Oman Air passenger rights under Oman Regulation 757/2024

Oman Passenger Rights Protection Regulation 757/2024 protects departures from Oman and certain Oman Air arrivals into Oman. It provides distance-based OMR compensation for protected international cancellation and denied boarding, compensation after delay exceeding six hours, care during disruption, cabin-downgrade remedies and an airline-to-CAA complaint route. It is a separate legal system, not an OMR version of EU261.

The regulation took effect after publication in 2024. This guide reflects its official English text available on 14 August 2026. For an EU or UK departure, apply the European or British rules first rather than replacing them with Oman thresholds.

Which journeys fall within Article 2?

The regulation covers all flights departing airports in the Sultanate of Oman. It also covers flights arriving in Oman on a national carrier unless passengers have already received compensation or assistance under the laws of the departure country. Frequent-flyer travel is included.

This design prevents simple double compensation. Preserve what another carrier or authority already paid, because “not already compensated or assisted” is part of the inbound national-carrier test.

Delay and cancellation payments

A covered international cancellation notified less than 14 days before travel uses OMR 108 up to 1,500 km, OMR 173 above 1,500 and up to 3,500 km, and OMR 260 above 3,500 km. An alternative arriving within two hours can remove payment. Rerouting within distance-based windows of three, four or five hours can halve it.

Delay shorter than six hours gives care and preserves Montreal Convention damage rights. When delay exceeds six hours, Article 24 applies cancellation compensation. Do not round exactly six hours to “more than six.”

If Oman Air proves force majeure, Article 42 can exclude fixed compensation. The annex lists war, unlawful acts, sabotage, security threats, severe weather, airport closure, medical emergencies, bird strikes, hidden manufacturing defects and specified unexpected safety faults, among other events. Proof and causation remain necessary.

Care during a wait

Articles 38-39 create a clear timetable:

If required care is not provided, the regulation specifies 10 SDR for refreshments, 30 SDR for a meal and 100 SDR for accommodation plus transport. In force-majeure situations, the carrier may limit hotel provision to three nights.

Care and fixed compensation are distinct. A passenger can require food during a wait even if the cause later proves to be force majeure. Record requests and retain itemised purchases.

Denied boarding and overbooking

The carrier should first seek volunteers. A volunteer should understand the agreed benefit and rerouting before surrendering an involuntary claim. For an involuntary refusal, an alternative arriving less than two hours late can mean care without fixed payment. Arrival between two and six hours can trigger 50% of the unused-sector value, while a delay above six hours moves to cancellation compensation.

The passenger should keep check-in evidence and request written confirmation that boarding was denied for capacity reasons. Health, safety, security or missing travel documents can justify refusal and are not ordinary overbooking.

Downgrade formula

Article 34 uses a distinctive remedy when a passenger is placed in a lower cabin. Oman Air should return the difference between the paid fare and the lowest reservation booking designator in the lower class for that flight, plus 50% of that difference. If the passenger terminates unused travel, the provision uses unused fare plus 50%.

This is not the EU261 30/50/75% formula. Keep the original ticket, booked cabin, flown cabin, booking class, fare breakdown and any paid upgrade record. The downgrade guide gives worked examples.

Payment timing and method

Article 40 lets the passenger choose cash, bank transfer, bank draft or a travel voucher. Payment should be made within no more than 14 business days after the carrier acknowledges the right to compensation. The acknowledgement condition matters: a disputed case does not automatically mature merely because a form was submitted.

Read vouchers carefully. A passenger seeking money should state the selected method and avoid signing a full settlement unless every remedy is included.

Complaints and the official timing inconsistency

Article 44 says a carrier must decide a complaint within 15 working days, and silence is treated as rejection. It allows a passenger to complain to the Oman Civil Aviation Authority within 60 working days after rejection.

The current Oman CAA public FAQ instead says a passenger should complain to the airline in writing, allow a written response within 30 days, then approach the Authority with the complaint and supporting documents. These official statements do not use the same period.

The prudent response is to save the airline submission, acknowledgement and every response; cite Article 44; and consult the current CAA portal before escalation. Do not promise that the Authority will accept a case on one pre-calculated day. The Oman CAA escalation guide provides a document list.

Two-year limit and international claims

Article 45 says claims and complaints under the regulation cannot be heard after two years from the incident. Submit much earlier. Baggage notice windows can be far shorter, and Montreal Convention court actions have their own two-year rule.

The regulation's baggage text uses 1,288 SDR, but ICAO revised the Montreal Convention international baggage limit to 1,519 SDR per passenger from 28 December 2024. The ceiling is not an automatic award; actual proven loss remains central.

FAQ

Does Oman Regulation 757/2024 cover all Oman Air flights?

No. It clearly covers Oman departures and conditionally covers national-carrier arrivals. Departure-country rights can take priority for inbound travel.

When does an Oman delay earn fixed compensation?

The covered delay must exceed six hours before Article 24 points to cancellation compensation.

How quickly must Oman Air pay an accepted amount?

Article 40 sets a maximum of 14 business days after the carrier acknowledges entitlement.

Is the complaint response period 15 or 30 days?

The regulation says 15 working days, while the current CAA FAQ says written response within 30 days. Preserve proof and check current filing guidance.

What is the Oman claim limit?

Article 45 states two years from the incident for claims and complaints under the regulation, but shorter notice periods can govern particular losses.
