JetBlue departures from Europe: when EU261 protects the journey
EU261 can cover JetBlue because the regulation protects departures from EU airports even when the operating airline is American. A qualifying delay, cancellation or denied boarding on JetBlue from Paris, Amsterdam, Dublin or another EU gateway may produce EUR 250-600 per passenger. The reverse US-to-Europe direction normally falls outside EU261 because JetBlue is not an EU carrier.

Territorial coverage in one table
| JetBlue journey | EU261 position |
|---|---|
| Paris to New York | Covered at departure |
| Amsterdam to Boston | Covered at departure |
| Dublin to New York to Orlando on one ticket | Can remain covered to Orlando |
| New York to Paris | Normally outside EU261 for JetBlue |
| Boston to Amsterdam | Normally outside EU261 for JetBlue |
| London to New York | Use UK261, not EU261 |
EU261 also applies to departures from the EEA, and comparable rules apply in Switzerland through the relevant arrangements. London has its own retained UK system. Do not describe every geographic European airport as an EU departure without checking the applicable territory.
One booking carries protection to the final destination
The regulation views directly connecting flights booked as a whole as a unit for delay measurement. If JetBlue sells Dublin-New York-Los Angeles under one reservation and a disruption leads to arrival in Los Angeles four hours late, Los Angeles can be the final destination for EU261.
Case C-561/20 is especially relevant. The Court of Justice held that compensation could be due for a journey departing the EU and continuing on a non-EU flight operated by a non-EU carrier when the flights formed a single booking. It prevents the European protection from disappearing merely because the decisive delay occurs on a later US domestic sector.
This does not merge independently purchased tickets. If Dublin-New York and New York-Los Angeles have separate ticket contracts, the first ticket's destination may be New York. The passenger may still have insurance or other claims for the self-transfer, but should not assume EU261 reaches the second booking.
Events covered by EU261
Delay
Final arrival at least three hours late can trigger compensation. Most direct JetBlue EU-US routes exceed 3,500 km and therefore begin in the EUR 600 band. The amount can be reduced by half where qualifying rerouting delivers the passenger within four hours of schedule.
Cancellation
Passengers choose reimbursement or rerouting and retain care while waiting. Fixed compensation depends on notice timing, the replacement schedule and extraordinary circumstances. At least 14 days' notice normally removes the fixed cancellation amount.
Denied boarding
An eligible passenger who checked in and presented on time but was involuntarily refused due to oversales can receive fixed compensation, rerouting or reimbursement and care. Do not sign a volunteer document without understanding the offer.
Downgrade
A lower cabin on the protected flight creates a percentage reimbursement of the affected ticket price under Article 10. This does not require a three-hour delay and is calculated separately from fixed compensation.
Cause and reasonable measures
JetBlue is not automatically liable whenever an EU departure is disrupted. It may avoid fixed delay or cancellation compensation by proving an extraordinary event that could not have been avoided despite reasonable measures.
Severe weather, air traffic management decisions, airport closure or an external security event may qualify. Ordinary technical faults, lack of crew, aircraft rotation and routine operational decisions generally remain within carrier control under EU case law. The precise facts matter more than a generic label.
Ask for the event's location and timing, its connection to the specific flight and the mitigation attempted. The duty of care remains even where the defence succeeds.
Care, rerouting and self-purchased transport
During a qualifying wait, JetBlue should provide reasonable meals and communication. An overnight delay can require hotel accommodation and transport between the airport and hotel. Keep itemised receipts if direct assistance is not practical.
After cancellation, rerouting at the earliest opportunity is not necessarily restricted to JetBlue's next service. Ask JetBlue for a reasonable alternative and preserve its answer. If a suitable partner flight exists but the airline offers several days of waiting, a carefully documented replacement purchase may be recoverable. Necessity, comparable travel conditions and price proportionality matter.
Reimbursement is the alternative when the passenger abandons the trip. After a delay of five hours, it can also become available even if the flight has not been cancelled. See the five-hour refund guide.
Route examples
Amsterdam-Boston: arrival four hours late after a routine aircraft defect. The EU departure and long distance point toward EUR 600 per eligible passenger, subject to proof and no valid defence.
Paris-New York-San Juan: the first flight is late, the connection is missed and final arrival is six hours late. On one booking, San Juan is the measurement point. If the replacement arrives within the long-haul reduction window, the amount may be EUR 300 rather than EUR 600.
New York-Paris: arrival five hours late. The destination does not create EU261 coverage for JetBlue. Examine US refund rights, JetBlue policy and proven losses instead.
Dublin-New York cancellation: a replacement leaves the next day. The passenger can choose rerouting or reimbursement, request care and test EUR 600 fixed compensation using notice and cause.
Evidence and submission
Retain the ticket showing the first EU airport, all connecting sectors, boarding passes, operated-by details, final arrival proof, disruption messages, alternatives and receipts. If another airline operated a sector, identify it rather than sending every claim to the JetBlue marketing name.
Write the request around Article 7 compensation, Article 8 reimbursement or rerouting and Article 9 care as separate items. State the amount per passenger. A concise chronology is more useful than screenshots with no explanation.
The legal position was checked on 14 August 2026. The EU reform adopted in July 2026 has not been applied here before its future application date.
FAQ
Is JetBlue subject to EU261 even though it is American?
Yes, for flights departing the covered EU territory. The regulation applies to carriers of any nationality on those departures.
Does EU261 cover JetBlue from New York to Paris?
Normally no, because JetBlue is not an EU carrier and the flight begins outside the EU.
Can a US domestic connection be included?
Yes, when it forms part of one booking that began in the EU and final arrival is sufficiently late.
Is Ireland included in EU261?
Yes. A JetBlue departure from Dublin is an EU departure, regardless of US preclearance arrangements.
Does extraordinary weather remove meals and hotel rights?
No. It may remove fixed compensation, but the duty of care generally continues on a covered departure.
