United Airlines flight compensation: when EU261 or UK261 applies
United Airlines can owe fixed compensation when the affected journey begins in the EU, EEA, Switzerland or the United Kingdom. A separate United-operated flight beginning in the United States normally does not qualify for EU261 or UK261 simply because it lands in Europe. The last row is not a loophole for every domestic flight. It reflects a continuous booking that starts in the EU. A new ticket bought for a later US flight, or a return journey beginning in America, needs its own coverage test.
Four questions decide most United cases
1. Where did the protected journey begin?
EU261 applies to departures from an EU or EEA airport and is also reflected in the relevant passenger-rights framework for Switzerland. It applies regardless of United's US nationality. UK261 covers departures from UK airports on United in the same way.
Arrival in Europe is different. For a flight starting outside the protected territory, inbound coverage normally requires a qualifying European or UK operating carrier. United Airlines, Inc. is a US carrier. Therefore, a United-operated Newark-Dublin or Chicago-London sector usually fails the fixed-compensation scope test.
2. Who operated the disrupted sector?
The UA code identifies marketing, not necessarily operation. United sells codeshares operated by Lufthansa, SWISS, Austrian Airlines, Brussels Airlines and other partners. The confirmation and boarding pass should say operated by [airline]. That line can turn an inbound itinerary from an uncovered United case into a covered European-carrier case, or the reverse.
United Express also names a service brand rather than one single airline. A regional segment may be flown by a separate carrier. Preserve the operator name rather than assuming that every UA-numbered aircraft creates the same respondent.
3. What qualifying event occurred?
For an eligible route, fixed compensation may follow when:
- arrival at the final destination is at least three hours late;
- a cancellation was notified fewer than 14 days before departure and no timing exception applies;
- boarding was refused involuntarily despite valid documents and timely presentation; or
- a substantial move to an earlier flight is treated as cancellation under the applicable case law.
A five-hour departure delay creates a separate choice to abandon a covered trip and seek reimbursement. It is not the threshold for ordinary delay compensation.
4. Can United prove a valid extraordinary circumstance?
Severe weather, air-traffic-control restrictions, airport closure or a genuine security event can defeat fixed compensation when the event caused this disruption and could not have been avoided through reasonable measures. The label alone is insufficient. Routine technical defects and normal operational resourcing are not automatically extraordinary.
Care, rerouting and refund duties can survive even when extraordinary circumstances remove the fixed amount.

Distance and the structure of the protected journey determine the band. Most direct Europe-US services are over 3,500 km, but a long route does not guarantee the maximum. If rerouting reaches the destination within the statutory long-haul window, compensation can be reduced by half.
Payment is generally per eligible passenger. A family of four does not receive one EUR 600 award; it can have four individual claims where each traveller meets the conditions. Reward tickets can qualify too, provided they were issued to the public through a loyalty programme and were not genuinely free travel outside the regulation.
A connection inside the United States can still matter
The Court of Justice considered a single booking from Brussels through Newark to San Jose, operated by United. The decisive delay arose on the sector inside the United States, yet the journey was assessed as a whole because it began in the EU and had one reservation. The operating carrier could be liable under EU261.
That rule is especially valuable for passengers flying from Europe through Newark, Chicago, Washington Dulles, Houston, Denver or San Francisco to a final US city. What an uncovered passenger may still claim
No EU261 or UK261 fixed payment does not mean no remedy. For a United journey to, from or within the United States:
- US Department of Transportation rules can require a refund after cancellation or a significant change when the passenger rejects the alternative;
- involuntary denied boarding can trigger US oversales compensation;
- international baggage loss can fall under the Montreal Convention;
- an unprovided paid service can require a fee refund;
- United's current customer-service commitments may provide meals, hotel or transport for a controllable disruption.
These remedies have different triggers. A completed seven-hour United delay from Denver to London normally does not produce an automatic US cash award equivalent to GBP 520. Calling a refund "compensation" can obscure the stronger request actually available.

Evidence that makes the claim usable
Save the e-ticket receipt, six-character confirmation number, original schedule, boarding passes and every rebooking document. Capture the operated-by line for each sector. Record the time passengers were allowed to leave at the final destination, not merely touchdown.
Keep United emails, app messages and airport notices showing when a cancellation was communicated and what reason was given. For a connection, preserve the complete coupon sequence and the first itinerary displaying one booking. For expenses, retain itemised receipts and evidence that reasonable care was requested or unavailable.
The written claim should identify the governing regime, initial departure, final destination, operating carrier, length of final delay and amount sought. Ask United to identify the specific event and reasonable measures if it relies on extraordinary circumstances.
Two direction-sensitive examples
Dublin-Newark-Denver on one ticket: the United-operated trip starts in the EU. A routine aircraft fault at Newark causes a missed connection and arrival in Denver five hours late. EU261 can apply to the complete journey, with final delay measured in Denver.
Denver-Newark-Dublin on the return: the journey now begins in the United States and United operates it. A five-hour arrival delay in Dublin usually does not attract EU261 fixed compensation. Refund, care commitments or baggage rights may still matter, but the direction cannot be ignored.
FAQ
Does EU261 apply to United Airlines?
Yes, when the United journey departs the EU or EEA, and comparable territorial rules include relevant Swiss departures. United's US nationality does not remove protection from an outbound European flight.
Can United owe GBP 520 from Heathrow?
Yes. A United-operated flight leaving Heathrow can fall under UK261, subject to final delay, cancellation notice, cause and any permitted reduction after rerouting.
Is a United flight from the US to Europe covered?
