KM Malta Airlines booked through an OTA or package: who handles the claim?

Short answer: send EU261 fixed compensation and operating disruption claims to the airline that operated the flight. Use the OTA or ticket issuer for ticket servicing and often the payment flow of a fare refund. A package organiser has separate duties for the combined holiday. Identify each role before submitting so that KM, the seller and organiser do not redirect the same request indefinitely.

One company can hold more than one role, but do not assume it does.

Find the ticket issuer and operator

The booking confirmation should show ticket numbers, flight codes, operating-carrier disclosure and agency contact. The merchant on the card statement shows who collected money but does not necessarily identify the airline performing the flight.

Read each sector. KM can place its code on a partner's service, and a partner can place its code on a KM-operated flight. Fixed passenger-rights claims generally follow operation.

Cancellation notice through an intermediary

For fixed cancellation compensation, KM bears the burden of proving when the passenger was informed. Keep original email headers and account notifications from both airline and agent.

Court of Justice case law has held that an operating carrier cannot rely automatically on timely notice sent to an intermediary when the passenger did not receive it in time, subject to the actual authority and information chain. Ask the OTA when it received KM's message and why forwarding was delayed.

Do not conceal an address error supplied by the passenger. A complete chronology is more credible than a simplified claim.

Refund after KM cancellation

KM must offer reimbursement or rerouting after its protected cancellation. Where an agency issued the ticket, refund money may pass through the ticketing chain. Ask KM to confirm authorisation and the issuer to confirm receipt and onward payment.

Do not file a card chargeback and airline refund for the same fare without disclosure. Claim only the outstanding balance.

Rerouting and self-transfer

One ticket across several carriers can carry connection protection to the final destination. An OTA can instead sell two independent tickets in one checkout and label them self-transfer. Look for separate booking references, baggage collection instructions and guarantee terms.

If a protected connection is missed, the responsible operator should reroute. If a separate onward flight is missed, statutory protection normally stops at the first ticket's destination; the OTA guarantee, insurance or package organiser may help.

Package holidays

A package combines at least two travel services under the statutory definition and can give rights against the organiser when performance is affected. The organiser may need to provide suitable alternatives, assistance or price reduction beyond airline EU261 duties.

KM Malta Holidays' current UK terms identify a collaboration involving KM Malta Airlines and TripX Travel AB and distinguish the airline contract from the travel-agency or package relationship. Read the organiser named on the confirmation; branding alone does not identify it.

Notify the organiser promptly before cancelling components independently. Preserve the package certificate, invoice, accommodation and transfer terms, plus every proposed alternative.

OTA service and communication problems

If the agent hides the booking email, asks for verification or controls Manage Booking, request that it update KM with the passenger's direct contact details. Keep proof of attempts to obtain the airline booking reference.

An OTA fee for handling a statutory airline refund can raise a separate contract or consumer issue. Compare the fee disclosed at purchase and refund. Do not subtract it silently from the EU261 claim against the operator.

An agency may also issue its own credit before receiving money from KM. Read whether that payment is a loan, goodwill benefit or final settlement. If later airline funds arrive, the seller should provide a transparent reconciliation. Preserve the original currency and exchange rate used because hidden conversion can create a separate disputed balance.

Where the agent claims it cannot contact the airline, ask for the global distribution system status, ticket coupon status and any waiver code supplied. Those records can show whether KM authorised an involuntary refund or reissue.

Submit parallel but distinct requests

Send KM the operating-flight claim with complete itinerary, final arrival, notice and passenger list. Send the issuer the fare-servicing request. Send the organiser the package-performance request. Cross-reference case numbers and state what each party is being asked to do.

Avoid duplicate recovery. If one party reimburses hotel, fare or replacement transport, update the balance claimed from another.

FAQ

Does booking through an OTA remove EU261 rights?

No. The operating carrier remains responsible for qualifying flight disruption, although the issuer can control ticket servicing and refund flow.

Who pays KM compensation on a codeshare?

The airline actually operating the affected flight generally receives the fixed claim, even when KM or the OTA sold it.

What if the OTA informed me late about cancellation?

Preserve both timestamps. KM must prove timely notice, and intermediary communication can be central to the 14-day exemption.

Is an OTA self-transfer one protected connection?

Not necessarily. Separate tickets normally remain independent despite one checkout; read ticket numbers and guarantee terms.

Can I claim from both organiser and airline?

Separate rights can coexist, but the same fare, hotel or loss cannot be recovered twice. Disclose payments and claim the remaining balance.
