United Airlines schedule change or early flight: refund and compensation
A United schedule change can create a refund, rerouting or fixed-compensation claim, but the result depends on direction, size of the change, notice and whether the passenger travels. Under EU261, bringing a covered flight forward by more than one hour is treated as cancellation. US DOT uses different significant-change thresholds for a refund when the passenger rejects the new itinerary.

A United-operated Newark-Frankfurt flight normally has no EU261 fixed compensation because United is a non-EU carrier and the journey starts outside the EU. It can still have a DOT refund outcome. Frankfurt-Newark starts in the EU and can enter EU261 regardless of United's nationality.
More than one hour earlier under EU261
The Court of Justice held that moving a flight forward by more than one hour is a cancellation for Regulation 261. The change seriously affects how a passenger can use time and can cause the traveller to miss the flight.
Cancellation treatment does not automatically mean payment in every case. United may avoid the fixed amount if it proves timely notice, a compliant alternative or extraordinary circumstances. The passenger still has the cancellation choice between reimbursement and rerouting on a covered journey.
If the change is one hour or less, it is not treated as cancellation solely under that judgment. Other contractual or refund rights may still apply, especially if the entire itinerary changes materially.
The 14-day notice framework
For fixed EU261 or UK261 cancellation compensation, preserve when United communicated the schedule change:
- at least 14 days before departure generally removes the fixed cancellation amount;
- seven to 14 days requires testing the departure and arrival window of the offered alternative;
- fewer than seven days uses a tighter replacement window;
- the carrier bears the burden of proving when notice reached the passenger.
An email sent to an OTA but not passed to the traveller creates an evidence issue. Save agency correspondence and account notifications. The legal analysis can depend on who was authorized to receive notice and what was actually communicated.
DOT significant-change refunds
For flights to, from or within the United States, current DOT rules define significant changes that can trigger an automatic refund when the consumer does not accept the changed flight, rebooking, credit or other compensation. Examples include:
- domestic departure three or more hours earlier or arrival three or more hours later;
- international departure six or more hours earlier or arrival six or more hours later;
- changed origin or destination airport;
- more connections;
- involuntary downgrade;
- a less accessible connection or aircraft for a passenger with a disability.
These are refund rules, not a routine US fixed award for inconvenience. A five-hour earlier international United flight may be highly inconvenient but does not meet the DOT six-hour time threshold on that fact alone; another listed change or United's own fare terms may still matter.
If a directly purchased booking qualifies and the passenger rejects alternatives, DOT requires prompt refund to the original payment method. Accepting and using the revised flight normally removes a full unused-ticket refund.
When the airport changes
A move from one airport to another can alter transport time, visas, connections and cost. Under DOT it is a listed significant change. Under European rules, ask whether United cancelled the original flight, offered rerouting and owes transfer to the booked airport or another nearby destination agreed with you.
Preserve taxi, rail and parking consequences. Do not assume every additional cost is automatically recoverable; show why it was reasonable and caused by United's change.
Accept, reroute or refund?
Before choosing, compare final arrival, cabin, connections and the trip's remaining purpose. Ask United to correct the itinerary as involuntary rerouting instead of paying a voluntary fare difference.
If travel no longer serves its purpose, request cash reimbursement and list the unused sectors. If travel remains important, identify an earlier reasonable rerouting option. A voucher should be voluntary and its expiry, transferability and settlement wording should be clear.
Fixed compensation can coexist with rerouting or reimbursement when its separate tests are met. Do not describe the ticket price refund as the EUR 600 or GBP 520 award.
Evidence checklist

Example: Dublin to Chicago moved earlier
United moves a Dublin-Chicago departure two hours earlier five days before travel. The flight begins in the EU, and moving it forward by more than one hour is treated as cancellation under EU law. The passenger must then test the short-notice replacement window and cause. Reimbursement or rerouting remains a separate choice.
If United moves Chicago-Dublin five hours earlier, the United-operated US departure normally has no EU261 fixed claim and the time change alone is below DOT's six-hour international threshold. Contractual flexibility or another listed significant change may still provide a remedy.
