United Airlines Polaris and Premium Plus downgrade refunds
If United places you in a lower cabin on a flight covered by EU261 or UK261, the current reimbursement is 30%, 50% or 75% of the price attributable to the downgraded flight. You do not need to prove a three-hour delay or airline fault. A seat change, missing meal or loss of a paid extra within the same cabin is not automatically a statutory downgrade.

Marketing names do not replace the booked class of carriage. Keep the fare basis, cabin name and booking class shown on the e-ticket and boarding passes.
Current EU261 percentages
Article 10 currently requires reimbursement within seven days at these rates:
- 30% for flights of 1,500 kilometres or less;
- 50% for other intra-EU flights over 1,500 kilometres and other flights between 1,500 and 3,500 kilometres;
- 75% for flights outside those first two bands, including many Europe-US long-haul sectors.
UK261 uses 30%, 50% and 75% bands based on flight distance. A Heathrow-US downgrade will commonly fall in the 75% long-haul category if territorial scope is met.
Do not confuse the current seven-day reimbursement rule with the adopted EU reform's future procedure. Nor should it be confused with a future nine-month complaint-notification period. Current law applies until the new provisions become applicable.
Calculate only the downgraded flight
The Court of Justice's Mennens judgment says the base is the price of the particular flight on which the downgrade occurred, not automatically the total multi-flight ticket.
If the ticket does not show a sector price, the judgment permits allocation by the ratio between the downgraded flight's distance and total ticketed distance. Taxes and charges whose existence and amount do not depend on cabin are excluded from the percentage base.
Example: a Paris-Frankfurt-Newark ticket is downgraded only on Frankfurt-Newark. Apply the relevant percentage to the value attributable to Frankfurt-Newark, not the unaffected feeder. Ask United or the ticket issuer for a fare construction and explain any distance allocation used.
The result is not simply "75% of everything paid." Carrier-imposed fare elements, taxes, upgrade charges and miles can require separate treatment.
United-operated direction matters
A United departure from the EU, EEA, Switzerland or UK can fall within Article 10 regardless of United's US nationality. Frankfurt-Newark and Heathrow-Chicago are strong territorial examples.
A United-operated Newark-Frankfurt or Chicago-Heathrow flight normally falls outside EU261 or UK261 because it begins outside the protected territory and United is not an eligible inbound carrier. DOT still treats involuntary downgrade as a significant change: a passenger who rejects travel can obtain a refund, while one who travels should receive the difference between the original and lower fare.
Codeshare operation can change inbound scope. A UA-numbered US-Europe flight operated by Lufthansa is assessed as a Lufthansa flight. Read the original operated-by line.
Paid upgrades, PlusPoints and miles
A cash purchase of a confirmed United upgrade should be preserved as part of the economic evidence. Request both the statutory sector reimbursement where territorial rules apply and return of any separately paid upgrade value, without claiming the same sum twice.
For MileagePlus miles, PlusPoints or an award ticket, fixed delay or cancellation compensation can still apply because a ticket need not be bought entirely with cash. Downgrade valuation is less mechanical when the cabin entitlement came from miles or an instrument. Request restoration of the upgrade currency and ask United for the sector value used; do not promise a single universal cash base in a disputed award case.

A downgrade refund may coexist with a qualifying disruption claim. Test that second issue independently with the United flight compensation guide instead of adding the two calculations together without explanation.
Downgrade can coexist with another claim
Article 10 reimbursement addresses loss of cabin. A qualifying delay, cancellation or denied boarding addresses a different disruption. Both can be claimed if their independent conditions are met.
For example, United cancels a covered Polaris flight, reroutes the passenger in economy and delivers them five hours late. The passenger may have a cancellation/delay fixed claim, reasonable care expenses and a downgrade reimbursement for the replacement sector. Each should have its own calculation.
Do not classify ordinary dissatisfaction with a meal, lounge, Wi-Fi or seat location as a cabin downgrade. Seek refund of the specific unprovided ancillary fee or a contractual remedy.

- cabin and reservation class for each sector;
- operated-by entry;
- cash, miles or PlusPoints upgrade confirmation;
- ticket fare construction and tax breakdown;
- distance of each ticketed sector;
- written explanation of the involuntary change;
- any separate delay or cancellation evidence.
Create a table showing sector base, distance category, percentage and amount per passenger. Send downgrade reimbursement through United's refund channel; send disruption compensation and expenses through Customer Care as directed on United's site.
Example: Frankfurt-Newark in economy
A passenger buys Polaris for Frankfurt-Newark but United seats them in economy. The covered sector exceeds 3,500 kilometres, so the current EU261 rate is 75% of the price attributable to that flight, excluding class-independent taxes and charges. No delay or fault is required.
If only a Paris-Frankfurt feeder remains in business and Frankfurt-Newark is downgraded, the percentage applies to the long-haul sector value. It does not apply to the unaffected feeder.
FAQ
Is Polaris to Premium Plus a downgrade?
Yes. They are different cabins, so an involuntary move from Polaris business to Premium Plus is a downgrade.
Is Economy Plus to standard economy covered by Article 10?
Usually it is a seat or ancillary-service issue within the same economy cabin, not a statutory class downgrade.
Is the 75% calculated on my whole itinerary?
No. Mennens limits the base to the downgraded flight; a distance allocation may be used if its price is not separately shown.
Can I claim downgrade reimbursement and delay compensation?
Yes when each claim's separate conditions are met. Avoid duplicate recovery of the same fare element.
What happens to a PlusPoints upgrade?
Ask United to restore the upgrade instrument and provide its valuation. Statutory cash calculation can be disputed, especially when no sector cash price exists.
