First test the direction of the flight

Tunisair is a Tunisian carrier. It is not an EU or UK airline. EC261 can cover its European departures. A direct Tunisia-to-Europe flight is normally outside EC261.

UK261 uses a similar direction test. A UK departure can be protected. A direct Tunisair return from Tunisia normally is not.

Nationality and payment currency do not alter the test. Examine each direction separately. A protected outbound does not protect the return automatically.

After scope, examine the event, arrival delay, distance and cause. A covered flight still needs all other conditions.

Identify a cabin change, then isolate its sector price

A move from Business to Economy is a downgrade. A different seat within Economy, loss of extra legroom or missing meal is normally a paid-service issue instead. Preserve the booked cabin, booking class and boarding pass after reaccommodation.

The percentage depends on the flight distance and statutory category. Apply it only to the sector actually downgraded, following the Mennens approach. Do not automatically multiply the entire return-ticket price when one leg changed cabin.

If the ticket does not allocate a sector price, a proportion based on relevant flight distance may be needed. Taxes independent of cabin class are generally outside the refund base. Ask Tunisair for a fare and tax breakdown before estimating.

An award ticket or paid upgrade can make valuation disputed, but statutory protection should not be dismissed solely because miles were used. Separate cash taxes, miles, upgrade value and the cabin actually delivered.

Worked example

A passenger books Business from an EU airport to Tunis and Tunisair carries them in Economy. The covered departure can trigger the Article 10 percentage for that segment. If only a later Tunisia-origin sector was downgraded, the territorial answer may differ because Tunisair is non-EU.

EC261 normally uses great-circle distance. A protected through booking uses its final destination. Timely rerouting can sometimes reduce a fixed payment.

Extraordinary events may remove only the fixed payment. They do not erase every duty. Tunisair must prove the event, causal link and reasonable measures.

Common mistakes to avoid

A Tunisair code does not prove who operated the flight. Check the operated-by line. Test the EU outbound and Tunisia return separately. Accept a voucher only by informed choice.

Keep baggage, refund, care and fixed payment amounts separate. Each has its own basis. Calculate the request rather than sending one unexplained total.

The EU reform approved in July 2026 is not yet applied on the checked date. Its future nine-month claim rule is not a current deadline. Nor is its 30-day reply rule. Existing law and national limitation rules still govern.

FAQ

Is a seat change a downgrade?

Not by itself. A downgrade means carriage in a lower cabin class than purchased, not merely a different seat.

Which ticket price receives the percentage?

Use the price attributable to the downgraded sector. If unavailable, a defensible distance proportion may be needed.

Are taxes included?

Taxes and fees independent of cabin class are generally excluded from the Article 10 percentage base.

Can downgrade and delay claims coexist?

Yes. They have separate conditions, so a qualifying arrival delay can support an additional fixed payment.

What about an upgrade paid with miles?

Preserve the award statement and delivered cabin. Valuation may be disputed, but the claim should distinguish miles, cash and taxes.
