Lufthansa weather and ATC disruption: test causation and mitigation

Short answer: severe weather, air-traffic-control restrictions and airspace closures can be extraordinary circumstances, but the category alone does not decide a Lufthansa claim. The airline must show the precise event, its causal effect on the passenger's flight and why reasonable measures could not avoid the qualifying delay or cancellation.

Forecasts and actual restrictions are different. Rain, snow or wind shown by a weather app does not by itself prove that operating the flight was unsafe.

When weather can be extraordinary

Meteorological conditions incompatible with operating the flight are expressly recognised by EU261 as a possible extraordinary circumstance. Examples can include a closed runway, visibility below operational minima, freezing rain, a severe thunderstorm cell or wind beyond safe limits.

The threshold is flight-specific. The same storm can affect aircraft differently because of location, timing, runway, equipment and crew qualifications. Another departure operating nearby is useful context but does not conclusively prove Lufthansa could fly.

At Frankfurt or Munich, snow may trigger airport-wide capacity restrictions while Lufthansa also needs to de-ice aircraft. The underlying weather can be external. Yet ordinary winter preparation, staffing and the timing of recovery measures remain open to examination.

ATC restrictions and airspace decisions

Air-traffic management decisions affecting a particular aircraft on a particular day are named in the regulation's recitals as events that may be extraordinary. Slot restrictions, sector closures and instructions to hold or divert can therefore defeat fixed compensation when properly evidenced.

An ATC code is not enough on its own. Ask which authority issued the measure, when it applied and how many minutes it assigned. If the flight was already late for a technical or crew reason before the restriction, Lufthansa should divide the causal timeline rather than attributing the whole delay to ATC.

Airspace closures may force long diversions or cancellations. The carrier should still examine routing around the affected area and seats on alternative services. Reasonable measures do not require unsafe operation, but they do require an active response.

The incoming-aircraft problem

Lufthansa may say that weather affected the aircraft on an earlier sector. EU law can recognise an extraordinary event from a previous flight when there is a direct causal link to the later disruption. That does not permit an unlimited chain through a day's schedule.

Request the aircraft registration, preceding route, event time and recovery steps. Consider whether Lufthansa could swap aircraft, reroute passengers or reposition crew once the knock-on risk became clear.

Example: fog delays an incoming aircraft to Frankfurt by two hours. It then waits another four hours for a replacement crew. Lufthansa should explain which part remained an unavoidable consequence of fog and which arose from crew recovery.

Example: Munich closes a runway during intense snow and all comparable departures are restricted. The flight leaves as soon as the airport restores capacity. Fixed compensation may be excluded, while meals and overnight support can still be due.

Reasonable measures are a separate defence

Proving extraordinary weather or ATC action is only the first limb. Lufthansa must also show that the disruption could not have been avoided even if all reasonable measures had been taken.

Relevant options depend on circumstances:

  • rerouting through another connection airport;
  • transferring passengers to another carrier;
  • using rail for a suitable German domestic sector;
  • allocating available aircraft and crews coherently;
  • rebooking before the passenger misses a protected onward flight;
  • arranging transport from an alternate arrival airport.

The law does not impose an unlimited financial or operational sacrifice. Focus on realistic seats and routes available at the time, not hypothetical capacity discovered weeks later.

Fixed compensation test

For delay, measure arrival at the ticketed final destination. The first aircraft door must open at least three hours after schedule under the EU rule. A short delay into Frankfurt that causes a protected missed connection can qualify when the passenger reaches the final city much later.

For cancellation, check the notice date and replacement timing before reaching the extraordinary-circumstances issue. A late cancellation caused by proven severe weather can remove the fixed sum but not the passenger's transport choices.

EU261 amounts are EUR 250, EUR 400 and EUR 600. UK261 amounts are GBP 220, GBP 350 and GBP 520, with a GBP 260 amount for certain long-distance delays below four hours. The coverage guide helps select the regime.

Care, refund and rerouting

The right to meals, communication, hotel and hotel transfer generally survives an extraordinary event. Keep receipts when Lufthansa's digital vouchers or desk assistance do not cover reasonable needs.

After cancellation, choose reimbursement or rerouting. A delay of at least five hours also permits a passenger to abandon a journey that no longer serves its purpose and seek reimbursement, potentially with a return to the point of departure. The five-hour delay guide explains that election.

Do not buy a replacement ticket impulsively. Ask Lufthansa to reroute first, document its offer or refusal, and choose a proportionate alternative if independent action becomes necessary.

Evidence checklist

Preserve the itinerary, operating carrier, boarding documents and every disruption message. Note departure, landing and door-opening times. Save airport notices and official ATC or weather statements covering the relevant place and period.

In a claim or rebuttal, request:

  1. the exact meteorological or air-traffic event;
  2. the official restriction and applicable time window;
  3. the aircraft rotation and delay breakdown;
  4. measures considered for the flight and passengers;
  5. the reason earlier rerouting was not possible.

Avoid relying solely on commercial flight-tracking screenshots. They are useful corroboration, but official records and Lufthansa's own operational evidence carry greater weight.

Evaluating Lufthansa's response

A persuasive response identifies the airport or sector, restriction period, affected aircraft and recovery action. A weak response repeats “weather” or “air traffic restrictions” without connecting them to the claimed arrival delay.

Challenge only what is missing. If the event is established but mitigation remains unexplained, say so. FAQ

Does any bad weather excuse Lufthansa from compensation?

No. Lufthansa must prove conditions incompatible with the flight, a causal link and reasonable measures.

Is an ATC slot always an extraordinary circumstance?

It can be, but the carrier should identify the authority, restriction, timing and minutes actually caused.

Can weather on an earlier Lufthansa flight affect my claim?

Yes where a direct causal link exists, although Lufthansa must still explain recovery and later independent delay.

Are hotel and meal rights lost during a snowstorm?

No. Appropriate care is normally due during the wait regardless of whether fixed compensation is excluded.

Does another airline's departure prove my Lufthansa flight could operate?
