Start with the operating airline and travel date. KM Malta Airlines began flying on 31 March 2024. It is not the former Air Malta, Malta Air within the Ryanair group, or Wizz Air Malta. The letters "KM" on a ticket do not by themselves prove which company owes a claim.

The fixed sum is assessed per eligible passenger, not per reservation. A couple with two qualifying tickets can each have a claim. A child travelling on a publicly available paid fare can also qualify. A free ticket unavailable to the public is treated differently, while a reward ticket issued through a commercial frequent-flyer programme is not automatically excluded.
When EU261 covers KM Malta Airlines

Citizenship, residence and the currency used to buy the ticket do not decide EU261 coverage. The geography of the journey and the airline actually performing the affected flight do.

Calculate EUR 250, EUR 400 or EUR 600
Under the current EU261 distance bands, the usual maximum fixed amounts are:

Distance is measured by the great-circle method. On a protected one-ticket connection, the relevant route can run from the first departure to the final ticketed destination rather than merely the disrupted sector. Do not add the lengths of separate bookings.
A rerouted passenger can receive half of the normal amount when arrival stays within the statutory two-, three- or four-hour limits for the applicable distance category. That reduction is not automatic merely because KM found another flight.

Compensation is different from transport and care
Keep each requested remedy on a separate line in the claim. This prevents an airline refund from being mistaken for settlement of every right.
- Fixed compensation addresses the inconvenience of an eligible disruption.
- Reimbursement returns the ticket price when the passenger chooses not to travel in a qualifying case.
- Rerouting carries the passenger to the booked final destination under comparable conditions.
- Care covers reasonable meals, communication, accommodation and airport-hotel transport during the wait.
- Consequential loss may require proof and a different legal basis, including the Montreal Convention.
- Baggage loss follows its own reporting and limitation system.
Accepting rerouting does not generally waive fixed compensation. Equally, accepting fixed compensation does not erase a supported hotel invoice. Choosing a full refund instead of travel normally ends the duty to carry the passenger onward on that ticket.
Delay and cancellation use different evidence
For a delay claim, record scheduled and actual arrival at the protected final destination. Under Court of Justice case law, arrival is linked to the opening of at least one aircraft door when passengers are allowed to leave, not touchdown or parking alone.
For a cancellation, preserve the first notice and its timestamp. Fixed compensation can depend on whether notice arrived at least 14 days ahead and, for shorter notice, on the departure and arrival times of the replacement offered. The choice between refund and rerouting remains even when the cancellation was announced early.
For denied boarding, keep proof of a confirmed booking, valid documents, timely check-in and presence at the gate. A passenger who voluntarily exchanges a seat for agreed benefits is not in the same position as someone removed involuntarily after insufficient volunteers came forward.
Extraordinary circumstances do not end every right
KM may avoid fixed compensation only if it proves an extraordinary event and that the disruption could not have been avoided even with all reasonable measures. A phrase such as "operational reasons" is not a complete explanation.
Severe weather, binding air-traffic restrictions, airport closure or an external security event can qualify when the evidence connects that event to the flight. Routine technical faults and ordinary internal staffing problems usually require closer scrutiny. Even when the defence succeeds, rerouting, refund and care can remain due.
Ask KM to identify the event, affected time window, causal chain and mitigation considered. The rejected claim guide provides a structured response rather than assuming every refusal is correct or incorrect.
Build a claim file before submitting
Keep the e-ticket receipt, six-character booking reference, boarding passes, every disruption message and the itinerary showing the operating carrier. Add photographs of airport displays, proof of actual arrival, replacement booking records and itemised receipts. Where another person submits for the passenger, retain written authority and identity information requested by the form.
State each traveller's name and requested amount. Separate fixed compensation from ticket reimbursement and expenses. Explain the route, final destination, scheduled arrival, actual arrival and known reason. Save the confirmation page or acknowledgement because it proves when and where the claim was sent.
KM directs post-travel requests through its online Help Centre. If the answer is absent or unsatisfactory, the competent enforcement body usually depends on where the incident occurred. MCCAA is Malta's national enforcement body for incidents in Malta, but it supervises compliance rather than automatically transferring a private award.
