KM Malta Airlines missed connection in Malta: compensation and rerouting

Short answer: when a delay causes a passenger to miss an onward flight in Malta on one protected booking, KM should reroute the passenger to the final destination. Fixed compensation can be due if final arrival is at least three hours late and no extraordinary-circumstances defence succeeds. An OTA may display a self-transfer as one itinerary and offer a commercial guarantee. That guarantee can help, but it does not rewrite separate air-carriage contracts into one EU261 connection.

Immediate steps after missing the flight

Go to KM or the relevant transfer desk and ask for written rerouting to the final destination. Do not buy a replacement immediately without giving the responsible airline a reasonable opportunity to act, unless no effective assistance is available and delay would materially worsen.

Ask for:

  • the earliest reasonable route under comparable conditions;
  • confirmation of all new sectors and operators;
  • baggage tracing or re-tagging instructions;
  • meal vouchers during a qualifying wait;
  • hotel and airport transport if an overnight stay is necessary;
  • written reason for the original delay.

Keep the original and new itineraries. A standby slip is not a confirmed replacement booking.

Measure arrival at the final destination

Suppose a one-ticket Paris-Malta-Rome journey has a late KM inbound sector. The Rome connection is missed and rerouting arrives four hours after the original schedule. Rome supplies the final-arrival test, not the time the passenger reached Malta.

Under EU case law, arrival is linked to first aircraft-door opening when passengers may disembark. Record that time on the final replacement sector. Fixed compensation normally requires at least three hours and is calculated by protected journey distance.

Which airline receives the claim?

Passenger-rights liability usually follows the operating carrier responsible for the disrupting flight. If KM operated the late first sector, direct the initial fixed claim to KM. If a partner operated it under a KM marketing code, read the "operated by" field and preserve the contractual chain.

For through journeys involving several operators, Court of Justice case law can allocate liability based on the operating carrier and connected booking. Do not simply invoice whichever airline sold the ticket. A refund may still involve the ticket issuer, and baggage responsibility can follow Convention rules for successive carriage.

Care during the wait in Malta

Reasonable food and refreshments are due according to waiting time and journey distance. A necessary overnight stay can create hotel and transfer rights. The cause of the original delay does not generally remove care.

Ask the responsible airline first. If no usable accommodation or meal assistance is supplied, document the desk, messages and attempts to contact support. Buy proportionate necessities and retain itemised receipts. Claim those costs separately from the fixed amount.

If the passenger chooses not to continue because the journey has become pointless, discuss reimbursement of relevant travel and return to first departure rather than simply becoming a no-show.

Extraordinary circumstances on connections

An external event affecting the first sector can remove fixed compensation if the airline proves causation and reasonable measures. It must still explain why rerouting or operational recovery could not avoid the final delay.

The minimum connection time does not excuse every missed connection. If the airline sold the itinerary, the planned transfer was accepted as workable. Passenger-caused delay, late arrival at the gate or missing documents require different evidence.

A disruption with mixed causes may need allocation. Ask for the original delay chronology and each replacement option considered.

Separate-ticket loss

When the second flight is independent, EU261 for the first ticket normally does not reimburse the value of the missed onward ticket merely because the passenger planned them together. The first flight can still generate its own fixed compensation and care if its conditions are met.

Check travel insurance, credit-card cover, package status and any OTA self-transfer guarantee. Preserve proof that the connection risk was represented as protected if a seller made that promise.

Do not ask KM to reroute to a city not shown on its contract without explaining another legal or contractual basis.

Claim file

Attach all e-tickets, booking references, boarding passes, bag tags and replacement confirmations. State whether the journey was one reservation, identify the final destination, provide original and actual final arrival, and list each operating carrier.

Calculate compensation per passenger. Add meals, hotel and transport as a receipted schedule. If KM redirects the claim, request the factual and contractual basis. Save the Help Centre acknowledgement and any partner case number.
