United Airlines flights from Europe: when EU261 applies
United Airlines is a US carrier, but EU261 applies to its eligible flights departing the EU or EEA. Relevant Swiss departures are protected through the applicable Swiss framework. A long-haul United delay, short-notice cancellation or involuntary denied boarding from Europe can therefore produce up to EUR 600 per passenger.

A return booking contains at least two legal directions. The covered Frankfurt-Chicago outbound does not automatically export EU261 to the later Chicago-Frankfurt return operated by United.
Which departure territories matter?
The regulation applies from EU Member State airports and extends through the EEA framework to Norway and Iceland. Switzerland has its own incorporation of the passenger-rights regime. Use the specific departure country when identifying enforcement and court options rather than casually calling every location "the EU."
United's US nationality matters mainly on inbound travel. A non-EU carrier is covered on departure from the protected territory, but normally not on a flight from a third country into that territory.
The passenger's nationality, residence and place of purchase are not substitutes for route scope. An American resident departing Dublin can claim; an Irish resident departing Newark on United usually cannot invoke EU261 for that reason alone.
Connecting travel remains one journey when booked together
Suppose United sells Amsterdam-Washington Dulles-Orlando as one directly connecting itinerary. EU261 scope is assessed from Amsterdam to Orlando. If the first delay causes a missed connection, measure arrival in Orlando. If the second sector alone creates the decisive delay, the journey can still remain protected.
C-561/20 involved United itself. Passengers booked Brussels-Newark-San Jose as one reservation with Lufthansa, and United operated the journey. The Court treated the connection as a whole despite the later sector running entirely inside the United States.
This principle requires one reservation and direct connection. A long stopover that breaks the journey, a separately purchased domestic flight or a new itinerary after arrival needs individual analysis. Read the United C-561/20 guide before relying on the judgment.
Events that can produce compensation
For a covered United departure, fixed compensation can follow when:
- final arrival is at least three hours late;
- cancellation notice is received fewer than 14 days before travel and no replacement-timing exception applies;
- boarding is refused involuntarily despite timely presentation and valid documents;
- substantial advance of the departure is treated as cancellation.
United can defend a fixed claim by proving extraordinary circumstances and reasonable measures. Airport closure or ATC restriction may qualify. An ordinary mechanical defect, aircraft rotation problem or generic "operational reasons" response does not automatically do so.
EUR 250, EUR 400 or EUR 600
Distance from initial departure to final destination determines the category for a connected journey. Most Europe-US itineraries exceed 3,500 km and can reach EUR 600. A three-to-four-hour long-haul arrival can permit a reduction to EUR 300 in relevant circumstances.
The amount is generally per traveller, not per booking. A reward ticket can qualify when issued through a public frequent-flyer programme. The fixed award is independent of fare price; a discounted Economy passenger and a Polaris passenger normally use the same route band.

Rerouting, reimbursement and care
Cancellation creates a choice between reimbursement and rerouting. A departure delay of at least five hours can let the passenger abandon the covered trip and seek reimbursement. While waiting, United must provide proportionate meals, communications and, when necessary, hotel and transport.
These rights do not depend on United accepting fault. Care can remain payable during severe weather. Fixed compensation addresses a different question and can coexist with rerouting or reasonable expense reimbursement.
If United does not offer an adequate route, ask it to check realistic Star Alliance alternatives. Document available seats and the refusal before self-booking.
The operating carrier remains important
United may sell a UA-coded flight operated by Lufthansa, SWISS, Austrian Airlines or Brussels Airlines. EU261 liability generally follows the airline operating the disrupted flight. For a departure from Europe, both United and an EU operator can fall within scope, but the correct respondent still matters.
On the inbound return, the operator can change coverage entirely. Newark-Frankfurt operated by Lufthansa can be covered; the same route operated by United normally is not. Preserve the original operated-by line, since later rebooking can replace it.
United Express regional legs can introduce another operating company. Identify it when the claim concerns that sector, especially after a connection inside the US.
Filing and escalation
Send the first claim through United Customer Care. Include route scope, final delay, legal event, amount and evidence. Keep the submission reference and a PDF or screenshot of the completed form.
If the response is unsatisfactory, the next step depends on where the incident occurred and the purpose of the process. A national enforcement body can supervise compliance but may not collect an individual award. The European Consumer Centre may help eligible cross-border consumers, while court jurisdiction and limitation periods depend on the itinerary and national law.
Do not present the adopted 2026 EU reform's future nine-month notification process as current. As at 14 August 2026, existing national limitation rules still require case-specific analysis; the new framework applies only after its formal timetable following Official Journal publication.
Example: Dublin-Newark-St Louis
United operates both sectors on one booking. A routine technical issue in Newark makes the passenger miss the connection, and final arrival in St Louis is five hours late. The trip began in Ireland, so EU261 can cover the connected journey. If United cannot prove an exception, EUR 600 may be due.
The later St Louis-Newark-Dublin return starts in the United States. The same operator and delay do not produce the same scope result. The return is normally outside fixed EU261 compensation.

Is United covered by EU261 when departing Europe?
Yes. Any operating airline can be covered on departure from an EU or EEA airport; relevant Swiss departures have comparable protection.
Does EU261 follow me onto a United domestic connection?
It can when the domestic sector is part of one directly connecting booking that began in Europe. Separate US tickets are not automatically included.
Is a United return from the US covered because the outbound was?
Normally no. Outbound and return journeys are assessed separately, even when sold under one confirmation number.
Can United avoid payment by saying it is a US airline?
