Iberojet cancelled flight: refund or rerouting

When Iberojet cancels, the immediate decision is not whether to claim EUR 600. It is whether the passenger wants reimbursement or alternative transport. That choice deals with completing—or unwinding—the journey. Care while waiting and possible fixed EU261 compensation remain separate. The position below reflects the law on 9 September 2026; the EU reform adopted in July 2026 has deferred application, so its future nine-month claim period is not current law.

Choose between reimbursement and rerouting
For a covered cancellation, Iberojet must offer a choice between reimbursement of the unused ticket, rerouting at the earliest opportunity under comparable conditions, or rerouting at a later date convenient to the passenger, subject to seat availability. If the journey has already begun but no longer serves its purpose, reimbursement can extend to used sectors and a return to the first departure point where relevant.
Do not accept a refund reflexively if the holiday still needs to happen. Once reimbursement is freely chosen, the airline usually does not also have to transport the passenger. Conversely, a passenger who accepts and uses a reroute cannot claim that same flown sector as unused.
Package travellers should contact the organiser as well. The organiser may rearrange the whole holiday, but that does not replace the operating airline's flight obligations.
Direction and operator decide whether EU261 applies
Iberojet is a brand used by Spanish Evelop and Portuguese Orbest. An E9/Evelop or 6O/Orbest departure from the EU can be covered. Because both operators are EU carriers, their own services from destinations such as Cancún or Punta Cana into the EU can also fall within EU261. Check the original operated-by line: an Iberojet logo, agency voucher or package name does not prove who was due to fly.
A mixed itinerary must be divided correctly. If another, non-EU airline operated a Caribbean-to-Europe sector under a marketing arrangement, arrival in the EU alone may not be enough. Passenger nationality, booking language and card currency do not change the territorial test.
Notice timing affects fixed compensation
Cancellation compensation is assessed separately from the transport choice. Broadly, no fixed award is due when the passenger was informed at least 14 days before departure. With shorter notice, Iberojet can still avoid the award if the offered rerouting fits the regulation's specified departure and arrival windows. Keep the timestamped email or message and both schedules.
An extraordinary circumstance may also defeat fixed compensation if the carrier proves the causal link and reasonable measures. It does not erase the choice of refund or rerouting, or the duty of care. “Operational reasons” is not, by itself, a factual explanation.
The fixed bands remain EUR 250, EUR 400 and EUR 600, determined by route distance and status. A long-haul cancellation is not automatically worth EUR 600: coverage, notice, replacement timing and cause all matter.
Care continues while replacement travel is pending
Passengers awaiting the earliest reroute are entitled to reasonable meals and refreshments in relation to the wait, communications, and hotel accommodation plus transfers where an overnight stay is necessary. If the desk is closed or Iberojet supplies nothing, buy reasonably rather than luxuriously and retain itemised receipts. A shared taxi or room is claimed once at its actual cost.
Care is not a substitute for compensation. Nor is a meal voucher necessarily settlement of the ticket choice. Record what was offered, what was declined and why. If the passenger selects a much later date for personal convenience, open-ended care is not necessarily available until that date.
Worked example: Lisbon cancellation before a package departure
Arun and Mei hold a Lisbon–Cancún package, with the flight coupon showing 6O and Orbest as operator. At 22:00 the night before departure, Iberojet cancels and offers a flight 36 hours later. They still want the holiday and select earliest rerouting rather than a refund. Because Lisbon is an EU departure and Orbest is the operator, EU261 applies subject to its conditions.
They retain the cancellation email, package voucher, e-ticket coupon, replacement passes and receipts for one airport hotel, meals and transfers. Their fixed compensation calculation is listed per passenger; the shared costs are not doubled. Separately, they ask the organiser about the lost hotel night and shortened package. Any price reduction must avoid duplicating a loss already reimbursed elsewhere.
If Iberojet later invokes airport closure, the couple should request dates, times and the effect on their rotation. Even if that defence succeeds against compensation, it does not retrospectively remove rerouting and reasonable care.
Submit a cancellation file that answers one question at a time.
Use the Iberojet claim form with the locator and surname. State the original flight, operator, notice time, chosen transport remedy and replacement arrival. Attach the original reservation before any reissue, then numbered proof of costs. Ask for fixed compensation in a separate paragraph.
If the response is incomplete, challenge the precise gap rather than resubmitting everything. Spanish or Portuguese enforcement routes depend on the relevant departure and event, not the travel agent's language. Preserve the confirmation number and a complete copy of the form.

Can I insist on rerouting instead of a refund?
For a covered cancellation, the regulation gives the passenger a choice, including earliest rerouting under comparable conditions. Availability and the facts still matter, so document inadequate offers before buying alternatives.
Does accepting rerouting prevent compensation?
No. Rerouting and fixed compensation are distinct. Notice, arrival timing, distance and extraordinary circumstances decide the separate compensation question.
Who handles a cancelled package flight?
The operating carrier handles EU261 flight duties, while the organiser handles package performance. Notify both and separate each loss to prevent double recovery.
Does an extraordinary circumstance remove hotel rights?
No. It may defeat fixed compensation, but reasonable care and the refund-or-rerouting choice remain separate obligations.
Is the July 2026 nine-month deadline already binding?
No. Application of that reform is deferred. As at 9 September 2026, it must not be described as the current EU261 deadline.
