for which they chose reimbursement. If Iberojet proves a qualifying extraordinary event, fixed compensation may fail, but the duties to offer rerouting or reimbursement and appropriate care do not disappear merely for that reason.

Their evidence is the original itinerary, cancellation notice with timestamp, replacement boarding passes, actual arrival time, operated-by line, and itemised receipts. A bank statement can support payment, but it is weaker than a receipt identifying what was bought.

How to present the claim to Iberojet

Use Iberojet's official claim form with the booking locator and surname. Begin with one sentence identifying the route, date, flight number and operating entity. Then give scheduled and actual arrival, the notice time if cancelled, and the remedy requested. Number attachments and save screenshots or a PDF copy of every completed field before submitting.

Ask for the cause if it was not stated precisely. If the response refuses payment, isolate the disputed point: territorial coverage, operating carrier, delay length, cancellation notice or extraordinary circumstances. Spanish or Portuguese enforcement routes depend on the flight and event, not on where the passenger lives or which language the travel agent used. Preserve the submission reference before escalating.

Questions about Iberojet compensation

Does every three-hour Iberojet delay qualify for EUR 600?

No. The flight must be covered, the relevant final arrival must be at least three hours late, and the amount depends on distance. Iberojet may also defeat the fixed award by proving extraordinary circumstances and reasonable measures.

Is a Punta Cana to Madrid Iberojet flight covered?

It can be. Although it starts outside the EU, the inbound limb can apply where the operating carrier is the EU-licensed Evelop or Orbest. Confirm the operated-by line rather than relying on the brand.

Can I claim both a refund and compensation?

Potentially, because they answer different questions. A refund concerns unused carriage; fixed compensation concerns a qualifying disruption. The passenger cannot, however, take a refund for travel that was actually used.

Does a package organiser pay the EU261 award?

The fixed flight claim is generally directed to the operating air carrier. The organiser may separately be responsible for package remedies, but overlapping losses cannot be paid twice.

Has the deadline become nine months after the July 2026 reform?

No. As at 9 September 2026, the reform's application is deferred. The future nine-month period must not be presented as the current rule; applicable limitation law still needs to be checked for the competent jurisdiction.
