The CAA describes UK protection as covering flights departing the UK on any airline and flights arriving in the UK on a UK or EU airline. KM's EU licence therefore matters on the inbound direction.
Which regime should be claimed?
For UK-Malta, UK261 supplies the natural fixed-payment route. For Malta-UK operated by KM, both departure-based EU261 and inbound UK261 can be relevant. The passenger should not submit two claims as if two losses occurred.
Choose a coherent basis using the operating carrier's process, currency and competent enforcement route. Disclose any payment already received. Refund, rerouting and care can also overlap conceptually, but actual expenditure or fixed inconvenience must not be recovered twice.
If a protected one-ticket journey continues beyond Malta, assess whether the final destination is part of the same contract. A UK departure can remain protected to the last destination even when the missed connection occurs in Malta. Separate tickets generally end the statutory journey at the first ticketed destination.
UK compensation bands
The CAA currently presents UK261 fixed amounts as:

For long-haul delay, the UK system distinguishes arrival between three and four hours from arrival of at least four hours; the lower situation can produce GBP 260 rather than GBP 520. Rerouting reductions also need the applicable statutory conditions.
EU261 uses EUR 250, EUR 400 and EUR 600. Do not convert one schedule at a daily exchange rate and call it the other regime. State the legal basis and amount actually claimed.
Delay, cancellation and denied boarding
For delay, UK guidance measures compensation by arrival at the destination, normally requiring at least three hours. Care starts after two, three or four hours of expected departure delay depending on distance.
For cancellation, the airline must offer reimbursement or rerouting, and fixed compensation can depend on notice, substitute timing and extraordinary circumstances. For an involuntary denied boarding case, timely presentation and valid travel documents remain essential.
The CAA expects airlines to provide reasonable food, communication, hotel and transport during a qualifying disruption. If assistance is unavailable, retain itemised receipts and keep spending proportionate.

Operator and connection evidence
Keep the full itinerary rather than a screenshot showing only a KM flight number. The operating-carrier line, ticket numbers and booking references establish who performed each sector and whether they formed one reservation.
A journey sold by a UK travel company may also be a package. Package organiser duties can coexist with airline passenger rights, but claiming against the organiser does not change which airline operated the flight. An OTA self-transfer label does not turn separate tickets into one protected connection.
Where the aircraft or crew comes from another carrier, ask whether the arrangement was a wet lease on behalf of KM or a codeshare operation by the partner. The legal answer cannot be inferred from cabin branding alone.
Cause and extraordinary circumstances

For an incident departing Malta, MCCAA may examine EU261 compliance. It should not be selected for a UK departure merely because KM is Maltese. Court jurisdiction and limitation require separate assessment under the regime and forum.
