United Airlines from the US to Europe: when compensation is not due
A separate flight from the United States to Europe operated by United Airlines normally does not qualify for EU261 or UK261 fixed compensation. United is a US carrier, and arrival in Dublin, Frankfurt or London is not enough. Why the return direction changes the answer
EU261 covers departures from the EU/EEA on any carrier and inbound flights operated by an eligible EU carrier. United satisfies the first rule when leaving Europe but not the second when it operates from the US.
UK261 similarly covers departures from the UK on any carrier, while inbound scope normally requires a qualifying UK or EU operator. United's US licence means that its Washington Dulles-Heathrow service usually falls outside fixed UK compensation.
Outbound and return travel are treated as separate journeys. Buying Dublin-Newark-Dublin in one transaction does not carry EU261 from the first flight into the later return. Stopover and continuous-connection facts can be nuanced, but a normal return days later is not one directly connecting flight.
The operating-carrier rescue check
United markets flights operated by Lufthansa, SWISS, Austrian Airlines, Brussels Airlines and other partners. On a US-origin itinerary, that detail can be decisive. A UA-coded Newark-Frankfurt flight actually operated by Lufthansa can fall under EU261 because Lufthansa is an EU carrier.
The reverse is also true: an LH code on an aircraft operated by United does not make United European. Send the fixed-compensation claim to the airline that performed the flight, supported by the original ticket and boarding pass.
Regional United Express operation matters for later US sectors, but it does not change the nationality of the United-operated transatlantic leg. Identify each segment individually.
DOT refunds can be strong even without fixed compensation
US Department of Transportation rules generally require an automatic refund when United cancels or significantly changes a flight and the passenger rejects rebooking, travel credit or other alternative compensation. The current definition includes major time shifts, airport changes, extra connections and cabin downgrades in specified circumstances.
Refunds are generally due within seven business days for credit-card purchases and 20 calendar days for other forms of payment. They return the unused fare and eligible fees. A passenger who accepts and flies a replacement normally does not also receive a full refund for that used transportation.
DOT does not currently provide a general fixed cash award merely because a United flight arrived six hours late. Do not turn a refund right into a fictional EUR 600 delay claim.
US denied boarding protection
Involuntary bumping from an oversold flight has a separate federal compensation system. Eligibility and amount depend on ticket status, alternative arrival and one-way fare, with periodically adjusted maximums. Voluntary passengers negotiate their own benefit and usually give up the involuntary payment.
This can be valuable on a US-origin United flight even though EU261 and UK261 do not apply. Ask for the written denied-boarding notice and record whether you volunteered.
Baggage and unprovided-service claims
International baggage delay, loss or damage can be governed by the Montreal Convention. Report the problem before leaving the airport where possible, obtain a file reference and keep itemised purchase or repair evidence. Written deadlines differ for damage and delay.
DOT rules can also require refund of a checked-bag fee after a qualifying significant delivery delay and refund of an ancillary-service fee when the paid service was not provided. Those fee refunds do not replace proof-based compensation for the contents or consequences of a baggage loss.

Customer-service commitments and insurance
United's commitments may include rebooking, meals, hotel or ground transport for controllable cancellations and significant delays. Weather and ATC events can be treated differently. Check the current DOT dashboard and the written offer for the incident date.
Travel insurance or card protection may cover delay costs where no statutory care right exists. Notify the insurer promptly and avoid recovering the same receipt twice.
Goodwill miles or an electronic travel certificate may be offered. Read whether acceptance settles only service dissatisfaction or purports to resolve a legal claim.
Three examples
Newark-Dublin, five-hour completed delay: United operates from the US. No EU261 fixed award normally applies. A completed trip also does not trigger the automatic unused-ticket refund, though contractual assistance and expenses may remain relevant.
Chicago-Frankfurt cancelled: United cancels and the passenger rejects rebooking. DOT can require a cash refund. EUR 600 fixed cancellation compensation normally does not apply to this United-operated direction.
Newark-Zurich under a UA code, operated by SWISS: operator status changes the inbound analysis. EU-linked Swiss passenger-rights protection can apply; direct the claim to SWISS.
Evidence for the correct remedy
Keep the e-ticket, operated-by line, cancellation or delay notice, alternative offer, refund choice and all receipts. For baggage, save tags, the airport report, delivery date and written complaint. For denied boarding, obtain the written statement and alternate arrival details.
State the remedy accurately: "refund of unused transportation under DOT rules," "involuntary denied-boarding compensation," or "Montreal Convention baggage claim." Accuracy makes the request stronger than demanding an inapplicable European amount.

Does EU261 cover United flying from the US to the EU?
Normally not when United operates that separate inbound journey. An EU or qualifying Swiss operating carrier can change the result.
