Iberojet delayed, lost or damaged baggage claim

An Iberojet baggage claim is based on proven loss under the Montreal Convention, not the EU261 bands for flight disruption. Report the irregularity at the airport, keep the Property Irregularity Report (PIR) reference and bag tag, and follow with a written monetary claim supported by receipts or valuation. A PIR starts the tracing record; it is not normally the complete claim.

This guide states the law at 9 September 2026. The EU reform adopted in July 2026 has deferred application. Its future nine-month flight-compensation period neither governs today's EU261 claim nor replaces Montreal's baggage deadlines.
Report the bag before leaving the airport
Go to the baggage desk or handling agent as soon as a bag fails to appear or arrives damaged. Check that the PIR records the passenger, flight, bag-tag number, contact address and an accurate description. Photograph damage, wheels, handles, contents and the baggage belt area where useful. Keep the original tag and boarding pass.
If the desk is closed, use the official reporting route immediately and preserve evidence of the attempt. Informing a hotel representative or travel agency may help the package file but is not necessarily notice to the carrier.
Treat delay, loss and damage as different cases
A delayed bag may justify reasonable essential purchases while the passenger is away from home. A lost bag requires an inventory and evidence of value, age and condition. A damaged bag or contents claim needs photographs, repair estimates or evidence that repair is uneconomic. Montreal liability is compensatory and subject to a limit; it is not an automatic flat payment for inconvenience.
For checked baggage, written complaints about damage must generally be made within seven days of receipt. For delayed baggage, the written complaint must generally be made within 21 days after the bag is placed at the passenger's disposal. Court action under Montreal generally has a two-year period. These are different clocks; prompt action is safest.
Buy essentials reasonably and document each item
Reasonableness depends on destination, length of delay, purpose of travel and what the passenger had available. Basic toiletries, underwear and practical clothing for a beach holiday may be supportable. Designer replacements or a full wardrobe after a short delay are harder to justify. Keep itemised receipts; card statements alone rarely show what was necessary.
Purchases made after returning home are often more difficult because existing belongings are available. If medication or specialist equipment is involved, prioritise safety and keep professional or prescription evidence. Do not describe necessary baggage purchases as EU261 airport meals.
Worked example: two-day bag delay in Punta Cana
Ella flies Madrid–Punta Cana on an E9-operated Iberojet service. Her suitcase arrives 48 hours later. Before leaving the airport she obtains a PIR, photographs the tag and saves tracing updates. She buys modest toiletries, swimwear and two changes of clothing, keeping itemised receipts totalling EUR 142. Her written claim lists each purchase and explains the holiday context.
Her travelling companion's bag arrived normally, so his purchases are not added. If their flight itself arrived four hours late, Ella opens a separate EU261 assessment. Madrid is an EU departure and Evelop is an EU carrier, but fixed compensation depends on delay, distance and cause. The EUR 142 baggage loss does not increase or reduce a possible EUR 600 award.
If the package organiser provides emergency items or reimburses a receipt, Ella records that payment and does not claim the same sum again.
Identify the carrier and route without confusing legal regimes
Iberojet is used by Spanish Evelop (E9) and Portuguese Orbest (6O). The coupon's operated-by line identifies the carrier for the flight and baggage file. Codeshares or substitutions may require another carrier's process, so retain the original and revised itinerary.
Direction is vital for EU261 flight compensation, especially on third-country returns. Montreal baggage protection, however, has its own international-carriage framework. Do not promise or deny a baggage claim solely because an inbound flight falls inside or outside EU261. UK261 also does not set a fixed amount for a suitcase.
Send a complete written baggage demand.
Use the relevant Iberojet claim channel and retain every submitted field and attachment. Include passenger and flight details, operator, PIR, tag, delivery date, inventory, photographs, receipts, repair evidence and the total requested. For lost contents, explain purchase date, original value and depreciation rather than demanding replacement-new prices without proof.
If rejected, identify whether Iberojet disputes notice, deadline, causation, ownership, value or reasonableness. Answer that issue with targeted evidence. Package correspondence belongs in a parallel file, while Spanish or Portuguese escalation depends on the facts and competent forum.
Keep baggage damages separate from flight remedies.
EU261 fixed compensation addresses lost time after a qualifying delay, cancellation or denied boarding. Care covers support while waiting for the flight. Refund or rerouting deals with carriage. Package rights address the holiday contract. Montreal baggage damages compensate proven property loss. Separate totals prevent double recovery and make the claim reviewable.
