Iberia, Iberia Express, Air Nostrum and codeshares: who is liable?

The airline shown beside “operated by” normally receives an EU261 or UK261 disruption claim. An IB flight number can be operated by Iberia, Iberia Express, Air Nostrum under the Iberia Regional brand, or an unrelated codeshare partner. These companies do not become one legal operator because the booking, check-in and loyalty experience look unified. Identify who supplied the aircraft and crew on the sector that caused the disruption; this can also decide whether a non-EU-origin flight is covered.

EU261 defines the operating air carrier by performance or intended performance under a contract with the passenger or on behalf of another contracting party. The Court of Justice in Wirth confirmed that a wet-lessor supplying aircraft and crew is not automatically the operator when another airline retains operational responsibility; facts and contractual performance matter.

Iberia and Iberia Express

Iberia Express is a separate Spanish airline within the Iberia Group. It operates short- and medium-haul services and may feed Iberia's long-haul network. Its passenger-rights notice identifies Iberia Express as the carrier and gives its own customer-service route.

If Iberia Express delays Dublin-Madrid and a one-ticket Iberia connection to Buenos Aires is missed, the claim should identify Iberia Express as operator of the causal feeder and state final arrival in Argentina. Sending only “Iberia flight IB…” can produce misrouting.

Air Nostrum and Iberia Regional

Air Nostrum operates regional services under the Iberia Regional franchise. The brand on the timetable can look like Iberia, while the operating line identifies Air Nostrum. Keep the boarding pass and e-ticket because regional routes and operators can change.

If Air Nostrum cancels a domestic feeder and it breaks a through journey, address the operational claim to Air Nostrum and describe the ticketed final destination. Iberia may still control reissue or ticket servicing, but that commercial role does not erase Air Nostrum's operator identity.

Codeshare partners

Iberia participates in oneworld and other codeshares. American Airlines, British Airways, Finnair, LATAM and other partners may sell or operate sectors under multiple codes. The carrier actually flying is the normal respondent.

Direction makes this especially important. An IB-marketed Miami-Madrid flight operated by American Airlines normally does not gain EU-carrier inbound coverage. Iberia operating the same route can qualify because Iberia is an EU carrier. The Latin America-Europe guide applies the same test to inbound routes.

Wet lease and last-minute substitution

An aircraft can display another company's livery or be supplied with crew under a wet lease. Do not infer liability from paint alone. Save the boarding pass, gate notice, safety card information and any message naming the company.

Ask who made the operational decision, assumed the carriage obligation and actually performed the flight. Wirth shows why “aircraft and crew” is a strong practical clue but not a complete answer in every wet-lease structure. If identity remains disputed, submit the same evidence to the plausible carriers and require each to state its role.

One disruption can involve two operators

Suppose Iberia Express operates London-Madrid late, and Iberia operates Madrid-Lima. On one booking, final arrival matters, but the causal feeder operator remains relevant. If instead Iberia cancels the long-haul sector after an on-time feeder, Iberia is the target.

Create a sector table with marketing code, operating carrier, scheduled time, actual event and effect on the final destination. This prevents a respondent from assessing only the sector it sold.

Ticket refund versus fixed compensation

An agency or ticket issuer may process a refund, while the operating airline handles fixed compensation. These are separate workflows. If a British Airways-issued ticket contains an Iberia-operated cancellation, BA may service the ticket but Iberia remains the normal EU261 respondent for its operation.

Write parallel, narrowly scoped requests when necessary. Do not let an airline refer every matter to the agent without distinguishing fare money from statutory operational liability.

Baggage uses a different carrier framework

The Montreal Convention distinguishes contracting and actual carriers and can permit baggage claims through different paths. Do not transfer the EU261 operator rule mechanically. Evidence checklist

Keep the full e-ticket, ticket number, booking confirmation, “operated by” line, all boarding passes, gate displays, disruption notices and replacement itinerary. For a codeshare, include both flight codes but name the operator first in the claim.

Use the Iberia claim form guide after resolving identity. If Iberia's form rejects the ticket because another group carrier operated, preserve the screen and use that carrier's official channel.

Rebooking can change the operator

The original cancelled flight and the replacement may have different operators. Liability for the original disruption follows the original operating arrangement; performance of the replacement should be recorded separately. A passenger rebooked from Iberia to British Airways does not normally redirect the cancellation claim to British Airways merely because BA completed the journey.

Keep both boarding passes and ticket reissue history. If the replacement itself suffers a new qualifying disruption, it may create a second event requiring its own operator and timing analysis. Do not automatically combine two distinct events or ask one carrier to answer for the other's operation.

At the airport, ask staff to print or write the operating carrier and involuntary rebooking reason. Mobile boarding passes can disappear after travel, so save them before departure. Where a lease or substitution is announced only at the gate, photograph the lawful display and retain the safety-card or crew announcement details without interfering with boarding.

FAQ

Is every IB flight operated by Iberia?

No. Iberia Express, Air Nostrum and codeshare partners can operate IB-marketed services.

Is Iberia Express the same legal airline as Iberia?

No. It is a separate operator within the group and has its own passenger-rights and customer-service materials.

Who pays after an Air Nostrum feeder causes a missed connection?

The claim normally identifies Air Nostrum as operator of the causal feeder and states final delay on the through booking.

Does an IB code make a non-EU partner an EU carrier?

No. Marketing does not transfer Iberia's EU status to the operating partner.

Does the same rule govern baggage?

Not exactly. Montreal Convention rules for contracting and actual carriers require a separate analysis.
