EU261 denied boarding is broader than a classic ticket-sale oversell. Operational seat shortages can qualify where the passenger presented properly and there were no reasonable grounds to refuse carriage.
EU261 on United departures from Europe
United is a US airline, but any operating carrier can be covered when the flight leaves the EU, EEA or Switzerland. An involuntary denial on Dublin-Newark or Frankfurt-Chicago can therefore trigger EUR 250, 400 or 600 according to distance.
The passenger also chooses reimbursement or rerouting and receives care while waiting. If rerouting reaches the final destination within the statutory distance-based window, the carrier may reduce the fixed amount by 50%.
Extraordinary circumstances are not a general defence to denied boarding. Weather may explain why capacity changed, but United must still establish a legally reasonable ground if it refuses a passenger who was ready to travel.
UK261 on Heathrow departures
A United-operated Heathrow-US flight is within UK261 because it departs the UK. Current fixed bands are GBP 220, 350 or 520, with possible 50% reduction when alternative transport arrives within the relevant window.
Long-haul Heathrow-US denied boarding commonly starts at GBP 520 before any permitted reduction. It is not calculated from ticket price. Keep the new boarding pass and final arrival time.
The inbound United-operated US-Heathrow direction normally falls outside UK261 because United is neither a UK nor EU carrier. US DOT can still govern an oversold international departure from the United States.
Current US DOT formula
DOT protection applies to involuntary bumping from an oversold flight when eligibility conditions are met. For international flights departing the US, current minimum compensation is generally:
- no statutory payment where substitute transport arrives within one hour;
- 200% of the one-way fare, capped at USD 1,075, for arrival one to four hours late;
- 400% of the one-way fare, capped at USD 2,150, for arrival more than four hours late.
For domestic travel, the middle window is one to two hours and the higher tier begins over two hours. Current caps can change with inflation, so preserve the written statement United must provide at the airport.
DOT payment should normally be offered the same day, or within 24 hours if substitute transport departs before payment can be made. Airlines may offer more than the legal minimum.
When compensation may be refused lawfully
The passenger must normally hold a confirmed reservation, meet check-in and gate deadlines, and have valid travel documents. Safety, security, health and immigration grounds can justify refusal when accurate and reasonable.
Ask for the precise reason. A passport-validity error by the airline is different from genuinely missing authorization. A cabin baggage dispute or seat assignment issue should not silently be recoded as a voluntary no-show.
For a child or passenger needing assistance, preserve the special-service request and any communications. Discriminatory or accessibility issues can engage additional law beyond EU261, UK261 or DOT bumping rules.
What to obtain at the gate
- written reason for denied boarding;
- confirmation whether United classifies it as voluntary or involuntary;
- passenger check-in and gate timestamps;
- original seat and boarding pass, including any "seat request" notation;
- volunteer offer and final accepted terms;
- replacement itinerary and actual final arrival;
- meal, hotel and transfer vouchers or receipts;
- written rights statement and payment calculation.
If United asks for volunteers, photograph the offer board and ask whether compensation changes if no one accepts. A travel credit can be valuable, but check expiry, named-traveller restrictions, combining rules and whether accepting settles further claims.
Multiple passengers
Assess each passenger. A family of four involuntarily denied boarding on a covered long-haul departure can have four fixed claims, not one per booking. Children with confirmed paid travel are not automatically excluded.
If only one adult volunteers while others are involuntarily removed, keep separate records. Shared hotel or taxi expenses should not be multiplied, while statutory amounts are calculated per eligible passenger.

Example: Heathrow to Newark
A family checks in on time for United's Heathrow-Newark flight. No one volunteers, and United involuntarily removes two passengers because seats are unavailable. They arrive the next day. UK261 can support GBP 520 for each eligible removed passenger, plus rerouting and care, subject to any lawful reduction based on replacement arrival.
On Newark-Heathrow, the United-operated departure normally uses DOT rather than UK261. The amount depends on one-way fare and replacement delay, not GBP 520.

Is accepting a voucher the same as involuntary denied boarding?
Not if you knowingly volunteer under agreed terms. Preserve the agreement because statutory involuntary compensation may no longer apply.
Can United blame weather for overbooking?
Weather is not a blanket denied-boarding defence. United must establish a reasonable ground for refusing the particular passenger.
