easyJet Switzerland compensation: EC261 rights from Geneva and Basel
Reviewed on 10 August 2026. Switzerland applies Regulation (EC) No 261/2004 through its air transport agreement with the EU. An easyJet flight leaving Geneva, Basel or another Swiss airport is therefore within the passenger-rights framework regardless of which easyJet airline operates it. FOCA monitors Swiss cases, but Swiss treatment of later EU court judgments requires care, especially for compensation based only on a long delay.

FOCA states that the Regulation covers all travellers departing from the EU, Switzerland, Norway or Iceland. It also covers a third-country departure to that area when the operating airline has its principal place of business in one of those states. The actual carrier therefore matters on an inbound journey.
Do not decide by booking currency, passenger nationality or the U2 marketing code. Check the boarding pass and booking for the operating airline and flight designator. easyJet's conditions identify EZS flights as normally operated by easyJet Switzerland S.A., EJU by easyJet Europe Airline GmbH and EZY by easyJet UK Limited.
Which authority handles the case
FOCA says it is competent when the flight originates in Switzerland. It also handles a journey beginning outside the covered area when the first landing is in Switzerland and the operating carrier brings the flight within scope. A departure from Paris, Amsterdam or another EU airport normally belongs with that state's enforcement body instead.
A FOCA complaint can prompt investigation and possible administrative action. FOCA expressly explains that it cannot enforce the passenger's compensation payment itself. If easyJet still refuses to pay, a civil claim may be needed in a court with jurisdiction.
Send easyJet the complete claim first. Include the booking, operating entity, route, disruption, actual arrival and amount. Preserve the airline's final response before escalating.
The Swiss case-law qualification
The Regulation's written text grants compensation for cancellation and involuntary denied boarding, subject to its exceptions. The familiar right to fixed payment after arrival at least three hours late developed through Court of Justice judgments delivered after the EU-Switzerland agreement's historical reference date.
FOCA says judgments of the Court of Justice before 21 June 1999 guide interpretation under the agreement. Later judgments are communicated through the Joint Committee and can guide Swiss authorities and courts, but they are not automatically binding in Switzerland. FOCA's delay page therefore says it cannot fine an airline merely for failing to pay delay compensation where the Regulation itself lacks an express delay-payment provision.
This does not mean every Swiss delay claim fails. It means a claimant should not present EU case law as mechanically identical in every Swiss forum. The route, operating carrier, available jurisdiction and current Swiss decisions matter. A qualifying cancellation or denied boarding has a more direct textual basis than payment demanded solely for three hours of delay.
For a London departure, UK261 and UK courts provide a different legal route. For an EU departure, the applicable EU framework and Court of Justice interpretation ordinarily govern there. Use the easyJet UK-versus-EU guide before choosing a forum.
Amounts and distance
The adopted Swiss Regulation uses the EC261 euro bands:

Measure the great-circle distance between relevant airports rather than the aircraft's flown track. Confirm the exact airport: EuroAirport Basel Mulhouse Freiburg has the IATA code BSL for the Swiss side and sits in France physically, so documentation and route treatment deserve careful checking rather than a casual city label.
Compensation can be reduced in specified rerouting situations where arrival remains within the Regulation's thresholds. It can also be excluded when easyJet proves extraordinary circumstances and reasonable measures. Refund, alternative transport and care do not automatically disappear with that defence.
Cancellation, care and refund
After cancellation, choose between reimbursement, earliest reasonable rerouting or later rerouting subject to availability. A voucher is voluntary. When waiting for replacement travel, reasonable meals, hotel accommodation where an overnight stay becomes necessary, transport between airport and hotel, and two communications can be due.
FOCA's guidance confirms that care remains available during cancellations and long delays, including weather disruption. A delay of at least five hours also allows the passenger to abandon the flight and request ticket reimbursement.

Evidence for Geneva or Basel
Save:
- confirmation and boarding pass showing the flight designator;
- the name of the operating easyJet company;
- scheduled and actual airports and times;
- cancellation notice or door-opening arrival evidence;
- easyJet's stated reason and operational messages;
- replacement itinerary and final arrival;
- receipts for necessary care;
- easyJet claim and final response.
For Basel, preserve the exact airport code, terminal-side information and journey documents. For an inbound third-country flight, prove that the relevant easyJet company actually operated the aircraft.
Submit through the easyJet compensation form guide and escalate to FOCA only for a case within its competence. A civil limitation period and available court depend on the claim and forum, so act promptly.
The 2026 reform is not current law yet
EU institutions adopted a passenger-rights reform in July 2026, but its application is deferred until after publication and the stated transition. Its future claim periods and other changes do not govern a disruption on 10 August 2026 merely because the political process is complete.
Switzerland would also require the relevant agreement process for incorporated changes. Apply the current adopted Regulation and verify future Swiss implementation separately rather than projecting EU dates automatically.

Does EC261 apply when easyJet leaves Geneva?
