The airport announcement may call the event a diversion, cancellation or technical stop. Build the legal analysis from what actually happened.
Same city or region is not automatically cancellation
Under EU case law, diverting a flight to an airport serving the same town, city or region does not by itself make the flight cancelled. The passenger may still qualify for delay compensation if arrival at the original airport, or another nearby destination agreed with the carrier, is at least three hours late.
The airline should offer transport from the alternate airport to the booked airport or another close destination agreed with the passenger. If it fails to do so, reasonable transport costs can be recoverable. Keep the receipt and evidence that assistance was requested.
An airport hundreds of kilometres away or a landing with no practical continuation requires a closer look. KQ may need to arrange another flight, ground transport and overnight care rather than treating touchdown as completion of the contract.
How to calculate arrival time
For an ordinary flight, EU delay is measured when at least one aircraft door opens and passengers are permitted to leave. A diversion adds another step when the passenger must reach the booked airport or agreed nearby destination.
Record:
- touchdown and door-opening time at the alternate airport;
- when passengers were allowed into the terminal;
- when KQ offered transport or a replacement flight;
- departure and arrival of that onward transport;
- the time the original destination was reached.
Do not use the first landing time as the final figure if the airline still had to transport passengers to the ticketed endpoint. Conversely, private travel to an unrelated destination chosen for convenience may not define statutory arrival.
The cause still matters
A diversion caused by severe weather, an airport closure, a medical emergency or a binding ATC instruction can be extraordinary. A routine technical defect, fuel-planning issue or operational decision may remain within normal airline activity. Kenya Airways should identify the event and show reasonable measures.
Even an extraordinary cause does not erase care. On a protected EU or UK departure, KQ can still owe meals, communication, accommodation and transport while arranging completion of the journey.
If the airline blames weather, compare the conditions at the scheduled destination and the time operations resumed. If it cites a medical event, do not request another passenger's private medical details; ask for a sufficiently specific operational explanation and timeline.
EU and UK departures
Kenya Airways flights from Paris or Amsterdam can be covered by EU261. KQ flights from Heathrow or Gatwick can be covered by UK261. Because the routes exceed 3,500 kilometres, a qualifying final delay generally points to EUR 600 or GBP 520, with possible 50% reduction where a reroute limits arrival delay to the statutory long-haul window.
The airline's nationality does not block protection for these outbound journeys. The place of departure brings them within scope.
For Nairobi departures operated by Kenya Airways, the opposite normally applies: KQ is not an EU or UK carrier, so a diversion before Amsterdam, Paris or London usually does not create the European or British fixed sum. Seek completion, refund where appropriate and compensation for proven Montreal Convention damage instead.
Missed onward connection
A diversion can cause a missed connection after Nairobi. If Paris-Nairobi-Zanzibar appears on one booking and the protected first flight leads to arrival in Zanzibar many hours late, final-destination timing can control the EU claim. Preserve every boarding pass and the replacement itinerary.
If the tickets are separate, Kenya Airways may regard Nairobi as the end of its contract. Document how the journey was sold, any through-checking promise and whether a package organiser or insurer protects the second ticket.

Transport and care expenses
Ask KQ or its ground handler to arrange transport before paying independently. If no workable assistance appears, choose a reasonable option, retain an itemised receipt and record the refusal or absence of staff.
A taxi may be reasonable late at night when no coach or train operates. A premium car, sightseeing stop or hotel far from the alternate airport may be challenged. For an overnight diversion, keep room, meal and transfer receipts separately.
Do not deduct care costs from fixed compensation. They are different heads of claim. Likewise, fare reimbursement is generally an alternative to continuing the cancelled journey, not an extra award after completing the entire route.
Claim file
Attach the e-ticket, operating carrier, original and replacement boarding passes, diversion announcement, final arrival proof, ground-transport receipt and all KQ messages. Add a simple map only if it helps show why the alternate airport did not serve the same city or region.
State the applicable route rule, final delay and cause as separate points. If KQ declares extraordinary circumstances, request the operational notice and reasonable-measures record. If it treats the alternate landing as on-time arrival, provide the onward transport chronology.

Worked diversion scenarios
An Amsterdam-Nairobi service diverts because of a routine aircraft issue and passengers reach Nairobi by replacement transport six hours after schedule. If KQ cannot establish an extraordinary cause, each eligible passenger can seek EUR 600 plus reasonable care costs.
A Heathrow departure lands at another airport after Nairobi closes temporarily in severe weather. KQ arranges a coach and passengers reach Nairobi five hours late. Proven airport closure may defeat GBP 520 compensation, but the coach, meals and any necessary accommodation remain part of KQ's response.
A KQ-operated Nairobi-Paris flight lands elsewhere and arrives at CDG the following day. The disruption is serious, yet EU261 normally does not cover this non-EU carrier's departure from Kenya. Contractual completion and proven financial loss are the more suitable demands.
