Oman Air compensation deadlines: Europe, UK, Oman and baggage

There is no single filing deadline for every Oman Air claim. Regulation 757/2024 sets a two-year limit for claims and complaints under Omani passenger rules. EU261 time limits depend on the national law and court forum connected to the journey. UK court claims generally use a six-year period in England, Wales and Northern Ireland and five years in Scotland. Baggage requires written notice within days even though a Montreal Convention court action has a two-year limit.

The nine-month notification period in the adopted future EU reform was not yet the applicable rule on 14 August 2026. Do not present it as current law or use it to shorten an existing national limitation period before the reform applies.

Oman passenger-rights time limits

Article 45 says claims and complaints under Regulation 757/2024 are not heard after two years from the incident. Treat that as an outer boundary, not a target filing date.

Article 44 separately gives 60 working days after carrier rejection to complain to the competent authority. Missing that shorter escalation period can matter even though the general two-year period remains open for other action.

The airline response timetable is officially inconsistent. Article 44 says Oman Air must decide within 15 working days and treats silence as rejection. The current Oman CAA FAQ describes a written response within 30 days before a CAA complaint. Save both the submission and any follow-up, then check the live portal rather than waiting passively.

EU261 has national limitation periods

EU261 establishes the right but does not create one uniform deadline for court actions. The Court of Justice has held that national limitation rules apply, subject to EU principles. The departure country, place of performance, contract and court jurisdiction can all affect which period governs.

A Paris-origin Oman Air claim may involve French limitation analysis. Frankfurt or Munich departures can involve German rules. Milan departures can involve Italian procedure. Do not state that “the airport always decides” because jurisdiction can be more complex, especially with connecting bookings and agency sales.

Send the airline claim quickly and record the date. An airline complaint may not automatically suspend or interrupt a court limitation period in every country. Obtain local legal advice where the deadline is close.

UK261 periods

UK passenger-rights actions commonly use six years in England, Wales and Northern Ireland, while Scotland generally uses five years. These are not invitations to wait. ADR schemes, complaints and evidence retention can have shorter practical requirements.

Begin with Oman Air, preserve the complaint and check the current UK CAA process. If litigation is contemplated, confirm jurisdiction and the precise accrual date. A Scottish connection does not automatically make every claim five years; forum analysis remains necessary.

Baggage notice is much shorter

Oman Air's Conditions of Carriage reflect Montreal Convention notice periods: written complaint within seven days for damaged baggage and within 21 days for delayed baggage. Report at the airport immediately, obtain a Property Irregularity Report and then send the written claim with valuation and receipts.

A PIR is important but may not replace the formal written complaint. Do both. If luggage has not arrived after 21 days, it is generally treated as lost for claim handling.

The current Montreal Convention liability ceiling for international baggage is 1,519 SDR per passenger from 28 December 2024. The two-year action limit does not extend the seven or 21-day written notice. See the baggage guide.

Passenger delay damages under Montreal

The Convention can cover proven financial damage caused by delay, subject to defences and a current passenger-delay limit of 6,303 SDR. It does not award that ceiling automatically. A claimant must prove loss, causation and reasonableness.

Court action is extinguished if not brought within two years, calculated under Article 35 from arrival at destination, the date the aircraft ought to have arrived, or the date carriage stopped. A complaint email alone may not preserve the action in every forum.

Build a deadline record

Create a table with incident date, airline claim submission, acknowledgement, response, CAA or ADR filing and any legal deadline advice. Keep the original email headers or portal receipts.

If Oman Air argues lateness, ask it to identify the legal source, governing forum, start date and any alleged contractual term. Compare that answer with the route and remedy. A two-year Omani provision should not automatically shorten a valid EU261 court period in another jurisdiction, and a longer EU period should not erase Oman Article 44's 60-working-day authority window.

Tickets issued by agents

Do not assume correspondence with an OTA counts as a compensation claim to the operating carrier. Send Oman Air a direct statutory complaint and retain the agent ticket-refund case separately.

FAQ

Is the Oman Air compensation deadline always two years?

No. Two years governs Regulation 757/2024 claims, while EU261, UK261 and baggage procedures have different periods.

How long do I have to complain to the Oman CAA?

Article 44 states 60 working days after rejection, subject to the Authority's current procedural instructions.

Is nine months already the EU261 deadline?

No. The adopted reform's nine-month notification rule was not yet applicable on 14 August 2026.

Does emailing Oman Air stop a court deadline?

Not necessarily. Suspension or interruption depends on governing national law and procedure, so verify it where time is short.

Can I wait two years to report damaged baggage?

No. Written damage notice is generally due within seven days, with delayed baggage notice within 21 days.
