TUI and EU261: which flights are covered?

EU261 does not cover a booking simply because it was sold by TUI, paid in euros or carried an EU flight number. Coverage follows the departure airport and the airline actually operating the aircraft. In a group containing British and EU airlines, that check must be made for each direction of travel.

This guide uses the law in force on 9 September 2026. The EU reform adopted in July 2026 has deferred application, so its future nine-month claim deadline is not the rule today.

Map the five TUI airlines correctly

TUI Group identifies five airline businesses. TUI Airways is based in the United Kingdom and is relevant to UK261. TUI fly Germany, TUI fly Belgium, TUI fly Netherlands and TUI fly Nordic are EU carriers and can satisfy EU261's community-carrier limb on qualifying inbound flights.

The flight number can be a clue: BY, X3, TB, OR and 6B are associated with different group airlines. It is not conclusive where codeshares or operational substitutions occur. Use the “operated by” field on the final itinerary, airport display and boarding pass.

The tour organiser, travel agent and operating carrier can all be different companies. The operator answers the statutory flight claim. The organiser answers separate questions about performance of a package.

Apply EU261 by direction, not round trip

Any flight departing an EU airport is potentially covered by EU261 regardless of where the airline is established. Thus Brussels–Sharm el-Sheikh is within territorial scope whether TUI fly Belgium or an Egyptian airline operates it.

For a flight departing outside the EU and landing inside it, EU261 normally requires an EU operating carrier. Sharm el-Sheikh–Brussels operated by TUI fly Belgium can qualify; the same route operated by a non-EU airline generally does not. A return booking is not treated as one undivided departure merely because it has one PNR.

Connections require care. On one booking, the first departure and final destination can define the protected journey, while operator issues may turn on the disrupted sector. Separate tickets ordinarily create separate assessments. Record every sector rather than summarising the route as “Egypt to Europe”.

Keep UK261 on its own track

UK261 covers departures from the UK and can cover inbound services operated by a UK carrier. A Cardiff–Palma flight is therefore potentially covered regardless of operator. Palma–Cardiff operated by TUI Airways is potentially covered because the operator is British; an EU airline's inbound flight requires careful consideration of the UK territorial rule and overlap, not an assumption that EU261 follows it everywhere.

Currency reveals which calculation may apply but does not establish coverage. UK261 uses GBP 220, 350 and 520 bands; EU261 uses EUR 250, 400 and 600. Do the territorial analysis first, then select distance and amount. Where regimes might overlap, a passenger cannot obtain duplicate fixed awards for the same disruption.

Residence, citizenship, package law and the website used to book do not change the flight's first airport or the operator's licence.

Work through a mixed-booking example

Ethan buys a TUI package from Dublin to Montego Bay. The outbound is operated by TUI fly Netherlands after an aircraft substitution; the return is operated by a Jamaican partner. The Dublin departure is within EU261 whoever operates it. The Montego Bay departure is not brought within EU261 merely because the trip began in Dublin or TUI sold the package; its actual non-EU operator makes the return normally fall outside EU261.

If TUI fly Netherlands had operated the return, EU261 could apply because an EU carrier would be flying into the EU. If TUI Airways operated it to Manchester, UK261 rather than EU261 would be the principal route analysis. The example shows why copying the outbound answer to the return can produce a false promise.

Once coverage is established, qualification still depends on the event. A delay generally needs a three-hour final-arrival threshold; cancellation claims examine notice and alternatives; extraordinary circumstances may defeat only the fixed award. Refund or rerouting and care are separate.

Prove territorial scope in the claim

Attach the original confirmation showing airports, all coupons, the operated-by line and any substitution notice. Put a compact statement at the top: “Flight TB___ departed Brussels and was operated by TUI fly Belgium.” That lets the handler see why EU261 applies before considering time or cause.

Send the claim to the operator. TUI's UK delay form expressly deals with TUI Airways customers and directs passengers flying another carrier to that airline. TUI Airways unresolved claims may proceed to AviationADR; EU cases use the relevant operator's process and competent national body.

Keep compensation, reimbursement or rerouting, care receipts, package remedies and Montreal baggage loss in separate schedules. Territorial coverage for one remedy does not turn every holiday loss into the same statutory payment.

Frequently asked questions

Is every TUI flight covered by EU261?

No. TUI is a group brand. Departure direction and the operating airline must satisfy the regulation's territorial rules.

Is a return to the EU covered because the outbound left the EU?

Not automatically. Each direction is tested separately. An inbound departure outside the EU normally needs an EU operating carrier.

Does a BY flight number mean EU261 applies?

No. BY is associated with British TUI Airways. Check the actual operator and route; a code alone does not decide the regime.

Can UK261 and EU261 both pay for the same flight?

Overlapping facts require careful analysis, but passengers cannot recover duplicate fixed compensation for the same disruption.

Do package-holiday rights prove EU261 coverage?

No. Package protection may create rights against the organiser, while EU261 coverage remains a route-and-operating-carrier question.
