KM Malta Airlines 5-hour delay: refund or continue travelling?

Short answer: once a protected KM Malta Airlines flight is delayed by at least five hours at departure, a passenger who no longer wishes to travel can choose reimbursement within seven days. If earlier sectors have made the trip pointless, the current EU261 rule can also require repayment of relevant used portions and a return flight to the first departure point. Continuing the journey preserves transport and care rights but normally means the passenger has not chosen the five-hour abandonment refund.

The five-hour option is different from fixed compensation for arriving three hours late. It is also different from a voluntary cancellation under fare rules. Decide what outcome is wanted before accepting a refund, voucher or replacement flight.

The official rules and KM material were reviewed on 13 August 2026. The EU reform approved in July 2026 was not yet applicable, so the present seven-day reimbursement mechanism remains the operative reference here.

Five hours is measured against the scheduled departure of the delayed flight for this choice. It does not mean a passenger must wait exactly five hours before asking what arrangements KM can provide, and it does not turn a shorter delay into a free cancellation.

What the current refund can include

Article 8 of EU261 provides reimbursement of the full ticket cost at the price paid for the part or parts not made. It also covers parts already travelled when the journey has become pointless in relation to the passenger's original plan, together with a return flight to the first departure point at the earliest opportunity when relevant.

Consider Manchester-Malta-Rome on one ticket. The Malta departure is delayed for more than five hours, and the passenger's time-sensitive event in Rome is over. The claim should explain why the entire itinerary no longer serves its purpose, rather than asking only for the unused Malta-Rome coupon. Facts matter; a personal preference to go home is not identical to an objectively frustrated travel plan.

On separate tickets, the statutory repayment for one delayed contract does not automatically absorb the other booking. Insurance, package-travel rules or an OTA protection may still help with the independently purchased sector.

Refund or rerouting cannot be combined for the same transport

Reimbursement and onward carriage are alternative Article 8 choices. A passenger who elects a full refund normally cannot also demand that KM provide the cancelled or delayed journey without charge. A passenger who still needs to reach the destination should request rerouting and avoid clicking an irreversible refund option merely to obtain immediate money.

Before choosing, compare:

  • how soon KM can move the passenger;
  • whether another airline offers a materially earlier route;
  • the value of unused and already travelled sectors;
  • hotel and meal needs during the wait;
  • whether the purpose of travel can still be achieved;
  • restrictions attached to any proposed voucher.

Fixed compensation uses final arrival and cause

Choosing to continue can lead to a separate EUR 250, EUR 400 or EUR 600 claim if the protected journey reaches its final destination at least three hours late and KM cannot establish extraordinary circumstances plus reasonable measures.

Choosing reimbursement after five hours does not automatically create or destroy fixed compensation. The legal analysis must account for the qualifying disruption and the counterfactual arrival that would have occurred, with careful treatment when the passenger voluntarily abandons travel. State the two remedies separately and do not describe the refund itself as compensation.

The five-hour departure threshold can be met even if an eventual flight would have arrived under three hours late. The inverse can also happen: a missed one-ticket connection can create more than three hours of final delay even though no individual departure was held for five hours.

Care continues while the passenger waits

Meals and refreshments arise at earlier thresholds based on route distance. If departure moves to the following day, accommodation and transport between the airport and lodging should be offered where necessary. These duties do not require the passenger to prove that KM caused the disruption.

A passenger deciding whether to continue remains entitled to suitable care during the qualifying wait. After a clear choice to abandon and receive reimbursement, the future scope of care narrows because the airline is no longer carrying that passenger onward. Arrange the refund and any return transport explicitly rather than simply leaving the airport.

If KM fails to provide assistance, keep itemised receipts for reasonable necessities and proof of attempted contact. Separate those expenses from the fare amount in the online request.

Voucher consent and payment evidence

Under the current wording, reimbursement is made in cash, by electronic bank transfer, bank order or cheque, or with the passenger's signed agreement in travel vouchers or other services. An airline credit should therefore be an informed choice, not the only visible resolution.

Save screenshots of the options, the selected remedy and the confirmation. Record the original fare, taxes and payment method. Where an agency collected the money, the ticket issuer may be involved in the payment path, but KM remains responsible for offering the statutory choice after its protected disruption.

How to request the five-hour refund

Prepare the booking reference, ticket number, itinerary, scheduled departure, messages showing the accumulating delay and proof that travel was abandoned after the threshold. For a partly used journey, explain why it became pointless and identify the requested return journey.

Write the request in this order:

  1. identify the delayed flight and operating carrier;
  2. state when the delay reached at least five hours;
  3. select reimbursement under Article 8(1)(a);
  4. list unused and relevant used portions;
  5. request return to the first departure point where applicable;
  6. list care expenses separately;
  7. preserve the Help Centre case number.

Do not wait for future procedures. The adopted nine-month EU notification period had not started to apply on the review date, and court time limits can depend on the jurisdiction hearing the dispute.

FAQ

Does a five-hour delay force me to cancel the trip?

No. It creates a choice. You may abandon and seek reimbursement or continue travelling while retaining care and any later compensation claim that meets separate conditions.

Is the five-hour threshold measured at departure?

Yes for this reimbursement option. Fixed delay compensation is normally measured by final arrival, so the two clocks should not be confused.

Can I demand a refund and still take the delayed flight?

Normally not for the same transport. Full reimbursement and continued carriage are alternative choices, so decide which outcome serves the journey.

Must KM return me to my first airport?

It can be required when earlier travel has occurred, the trip no longer serves its original purpose and a return flight to the first departure point is relevant.

Can KM pay the refund only as a voucher?

Not under the current EU261 rule without the passenger's signed agreement. Ask for monetary reimbursement when that is the preferred method.
