Ethiopian Airlines flight compensation: when EU261 or UK261 applies

Ethiopian Airlines may owe fixed compensation when it operates a seriously disrupted journey that starts in the European Union, EEA or United Kingdom. A qualifying EU departure can be worth EUR 250, EUR 400 or EUR 600 per passenger; a qualifying UK departure can be worth GBP 220, GBP 350 or GBP 520. An Ethiopian-operated journey starting in Ethiopia or another African country normally does not acquire EU261 or UK261 protection merely because it ends in Europe.

Start with direction, not the airline logo

Ethiopian Airlines is licensed outside the EU and UK. That makes direction decisive. EU261 covers a flight leaving an EU or EEA airport regardless of the carrier's nationality. UK261 similarly covers a departure from a UK airport. For a flight arriving from a third country, however, carrier status becomes important and Ethiopian normally fails the European or UK carrier condition.

Citizenship, residence, booking currency and the location of a travel agent do not replace this test. A return ticket is also examined by direction: the outbound European journey may qualify while the African return does not.

Which events can produce fixed compensation?

For a delay claim, measure the difference between scheduled arrival and the time at least one aircraft door opened so passengers could leave at the final ticketed destination. A late departure alone is not enough. An arrival delay of at least three hours is normally required under EU261 and UK261.

A cancellation can produce compensation when notice was given less than 14 days before departure, subject to the replacement-flight timing exceptions and extraordinary circumstances. Involuntary denied boarding can also qualify when the passenger had a confirmed reservation, presented on time and satisfied travel-document requirements. Do not accept a volunteer package without understanding that voluntary surrender changes the legal analysis.

Care, rerouting, fare reimbursement and a cabin-downgrade repayment are separate from the fixed amount. More than one remedy may arise from the same disruption.

The amount depends on the protected journey

EU261 uses EUR 250, EUR 400 and EUR 600 distance bands. UK261 uses GBP 220, GBP 350 and GBP 520. Most protected journeys from Europe or the UK through Addis Ababa to a distant African destination sit in the longest band, but distance must be measured for the actual ticket rather than assumed from the airline name.

On a long EU journey, compensation may be reduced from EUR 600 to EUR 300 when rerouting or final delay falls within the statutory reduction window. UK long-haul delay compensation is GBP 260 for an arrival between three and four hours late and GBP 520 once the delay reaches four hours. Amounts are per eligible passenger. If two adults and two children with confirmed seats on a covered Frankfurt-Addis Ababa-Cape Town booking arrive more than four hours late for an airline-controlled reason, the potential EU figure is four times EUR 600, not one household payment.

One booking can protect the destination beyond Addis Ababa

EU law defines final destination as the last destination on a directly connecting ticket. The Court of Justice has confirmed that a single booking leaving the EU can remain within EU261 when the passenger changes aircraft outside the EU and continues to another non-EU airport. That principle is important for Ethiopian's Addis Ababa connections.

Suppose a passenger holds one ticket from Brussels through Addis Ababa to Nairobi. A disruption causes a missed onward flight and arrival in Nairobi five hours late. The final delay, not merely the time in Addis Ababa, is relevant. If the two sectors were bought as separate tickets, the second booking is not automatically folded into the first; consequential loss requires a different analysis.

Identify the actual operating carrier

An ET flight number is a marketing clue, not conclusive proof. Ethiopian sells and carries codeshare itineraries with partner airlines. EU261 and UK261 generally place duties on the carrier that performed or intended to perform the relevant flight.

Look for “operated by” on the e-ticket receipt, original itinerary and boarding pass. If a Star Alliance partner operated the disrupted sector, the fixed claim may belong with that partner. Conversely, a partner's marketing code on an Ethiopian aircraft does not turn Ethiopian into an EU carrier on an inbound African departure. Use the codeshare and operating-carrier guide before naming the respondent.

Extraordinary circumstances require proof

Severe weather, an external air-traffic-control restriction, airport closure or a security event can remove fixed compensation if Ethiopian proves the event caused the disruption and could not have been avoided with reasonable measures. A label such as “operational reasons” does not satisfy that burden by itself.

Routine technical defects arising in normal airline activity are generally not extraordinary under EU and UK case law. Hidden manufacturing defects, sabotage or certain external damage can be different. Ask for the precise event, location, time, affected rotation and mitigation. A genuine extraordinary event does not erase the continuing duty to offer care and, after cancellation, refund or rerouting.

Refund, rerouting and care remain distinct

After a covered cancellation, the passenger generally chooses reimbursement or rerouting at the earliest opportunity, with a later-date option under comparable conditions. After a delay of at least five hours, abandoning the journey may open reimbursement rights for the unused travel and, where relevant, a return to the first departure point.

During a qualifying wait, the airline must provide reasonable meals, communications, hotel accommodation and airport-hotel transport when an overnight stay becomes necessary. If Ethiopian provides nothing, buy only reasonable essentials and retain itemised receipts. These costs are not deducted from fixed compensation merely because they arise from the same flight.

Evidence to save before the record changes

Keep the complete e-ticket, PNR, receipt, original and replacement boarding passes, every “operated by” entry, disruption messages and the first cancellation notice. Record scheduled and actual final arrival in one time zone. Save the replacement itinerary even if the app later overwrites it.

For expenses, retain merchant receipts showing item and date. For a group, list each passenger and obtain authority from other adults if requested. A concise chronology supported by documents is more useful than a long complaint based on memory.

FAQ

Does every delayed Ethiopian Airlines flight earn EUR 600?

No. EUR 600 requires EU261 territorial coverage, the longest distance band, a qualifying arrival delay or other event, and no successful extraordinary-circumstances defence.

Is Addis Ababa to Europe covered by EU261?

Normally not when Ethiopian operates a journey beginning in Addis Ababa, because it is not an EU carrier. Check the operator and complete itinerary before closing the case.

Can a London departure earn GBP 520?

Yes. An Ethiopian-operated journey leaving a UK airport can fall under UK261 and reach the long-haul amount when the timing and cause tests are met.

Are children paid separately?

Children with eligible confirmed tickets are assessed per passenger. A free infant travelling without a reserved seat can require closer analysis.

Does extraordinary weather remove hotel rights?

No. It may remove fixed compensation, but the duty of care on a covered journey continues while the passenger waits for rerouting.
