Iberia delayed flight: when compensation is due

An Iberia delay can produce EUR 250, EUR 400 or EUR 600 when a protected itinerary reaches its final destination at least three hours late and Iberia cannot prove extraordinary circumstances plus reasonable measures. The clock normally stops when a door opens, not when the aircraft lands. A delayed first sector may also qualify when it causes a missed connection on one booking, even if that feeder itself was less than three hours late. Care starts earlier than the compensation threshold.

Do not reject a claim simply because Iberia's departure delay was 2 hours 45 minutes. If a Madrid connection was lost and the final destination was reached six hours late, final arrival controls on a through booking.

How to prove arrival time

The Court of Justice in Germanwings v Henning treated arrival as the time at which at least one aircraft door opens and passengers may leave. Touchdown, parking and the first baggage belt message can differ by many minutes. That matters near the three-hour boundary.

Record a timestamped message, photo of the gate display, airport notification or written confirmation. Flight-tracking data is useful corroboration. If Iberia disputes a claim by a few minutes, ask it to disclose the recorded door-opening time rather than relying on a rounded website status.

Connecting itineraries through Madrid

On one reservation, EU261 assesses the delay at the last ticketed destination. A Manchester-Madrid-Lima journey beginning in the UK is assessed under UK261 for the UK departure; a Paris-Madrid-Lima journey starts in the EU and is assessed under EU261. An Iberia-operated Lima-Madrid-Paris journey can also fall under EU261 because Iberia is an EU carrier arriving into the EU.

The itinerary must be contractually connected. Two tickets combined by an online travel app do not become one protected journey merely because the timings fit. A domestic Spanish leg is often in the EUR 250 band. A longer intra-EU itinerary can reach EUR 400. Madrid-New York, Madrid-Mexico City or an eligible inbound Iberia-operated long haul can reach EUR 600. Measure the protected journey, not the ticket price or number of hours waited.

For a long route, Iberia may reduce EUR 600 to EUR 300 only when the statutory rerouting arrival window is met. It cannot halve payment merely because the passenger accepted rerouting.

Care begins before three hours

Article 9 care is tied to expected departure delay and route band. Iberia should provide reasonable meals and refreshments, communication, and where needed a hotel plus transport between the airport and accommodation. These duties continue even when weather or air traffic restrictions caused the delay.

If no usable voucher or room is provided, purchase only what is reasonably necessary and keep itemised receipts. Record the request and Iberia's response. Alcohol, luxury accommodation and unrelated shopping are harder to recover. Keep care costs separate from the fixed amount.

The five-hour choice

When departure is delayed at least five hours and the journey no longer serves its purpose, EU261 permits reimbursement of unused ticket parts and, where relevant, used parts that no longer serve the original travel plan, plus a return to the first departure point. Choosing to abandon travel is different from missing the flight without notifying Iberia.

Ask Iberia to record the decision as involuntary. Do not press a generic “cancel booking” button that may classify the event as passenger cancellation. Save the delay notice and refund request.

Cause analysis

Iberia must connect the asserted extraordinary event to this flight and show reasonable measures. A thunderstorm over Madrid, ATC capacity restriction or airport closure can qualify. The words “operational reasons” prove nothing. Routine component failure, maintenance planning or lack of available crew within normal operations generally needs a more convincing defence.

Rotation evidence matters. Weather on an earlier flight does not automatically excuse every later sector operated by the same aircraft. Ask for the affected rotation, time of the restriction, recovery steps and why another aircraft or crew was not reasonably available. Read the Iberia causes guide before responding.

A clean evidence file

Keep the PNR, e-ticket, boarding pass, original schedule, delay notifications, operating carrier, new itinerary and final door-opening time. Add receipts and a chronology. For a family claim, identify every passenger and ticket number; the amount is calculated per eligible traveller.

Submit the fixed amount, care expenses and any refund on separate lines through the Iberia claim form. Preserve the claim reference and attachments. If Iberia pays expenses but ignores compensation, the unpaid line remains open unless the passenger accepted a clear settlement.

For several passengers on one booking, prepare a short table with each name, ticket number and requested fixed amount. One person may submit with authorisations, but a single PNR does not turn the family into one claimant. If a child travelled on an issued ticket, include that ticket rather than silently omitting the child. This avoids a common partial payment in which Iberia assesses only the lead passenger.

FAQ

Is a three-hour departure delay enough?

Not by itself. The usual fixed claim depends on arrival at the final destination at least three hours late. Departure time controls different rights such as care and the five-hour refund choice.

Does touchdown stop the delay clock?

No. The Court of Justice uses the opening of at least one aircraft door so passengers can leave.

Can a 45-minute feeder delay produce EUR 600?

Yes, if it causes a missed connection on one booking and the long-haul final destination is reached at least three hours late, subject to cause and coverage.

Does Iberia owe meals during an ATC delay?

Yes. ATC restrictions may exclude fixed compensation, but they do not remove reasonable care duties.

Can I stop travelling after five hours?

EU261 provides a refund choice after a qualifying five-hour departure delay. Notify Iberia and preserve evidence that the abandonment was caused by the disruption.
