KM Malta Airlines downgrade refund: 30, 50 or 75 percent

Short answer: if KM Malta Airlines moves a passenger to a lower cabin than the ticket purchased, current EU261 requires reimbursement of 30, 50 or 75 percent of the price of the downgraded flight segment within seven days. The percentage depends on distance. The passenger does not need to prove a three-hour delay or airline fault, and the downgrade refund can coexist with compensation for a separate qualifying disruption.

A changed seat within Economy, lost extra-legroom option or missing meal is not automatically a cabin downgrade. Compare the cabin and booking class actually purchased with the cabin flown.

This guide reflects Article 10 and Court of Justice interpretation checked on 13 August 2026. The reform approved in July 2026, including a future 14-day automatic process, was not yet applicable.

The calculation applies to the affected segment, not automatically the whole round trip or every connection. It is per downgraded passenger.

What counts as a downgrade?

KM currently describes a two-class aircraft configuration with Business and Economy cabins. A passenger booked in Business and carried in Economy has a clear cabin downgrade. Fare brands within the same cabin require more care.

Keep the fare conditions and cabin name. Booking-class letters alone can be confusing across airlines and codeshares.

Calculate the segment price

In Mennens v Emirates, the Court of Justice held that reimbursement is calculated from the price of the flight on which the passenger was downgraded. If the ticket does not show that price separately, a proportion can be derived from the distance of that segment compared with the total carriage covered by the ticket.

Taxes and charges unrelated to cabin class are excluded from the calculation base. Request the fare breakdown from KM or the ticket issuer rather than applying the percentage blindly to the card total.

Carrier-imposed surcharges require closer examination than genuine government or airport taxes. Ask which items varied by cabin and which were payable regardless of class. The label "taxes and fees" on an OTA receipt is not conclusive. If KM supplies only a total ticket price, request the fare construction and explain the distance-based allocation proposed under Mennens.

Example: a return ticket contains two segments, but only the outbound sector is downgraded. The refund base is the fare attributable to that outbound segment, excluding class-independent taxes. If its eligible base is EUR 600 and the route belongs to the 50 percent category, the refund is EUR 300.

One connection or several downgraded sectors

Assess each affected flight separately. If a passenger is downgraded only on a partner-operated onward flight, identify that operating carrier and segment price. A KM marketing code does not automatically make KM responsible for another airline's downgrade.

If two segments are downgraded, calculate each by its distance percentage and attributable price. Do not apply the highest percentage to the entire journey.

Paid upgrade, SkyBux and reward tickets

For a cash upgrade, preserve the original ticket, upgrade confirmation and extra payment. The correct base can depend on whether the upgrade reissued the ticket, changed the fare or purchased an ancillary product. Request a transparent calculation rather than promising one universal formula.

KM Rewards terms allow SkyBux to pay eligible fare components and ancillaries under programme conditions. A reward or mixed-payment ticket is not automatically outside Article 10. Determine the value assigned to the affected segment and any taxes paid in money.

If KM restores an upgrade payment, that may not equal the statutory downgrade reimbursement. Compare what was paid and the legal basis to avoid both underpayment and double recovery.

Combine downgrade with other claims

Article 10 refund does not depend on lateness or extraordinary circumstances. If the same passenger also arrives at least three hours late due to a qualifying controllable disruption, EUR 250-600 can be claimed separately.

Care expenses, ticket reimbursement after cancellation and denied-boarding compensation also follow their own conditions. List them on different lines. A passenger who flies in the lower cabin has used the transport, so a full ticket refund is not automatic merely because of downgrade.

Evidence and claim

Keep the e-ticket, receipt, fare breakdown, original and new boarding passes, cabin photograph where appropriate, seat assignment, upgrade confirmation and messages. Ask the gate to record involuntary downgrade rather than voluntary cabin acceptance.

Submit:

  1. affected passenger and sector;
  2. purchased and flown cabins;
  3. route distance and applicable percentage;
  4. segment fare base excluding class-independent taxes;
  5. calculation and amount;
  6. separate delay, cancellation or expense claims.

Current Article 10 says reimbursement within seven days. If KM offers only a voucher, request monetary repayment unless voucher consent is genuinely preferred. Preserve the Help Centre acknowledgement.

The future revised Article 10 preserves the percentage bands and codifies segment allocation, but its automatic 14-day mechanism had not started to apply on the review date. Do not give KM 14 days by replacing the current seven-day rule prematurely.

FAQ

Is Business to Economy always a downgrade?

Yes when the purchased Business cabin is replaced by Economy on the operated segment, regardless of whether the flight is late.

Does losing a preferred Economy seat trigger 30 percent?

Not automatically. It is usually an ancillary-service or seat-fee issue unless the passenger was moved to a lower cabin.

Is the percentage applied to the entire ticket?

No. Mennens directs calculation to the downgraded segment, with proportional allocation if its fare is not shown.

Can I claim downgrade and delay compensation?

Yes when the separate conditions for both are met. The downgrade refund and fixed delay payment address different harm.

Does extraordinary weather remove the downgrade refund?

No. Article 10 does not require airline fault, although the passenger must prove that a lower cabin was actually used.
