Lufthansa downgrade refund: Business, Premium Economy and Economy

Short answer: when Lufthansa involuntarily carries a passenger in a lower cabin than purchased, current EU261 requires reimbursement of 30%, 50% or 75% of the price attributable to the downgraded flight within seven days. The percentage depends on distance, not on whether Lufthansa was at fault, and the calculation applies only to the affected sector under the Mennens judgment.

The current rule is based on the distance of the particular downgraded flight. It is not the EUR 250–600 fixed-compensation table.

Example: Lufthansa moves a passenger from Business to Economy on Paris–Frankfurt. That short sector falls in the 30% category even if the complete ticket continues to Singapore.

Example: Frankfurt–Tokyo is downgraded from Business to Premium Economy. The affected non-EU flight exceeds 3,500 km, so the starting reimbursement is 75% of the price allocated to that sector.

What counts as a cabin downgrade

A downgrade means placement in a class lower than that for which the ticket was purchased. Lufthansa's cabins can include First, Business, Premium Economy and Economy, depending on aircraft and route. Business to Premium Economy, Business to Economy and Premium Economy to Economy are clear examples.

These events are not necessarily Article 10 downgrades:

  • seat changed within the same cabin;
  • preferred-seat assignment lost;
  • broken recline or entertainment system;
  • meal or lounge service not delivered;
  • separately bought baggage or seat option unavailable;
  • aircraft swap which preserves the booked cabin.

Such service failures can justify a contractual refund of the missing ancillary or damages, but the 30/50/75% formula does not automatically apply. Focus on the cabin shown on the original and final boarding documents.

Calculate only the affected flight

The Court of Justice held in Mennens that reimbursement is calculated from the price of the downgraded flight, not the entire multi-sector ticket. If that price is not shown, use an objective allocation such as the relationship between the distance of the affected flight and the total distance of carriage on the ticket.

Taxes and charges which are not dependent on cabin class are excluded from the percentage base. A carrier-imposed surcharge may require examination rather than automatic treatment as a government tax.

Worked example:

  • return ticket base and class-dependent price: EUR 2,400;
  • outbound Frankfurt–New York sector allocation: EUR 1,100;
  • inbound and feeder sectors remain in Business;
  • outbound sector is over 3,500 km and downgraded;
  • calculation: EUR 1,100 × 75% = EUR 825.

Do not apply 75% to the entire EUR 2,400 merely because the booking contains a long-haul downgrade. Ask Lufthansa for its sector allocation and fare construction when the e-ticket receipt does not show one.

One booking and several passengers

Each passenger has an individual Article 10 entitlement. If two adults and one child each hold paid Business tickets and all are downgraded on the same segment, calculate the applicable percentage against each person's affected-flight price.

A child fare or companion fare can have a different base. Do not simply multiply one adult amount unless ticket values match. An infant without a separate seat may not have the same cabin price allocation.

Where only one traveller is moved down, only that traveller claims the percentage. Preserve every boarding pass because a common booking confirmation may not reveal the final cabin assignment.

Paid upgrades and Miles & More upgrades

A confirmed paid Lufthansa upgrade should be evidenced with the original ticket, upgrade receipt, cabin confirmation and reissued boarding pass. Ask Lufthansa to state whether it treats the upgrade payment, underlying fare or combined affected-sector value as the reimbursement base.

Mileage upgrades are more complex because miles do not provide a simple cash sector price. Article 10 still protects an actual lower-class placement, but valuation may be disputed. Request return of the upgrade miles and fees as an immediate contractual remedy while preserving any statutory percentage argument.

A Miles & More award ticket is not excluded from EU261 merely because it was paid with miles. The regulation covers tickets issued under frequent-flyer programmes available to the public. The Miles & More guide separates award travel, upgrades and fixed compensation.

Cause and notice do not remove Article 10

Downgrade reimbursement does not require a three-hour delay, late cancellation notice or proof that Lufthansa caused the problem. Weather, aircraft substitution and operational necessity do not erase the percentage remedy if the passenger is actually carried in a lower cabin.

This differs from fixed compensation, where extraordinary circumstances and notice periods matter. Keep Lufthansa's reason for context, but do not let the response turn an Article 10 request into a fault debate.

An upgrade provided without charge produces no reverse payment to Lufthansa. Article 10 expressly bars the carrier from seeking a supplement when it places a passenger in a higher class.

Combining downgrade with other claims

Example: Lufthansa cancels a Business Class flight to Chicago, reroutes the passenger next day in Economy and arrival is 18 hours late. The passenger may have:

  • Article 10 reimbursement for the downgraded replacement sector;
  • EUR 600 cancellation compensation if all separate conditions are satisfied;
  • hotel, meal and transfer reimbursement during the wait;
  • return of an undelivered paid seat or service where applicable.

These heads address different harm. Present each calculation separately and disclose any payment already made. A duplicate recovery for the same fare element is not permitted.

Evidence and claim wording

Keep the e-ticket receipt, fare basis, booking code, original cabin confirmation, original and replacement boarding passes, baggage tags and upgrade record. Photograph the replacement boarding pass if Lufthansa retains paper at the gate.

Request:

  1. confirmation of the cabin actually travelled;
  2. the affected sector's price allocation;
  3. identification of class-independent taxes and charges;
  4. the distance category and reimbursement percentage;
  5. payment within the current Article 10 period.

Use a table for multiple passengers or sectors. Do not submit only the difference between a retail Business and Economy fare found after travel; Mennens looks to the ticket's affected-flight price, not a later market quote.

Current law and the adopted reform

This guide states the law on 10 August 2026. Current Article 10 retains the seven-day reimbursement period. The EU reform adopted in July 2026 is not yet applicable; its future automatic-payment timing and codified allocation method must not be presented as today's rule.

The future nine-month complaint period concerns filing a compensation request and is not the current deadline for Article 10 payment. Keep those clocks separate.

FAQ

Is Business to Premium Economy a Lufthansa downgrade?

Yes. Premium Economy is a lower cabin than Business, so Article 10 can apply to the affected flight.

Does bad weather prevent downgrade reimbursement?

No. The percentage remedy does not depend on airline fault or extraordinary circumstances.

Is 75% calculated on my whole return ticket?

No. It applies to the price attributable to the downgraded sector, excluding class-independent taxes and charges.

Can I claim when a mileage upgrade is lost?

Yes, but valuation can be disputed; preserve the upgrade confirmation and request return of miles and fees alongside the statutory position.

Can downgrade reimbursement and EUR 600 coexist?

Yes when the journey independently satisfies the cancellation, delay or denied-boarding compensation conditions.
