Neos codeshare: identify the operating carrier

The airline that sold the seat is not necessarily the airline responsible for flight performance. On a codeshare, charter or substituted aircraft, start with the words “operated by”. The NO code normally identifies Neos, but a tour operator, agency and marketing carrier can all appear on the same holiday paperwork without operating the aircraft.

This distinction can decide territorial coverage as well as the claim's addressee. The law here is stated at 9 September 2026; the July 2026 EU reform has deferred application, so its future nine-month claim period is not current law.
Find the operator in the original record
Preserve the first e-ticket or charter voucher before an app overwrites it. Compare the flight coupon, boarding pass, check-in page, airport display and disruption notice. Record the aircraft operator named for the affected sector, not merely the ticket stock or loyalty programme.
When the evidence conflicts, ask the seller or airline to identify the carrier that performed or intended to perform the flight. A last-minute wet lease needs careful treatment; do not infer responsibility from livery alone.
Why operator status changes inbound coverage
Every flight leaving the EU can enter EU261's territorial gateway regardless of carrier nationality. For a flight beginning in a third country and landing in the EU, the operating carrier must be an EU carrier. Neos is Italian, so its own inbound operation can qualify. A non-EU partner operating the same return may not.
Split round trips into directions. One PNR, euro payment or European passenger cannot turn a non-covered inbound operation into a covered one. A UK departure can engage UK261, but an inbound UK journey has its own carrier conditions; do not promise both regimes without mapping the route.
Marketing airline, organiser and operator have separate jobs
The marketing airline sells a coded service. The organiser combines travel services and may owe package remedies. The operating carrier performs the flight and is central to EU261 duties. Neos may direct agency customers back to the seller for booking changes while remaining the relevant operator for a Neos-operated disruption.
Send package issues such as lost accommodation to the organiser and flight-performance claims to the carrier. Keep amounts separate so the same night or transfer is not recovered twice.
Worked example: a substitute on the Cancún return
Eva's voucher shows a Neos-branded Milan–Cancún holiday. Neos operates the outbound, but a non-EU partner operates Cancún–Milan after a schedule change. The return arrives four hours late. Because that direction begins outside the EU, the substitute's status matters; the Neos branding and Italian destination are not enough on their own.
If Neos had operated the return, its EU-carrier status could bring it within EU261. Eva should direct any package complaint to the organiser and preserve the substitution notice rather than claiming against every name on the voucher.
Apply the correct remedy after identification
Once operator and coverage are settled, test final-arrival delay, cancellation notice, distance and cause. Fixed compensation may be EUR 250, EUR 400 or EUR 600. Refund or rerouting, care during the wait and Montreal baggage damages remain distinct.
An extraordinary-circumstances defence must identify the event, link it to the flight and address reasonable measures. Even a successful defence does not automatically erase care. On one protected connection, final arrival may control; separate tickets usually retain separate endpoints.
List each sector, flight number, marketing code, operating carrier, ticket number and direction. Attach the document proving each entry. State the remedy sought from that party and remove unrelated package correspondence.
This map is especially valuable after disruption, when an app may display only the replacement. Keep both versions. Note whether the named carrier merely sold the seat, intended to operate the original flight, actually operated the substitute, or provided ground handling. Those roles should not be collapsed into a single brand name.
Once the proper carrier is identified, calculate each remedy independently. A qualifying fixed award belongs to each passenger, whereas one shared hotel or taxi remains one actual expense. A refund applies to unused carriage when chosen; it is not an additional award for a sector already flown. Baggage loss is supported by tags and a timely Montreal demand.
If rejected, challenge the operator finding with primary records. ENAC and conciliation channels have different roles and do not automatically pay a claim. Preserve filing dates; the deferred future deadline does not replace current limitation analysis.
