Iberojet package holiday disruption: airline claim or organiser claim?
An Iberojet package disruption can create two valid claims because the airline and organiser perform different contracts. EU261 follows the operating air carrier and addresses the flight. Package law follows the organiser and addresses the holiday as a whole. Contacting both is sensible; describing the same hotel night as two separate losses is not.

Identify the airline behind the package voucher
Many Iberojet passengers receive an agency voucher rather than a conventional airline email. Find the e-ticket coupon and operated-by line. Iberojet is the brand used by Spanish Evelop, associated with E9, and Portuguese Orbest, associated with 6O. Both are EU carriers.
An Iberojet-operated departure from Madrid, Lisbon or another EU airport can engage EU261. An Evelop- or Orbest-operated return from a third country into the EU may also be covered because those companies are EU carriers. If a partner actually operated the sector, reassess it. The organiser's name and the passenger's residence do not decide airline coverage.
Send flight-performance remedies to the operating carrier
Cancellation gives a covered passenger a choice between reimbursement and rerouting. Significant waiting can trigger meals, communications, hotel accommodation and transfers. A qualifying cancellation, long final-arrival delay or denied boarding may also produce EUR 250, EUR 400 or EUR 600 fixed compensation, subject to distance and defences.
These requests go to the operating air carrier. Accepting rerouting does not ordinarily settle fixed compensation. Extraordinary circumstances may defeat the fixed award, but do not automatically remove care or the cancellation choice. Use Iberojet's form with the locator and surname and preserve the submission.
Ask the organiser to repair the package
The organiser remains responsible for package performance: accommodation, transfers and other included services, as well as appropriate assistance and possible price reduction or damages where legal conditions are met. A cancelled first night, unusable transfer or materially shortened stay should be explained to the organiser with the package contract and evidence.
Do not let either respondent redirect every issue to the other. The airline cannot avoid EU261 solely because the seat was part of a package. The organiser cannot treat the flight problem as irrelevant where it prevents contracted holiday services. Frame each request by the obligation that party undertook.
Worked example: two lost nights in Cancún
Samantha and Idris buy a seven-night Madrid package including an E9-operated flight, hotel and transfers. The departure is cancelled on the day and Iberojet reroutes them 40 hours later. Madrid is an EU departure and the coupon names Evelop. They request earliest rerouting and reasonable care from the airline, retaining meal, hotel and transfer receipts.
Their possible fixed EU261 claim is calculated per passenger, separately from those costs. They ask the organiser for a proportionate remedy for two unusable package nights and the missed transfer. If the organiser refunds a particular Madrid hotel receipt, they remove that item from the airline expenses schedule. The statutory fixed award is not simply payment for the lost resort nights and is not automatically duplicated by a package price reduction.
If Iberojet cites extraordinary weather, the couple request the specific event and reasonable measures. Even if that defence succeeds, their rerouting and care analysis remains, and the organiser's package responsibilities require their own decision.
Keep baggage and consequential loss out of the wrong claim
A delayed, lost or damaged suitcase follows the Montreal Convention. File a PIR promptly, retain the bag tag and submit a written claim with receipts within the applicable time. Essential clothing bought because the bag arrived late is not an EU261 meal expense.
Other consequential losses require proof, causation and the correct legal basis. Do not disguise every missed excursion as EUR 600 flight compensation. Give the organiser the package-loss schedule and give the airline the flight schedule. Any additional damages must account for sums already recovered.
Build two coordinated evidence files.
The airline file should contain the original coupon, operating carrier, notice, final arrival, reroute and care receipts. The organiser file should contain the package contract, itinerary, hotel and transfer terms, notice given to the representative and proof of the holiday services lost. Cross-reference payments so no item appears twice.
If either claim is refused, challenge the disputed issue. Spanish or Portuguese flight-enforcement routes depend on departure and event, not on the agent's language. Package redress depends on the organising contract and applicable market law. Save all acknowledgements and seek jurisdiction-specific limitation advice rather than applying the deferred nine-month reform.
